Justice M.L.JOSEPH FRANCIS\n\n Dated :19\/08\/2009\n\n O R D E R\n          K.M.JOSEPH &amp; M.L.JOSEPH FRANCIS, JJ.\n        ------------------------------------------------------\n                   M.A.C.A.No.826 of 2007\n            ----------------------------------------------\n          Dated, this the 19th     day of August, 2009\n\n                         J U D G M E N T\n<\/pre>\n<p>K.M.Joseph, J.\n<\/p>\n<p>             Appellants are the claimants 2 to 8 in a petition<\/p>\n<p>filed under Section 166 of the Motor Vehicles Act. The first<\/p>\n<p>claimant was the widow of the deceased and the mother of the<\/p>\n<p>appellants.   Feeling aggrieved by the amount awarded this<\/p>\n<p>appeal is filed.\n<\/p>\n<p>             2. We heard the learned counsel for the appellants<\/p>\n<p>and learned counsel for the insurance company.<\/p>\n<p>             3.    The Tribunal has awarded Rs.2,24,560\/-.<\/p>\n<p>Rs.1,12,520\/- represents medical expenses. Rs.80,040\/- has<\/p>\n<p>been awarded towards loss of dependency.            Apart from that<\/p>\n<p>appellant has been granted Rs.15,000\/- towards pain and<\/p>\n<p>suffering Rs.10,000\/- towards loss of love and affection. Of<\/p>\n<p>course, no amount is seen awarded towards loss of<\/p>\n<p>consortium. The widow passed away during the pendency of<\/p>\n<p>the petition.\n<\/p>\n<p>             4.  The main      contention raised by the learned<\/p>\n<p>counsel for the appellants is that the Tribunal has attributed<\/p>\n<p>25 percent negligence to the deceased.            He would submit<\/p>\n<p><span class=\"hidden_text\"> MACA No.826\/2007                -2-<\/span><\/p>\n<p>that it cannot be sustained.\n<\/p>\n<p>            5.  Learned counsel for the insurance company<\/p>\n<p>supported the award.\n<\/p>\n<p>            6.  The deceased was riding a cycle when the<\/p>\n<p>accident took place. The Tribunal has found that the total<\/p>\n<p>width of the road is 10 metres and the accident was about<\/p>\n<p>3.80 metres from the western tar end.      It is found that the<\/p>\n<p>deceased was almost crossing the road but had not reached<\/p>\n<p>the western extremity. Some degree of negligence is found<\/p>\n<p>on the part of the deceased.         It is on this basis that<\/p>\n<p>contributory negligence is found and Rs.25% is deducted. As<\/p>\n<p>noticed, from the award of Rs.2,24,560\/- nearly more than<\/p>\n<p>half that is Rs.1,12,520\/- represents medical expenses. The<\/p>\n<p>deceased was on a cycle.       The accident took place on a<\/p>\n<p>National Highway.     Of course, the learned counsel for the<\/p>\n<p>insurance company contended that the lorry was driven very<\/p>\n<p>slowly.\n<\/p>\n<p>            7. Having regard to the place of the accident and<\/p>\n<p>the fact that the deceased was riding a cycle we feel that the<\/p>\n<p>Tribunal is not justified in attributing 25 percent negligence<\/p>\n<p><span class=\"hidden_text\"> MACA No.826\/2007                 -3-<\/span><\/p>\n<p>on the part of the deceased. But, we are also not inclined to<\/p>\n<p>accept the case of the appellants in toto. There is negligence<\/p>\n<p>on the part of the deceased also. We would be justified to<\/p>\n<p>apportion the negligence between the deceased and the lorry<\/p>\n<p>driver on the ratio 10:90. On this basis the appellants would<\/p>\n<p>be entitled to Rs.2,02,000\/- in place of Rs.1,68,420\/-. Even<\/p>\n<p>though    the   appellants  contend     that  the  amount    of<\/p>\n<p>Rs.15,000\/- granted towards pain and suffering is inadequate<\/p>\n<p>since the deceased was in hospital for one month we are not<\/p>\n<p>satisfied that the said award is unjust.
