This bail<br \/>\napplication is filed on 23.8.2011 before this Court.\n<\/p>\n<p>\tMr.Maulik<br \/>\nNanavati, learned APP appearing for the respondent &#8211; State<br \/>\nsubmits that Investigating Officer &#8211; Mr. Ramgadiya, Police<br \/>\nInspector, Crime Branch, Vadodara City, is already informed by him to<br \/>\nremain present today before this Court with police papers, but he did<br \/>\nnot turn up.\n<\/p>\n<p>\tIt<br \/>\nis required to be noted that Additional Public Prosecutor or Public<br \/>\nProsecutor is officer of this Court and when they are giving any<br \/>\ninstruction to the Investigating Agency to appear before this Court<br \/>\nthen it should be considered as instruction is given under the<br \/>\ndirection of this Court. Today two persons are present before this<br \/>\nCourt in civil dress. One is Mr.J. S. Geddam- Police Inspector<br \/>\nand Mr.Kamlesh &#8211; Writer. It is stated by Mr.J. S. Geddam that<br \/>\nhe is instructed by  Mr. Ramgadiya, Police Inspector to appear before<br \/>\nthis Court. He is not Investigating Officer of this case and he is<br \/>\nnever called by learned APP. I have inquired from  Mr. J. S. Geddam-<br \/>\nPolice Inspector whether  Mr. Ramgadiya, Police Inspector is promoted<br \/>\nas D.C.P. or Dy.S.P. Mr.J. S. Geddam informed the Court that  Mr.<br \/>\nRamgadiya is simply Police Inspector and he is his colleague. I do<br \/>\nnot understand how Mr.J. S. Geddam- Police Inspector is sent by<br \/>\n Mr. Ramgadiya, Police Inspector before this Court when both are<br \/>\nPolice Inspector.  Mr. Ramgadiya, Police Inspector is not on leave.<br \/>\nMr. Nanavati submits that Mr. Ramgadiya, Police Inspector has gone<br \/>\nAnand for the custody of some other accused person. This conduct of<br \/>\nthe Police Inspector can be said to be negligent conduct. How Mr.<br \/>\nRamgadiya, Police Inspector  can send Mr.J. S. Geddam- Police<br \/>\nInspector before this Court.\n<\/p>\n<p>\tIssue<br \/>\nnotice to Mr. Ramgadiya, Police Inspector, D.C.B. Police Station,<br \/>\nVadodara City Police Station returnable on 9.9.2011 to appear before<br \/>\nthis Court. If Mr. Ramgadiya, Police Inspector fails then appropriate<br \/>\naction will be taken against him.\n<\/p>\n<p>\t\t\t\t \t\t\t  (Z. K.
