AKIL KURESHI)<\/p>\n<p>This<br \/>\n\tpetition styled as Public Interest Litigation has been filed by one<br \/>\n\tShri Lalit Shah seeking prayer for  a direction to the Agriculture<br \/>\n\tand Cooperation Department of the Government of Gujarat to formulate<br \/>\n\tan appropriate scheme for repayment of money of the depositors by<br \/>\n\tway of implementation of One Time Settlement(OTS for short) for the<br \/>\n\tborrowers of the banks in liquidation in conformity with the<br \/>\n\tguidelines of Reserve Bank of India(RBI for short).\n<\/p>\n<p>The<br \/>\n\tcase of the petitioner is that he has made deposits with one<br \/>\n\tCharotar Nagrik Sahkari Bank which is a cooperative bank which is<br \/>\n\tunder liquidation. RBI has issued guidelines vide communication<br \/>\n\tdated 10.4.2006 to the Secretaries of the States for framing of<br \/>\n\tscheme for  OTS to be granted to the borrowers of the various Urban<br \/>\n\tCooperative Banks. It is also<br \/>\n\tthe case of the petitioner that though the State Government<br \/>\n\tformulated a scheme for OTS, for cooperative banks operating in the<br \/>\n\tState of Gujarat, in disregard to the said guidelines issued by RBI<br \/>\n\texcluded from operation of such a scheme, those Cooperative Banks<br \/>\n\twhich had gone under liquidation. It is not in dispute that<br \/>\n\tthe State Government had issued a separate one time settlement<br \/>\n\tscheme specifically meant for those Cooperative Banks which were<br \/>\n\tunder liquidation. Such scheme was framed vide resolution dated<br \/>\n\t18.5.2007.\n<\/p>\n<p>The<br \/>\n\tcase of the petitioner however, is that scheme framed under<br \/>\n\tresolution dated 18.5.2007 which is applicable for Cooperative Banks<br \/>\n\tunder liquidation is different and the provisions for OTS are more<br \/>\n\tstringent than the earlier scheme framed by the Government under<br \/>\n\tresolution dated 8.6.2006 covering the  Cooperative Banks which are<br \/>\n\tnot in liquidation.\n<\/p>\n<p>Appearing<br \/>\n\tfor the petitioner, learned advocate Shri Y.N. Oza  with Shri Tejas<br \/>\n\tBarot submitted that the State Government could not have<br \/>\n\tdiscriminated between the Cooperative Banks which are under<br \/>\n\tliquidation and those which are not in liquidation. He submitted<br \/>\n\tthat RBI guidelines dated  10.4.2006  made no such distinction and<br \/>\n\tit was therefore, not open for the State Government to make a<br \/>\n\tseparate and different scheme for  Cooperative Banks under<br \/>\n\tliquidation from one covering those banks which were not in<br \/>\n\tliquidation. He contended that directions issued by RBI under<br \/>\n\tSection 21 and 35 A of the Banking Regulation Act are binding on the<br \/>\n\tState Government since the RBI under the Reserve Bank of India Act<br \/>\n\tas well as under the Banking Regulation Act has exclusive authority<br \/>\n\tto issue such directions and the subject matter was exclusively<br \/>\n\twithin the legislative powers of the Union.\n<\/p>\n<p>4.1\t\tReliance<br \/>\n\twas placed on the decision of the Apex Court in case of <a href=\"\/doc\/103959\/\">Joseph<br \/>\n\tKuruvilla Vellukunnel v. Reserve<\/a> bank of India and others<br \/>\n\treported in 1962 Supp(3) SCR 632, wherein the Apex Court was pleased<br \/>\n\tto consider at length the nature of powers enjoyed and duties to be<br \/>\n\tperform by RBI under the Reserve Bank of India Act.\n<\/p>\n<p>4.2\t\tReliance<br \/>\n\twas placed on the decision in case of <a href=\"\/doc\/1423031\/\">Central Bank of India v.<br \/>\n\tRavindra and others<\/a> reported in (2002) 1 Supreme Court Cases<br \/>\n\t367, wherein in paragraph 55(5), the Apex Court observed that the<br \/>\n\tReserve Bank of India is the prime banking institution of the<br \/>\n\tcountry entrusted with a supervisory role over banking and conferred<br \/>\n\twith the authority of issuing binding directions having statutory<br \/>\n\tforce, in the interest of the pubic in general and preventing<br \/>\n\tbanking affairs from deterioration and prejudice as also to secure<br \/>\n\tthe proper management of any banking Company.\n<\/p>\n<p>4.3\t\tReliance<br \/>\n\twas also placed on the decision in case of Corporate Bank v. D.S.<br \/>\n\tGowda and another reported in (1994) 5 Supreme Court Cases 213,<br \/>\n\twherein once again nature of powers of RBI to issue directions were<br \/>\n\tdiscussed.\n<\/p>\n<p>4.4\t\tLearned<br \/>\n\tcounsel also relied on following decisions to contend that the State<br \/>\n\tGovernment had no authority to formulate its own scheme for one time<br \/>\n\tsettlement for the Cooperative Banks under liquidation since it was<br \/>\n\tthe subject matter exclusively within the domain of RBI considering<br \/>\n\tthe legislative powers of the Union as per Entry No. 45 of List I.\n<\/p>\n<p>1)\tUnion<br \/>\n\tof India and another v. Delhi High Court Bar Association and others<br \/>\n\treported in (2002) 4 Supreme Court Cases 275.\n<\/p>\n<p>2)\t<a href=\"\/doc\/1036462\/\">State<br \/>\n\tof Maharashtra v. Sant Dnyaneshwar Shikshan Shastra Mahavidyalaya<br \/>\n\tand others<\/a>  reported in (2006) 9 SCC 1<\/p>\n<p>3)\tProf.\n<\/p>\n<p>\tYashpal and another v. State of Chhatisgarh and others reported<br \/>\n\tin (2005) 5 Supreme Court Cases 420.\n<\/p>\n<p>4)\tBharti<br \/>\n\tVidyapeeth(Deemed University) and others v. State of Maharashtra and<br \/>\n\tanother reported in 2004 11 Supreme Court Cases  755<\/p>\n<p>On<br \/>\n\tthe other hand, learned Advocate General Shri Kamal Trivedi<br \/>\n\tappearing for the State Government opposed the petition and<br \/>\n\tsubmitted that the petitioner has not disclosed any public interest.<br \/>\n\tHe also submitted that the State Government after careful<br \/>\n\tconsideration formulated a suitable scheme for the Cooperative Banks<br \/>\n\tunder  liquidation to suit the special requirements of such banks.<br \/>\n\tThere was no rigid directives from the RBI to formulate OTS Scheme<br \/>\n\tand it was therefore, within the discretion of the State Government<br \/>\n\tto formulate a scheme for those Cooperative Banks which were under<br \/>\n\tliquidation. In any case, OTS Scheme formulated by resolution dated<br \/>\n\t8.6.2006 under  the guidelines issued by RBI was time bound and the<br \/>\n\tscheme is no longer operational as the period for which the scheme<br \/>\n\twas framed is over.\n<\/p>\n<p>5.1\t\tHe<br \/>\n\trelied on decision of the Apex Court in case of Oriental Bank of<br \/>\n\tCommerce v. Sunder Lal Jain and another reported in (2008) 2<br \/>\n\tSupreme Court Cases 280, wherein the order of the High Court issuing<br \/>\n\tmandamus directing the concerned banks for applying the guidelines<br \/>\n\tof the RBI for declaring the account of the petitioner as Non<br \/>\n\tPerforming Asset was set aside, observing that in order that a writ<br \/>\n\tof mandamus may be issued there must be a legal right with the party<br \/>\n\tasking for the writ to compel the performance of some statutory duty<br \/>\n\tcast upon the authorities.\n<\/p>\n<p>5.2\t\tHe<br \/>\n\tfurther submitted that guidelines issued by RBI cannot be termed as<br \/>\n\tdirectives or statutory guidelines under Section 21 or 35A of the<br \/>\n\tBanking Regulation Act<\/p>\n<p>Having<br \/>\n\tthus heard learned advocates appearing for the parties at<br \/>\n\tconsiderable length, we find that in facts of the present case, it<br \/>\n\tis not necessary to go into the question of legislative powers of<br \/>\n\tthe Union or the State with respect to the subject matter under<br \/>\n\tconsideration for the reasons recorded here-in-after.\n<\/p>\n<p>We<br \/>\n\tfind that RBI guidelines issued under communication dated 19.4.2006<br \/>\n\tdid not provide for a rigid straitjacket formula for preparing OTS<br \/>\n\tScheme. In paragraph-2 of the said communication, it is clearly<br \/>\n\tstated that the guidelines for one OTS Scheme is forwarded  which<br \/>\n\tcould be modified to be in  the line with the legal position<br \/>\n\tobtaining as per the provisions of the Cooperative Societies<br \/>\n\tAct\/Rules. In the later portion of paragraph-2, it is again<br \/>\n\tstated that the State Government  may consider the same and<br \/>\n\tissue necessary notification\/administrative orders to primary<br \/>\n\tCooperative Banks under their jurisdiction on the lines indicated.\n<\/p>\n<p>It<br \/>\n\tcan thus be seen that the communication itself left sufficient<br \/>\n\tdiscretion to the State Government to suitably adopt and when need<br \/>\n\tbe, modify the terms of the scheme. The State Government after due<br \/>\n\tconsideration in its wisdom at the first instance, formulated a OTS<br \/>\n\tScheme under resolution dated 8.6.2006 covering all the Cooperative<br \/>\n\tBanks which were not in liquidation. Subsequently, a slightly<br \/>\n\tmodified scheme was prepared under resolution dated 18.5.2007<br \/>\n\tcovering those Cooperative Banks which were under liquidation. We do<br \/>\n\tnot find that by doing so, the State Government committed any<br \/>\n\tdiscrimination. Cooperative Banks which are under liquidation and<br \/>\n\tthose which are not do not form a homogeneous class and action of<br \/>\n\tthe State Government treating the two sets of Banks differently<br \/>\n\twould not offend Article 14 of the Constitution.\n<\/p>\n<p>We<br \/>\n\tfurther find that while adopting resolution dated 18.5.2007 for<br \/>\n\tformulation of OTS Scheme applicable to the Cooperative Banks under<br \/>\n\tliquidation, Government has carefully considered all the aspects. It<br \/>\n\tis recorded inter-alia that it is necessary that faith of the public<br \/>\n\tshould be reestablished in the cooperative activities and a suitable<br \/>\n\tatmosphere be created. It is noted that work of recovery of dues of<br \/>\n\tBanks under liquidation is very slow and  negligible.\n<\/p>\n<p>Additionally,<br \/>\n\tin the affidavit in reply filed by the State, it is stated<br \/>\n\tinter-alia that there are 65  Cooperative Banks under liquidation.<br \/>\n\tDeposit, Insurance and Credit Guarantee Corporation (&#8216;DICGC&#8217; for<br \/>\n\tshort) is the major stake holder as it stood as guarantor with<br \/>\n\trespect to small deposit holders upto Rupees One Lakh in almost all<br \/>\n\tthe banks and therefore without hearing DICGC, no orders can be<br \/>\n\tpassed.\n<\/p>\n<p>It<br \/>\n\tcan thus be seen that formulation of one time scheme vide resolution<br \/>\n\tdated 18.5.2007 for covering Cooperative Banks under liquidation was<br \/>\n\ta decision of the Government after careful consideration of all<br \/>\n\trelevant aspects. It would not be appropriate on part of this Court<br \/>\n\tto interfere with such exercise of discretion in policy matters<br \/>\n\twhich is not shown to be irrational, arbitrary or based on<br \/>\n\textraneous considerations.\n<\/p>\n<p>Additionally,<br \/>\n\twe also find that the initial scheme framed by resolution dated<br \/>\n\t8.10.2006 covering Cooperative banks which are not in liquidation<br \/>\n\thas come to an end by afflux of time. It is therefore, not possible<br \/>\n\tto give any directions to the State Government to bring the cases of<br \/>\n\tCooperative Banks under liquidation on par with the said scheme. It<br \/>\n\twould amount to direction of implementation of the scheme which is<br \/>\n\tno longer in existence. From the affidavit filed by the Government<br \/>\n\tit can be seen that even the Scheme covering Cooperative Banks under<br \/>\n\tliquidations as amended by Resolution dated 10.10.2007, provided for<br \/>\n\tlast date for making application upto 18.11.2007 and the last date<br \/>\n\tfor disposal of such applications of 18.2.2008. Thus even this<br \/>\n\tscheme at present is not in existence.\n<\/p>\n<p>Significantly,<br \/>\n\twe also find that though the petition is titled as public interest<br \/>\n\tlitigation, the petitioner has not disclosed any public interest in<br \/>\n\tthe petition. The petitioner claims to be a depositor in a<br \/>\n\tCooperative bank which is under liquidation. The nature and amount<br \/>\n\tof deposit is also not disclosed.\n<\/p>\n<p>For<br \/>\n\tall these reasons, the petition cannot be accepted. Same is<br \/>\n\tdismissed.
