The said original High Court file of this case The Applicant may visit the office<br \/>\n       regarding widening of Chand Nagar Court be during any working hours with prior<br \/>\n       given to me for inspection and any additional intimation.<br \/>\n       documents, after inspection if any, as<br \/>\n       demanded by me be provided to me duly<br \/>\n       attested.\n<\/p>\n<p> The First Appellate Authority Ordered:\n<\/p>\n<p>Not Mentioned.\n<\/p>\n<p>Relevant Facts emerging during Hearing:\n<\/p>\n<p>The following were present<\/p>\n<p>Appellant: Mr. Darshan Lal<\/p>\n<p>Respondent: Mr. Gautam Chand representing PIO<br \/>\nThe respondent has not supplied the relevant information on point 1. He is directed to<br \/>\nsupply the information of how much land has been taken from each house.<br \/>\nOn point 2 the appellant contends that the affidavit supplied is a rejoinder and he wants<br \/>\na copy of the original affidavit. The respondent is directed to provide the copy of the<br \/>\noriginal affidavit. If there is no other affidavit, the respondent will state this.<br \/>\nThe appellant contends the inspection of files has not been given. The PIO is directed to<br \/>\ngive an inspection of the files to the appellant on 15 January 2009 at 11.00am<\/p>\n<p>Decision:\n<\/p>\n<p>The appeal is allowed.\n<\/p>\n<p>The PIO will give the information on point 1 and 2 to the appellant before<br \/>\n30 January 2009.\n<\/p>\n<p>The issue before the Commission is of not supplying the complete, required information by the<br \/>\nPIO within 30 days as required by the law.\n<\/p>\n<p>From the facts before the Commission it is apparent that the PIO is guilty of not furnishing<br \/>\ninformation within the time specified under sub-section (1) of Section 7 by not replying within 30<br \/>\ndays, as per the requirement of the RTI Act. It appears that the PIO&#8217;s actions attract the penal<br \/>\nprovisions of Section 20 (1) .\n<\/p>\n<p>A showcause notice is being issued to him, and he is directed give his reasons to the Commission to<br \/>\nshow cause why penalty should not be levied on him.\n<\/p>\n<p>He will give his written submissions showing cause why penalty should not be imposed on him as<br \/>\nmandated under Section 20 (1) before 10 February, 2009.
