JOSHI for Respondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 31\/03\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThe<br \/>\npetitioner herein has challenged the order dated 14.05.2010 passed by<br \/>\nthe Civil Court (Senior Division), Vadodara in Regular Civil Suit No.<br \/>\n81 of 2005 below Ex. 49 whereby the application was rejected.\n<\/p>\n<p>2.\tIt<br \/>\nis the case of the petitioner that he moved a Regular Civil Suit No.<br \/>\n1840 of 1997 against the respondent who is his brother seeking<br \/>\npermanent injunction before the Civil Court, Vadodara.  The said suit<br \/>\ncame to be dismissed vide order dated 18.11.2006.  The petitioner<br \/>\nchallenged the said order vide Regular Civil Appeal No. 115 of 2006<br \/>\nalong with Ex. 21 for amending the plaint and for withdrawal of<br \/>\ncertain averments in the plaint.  The said application came to be<br \/>\nrejected by the appellate court.  The petitioner thereafter pending<br \/>\nthe suit of 1997 moved another suit being Regular Civil Suit No. 81<br \/>\nof 2005 seeking possession and mesne profits along with an<br \/>\napplication Ex. 5.  The petitioner also filed his written statement<br \/>\nbelow Ex. 9.  The court thereafter framed issued vide Ex. 23 and the<br \/>\nrespondent tendered his affidavit for examination in chief vide Ex.\n<\/p>\n<p>26.  The petitioner also moved an application for amending the<br \/>\nwritten statement filed at Ex. 9 The Court below rejected the said<br \/>\napplication.  Being aggrieved by the said order, the present petition<br \/>\nis preferred.\n<\/p>\n<p>3.\tMr.\n<\/p>\n<p>Dave, learned advocate appearing for the petitioner has submitted<br \/>\nthat the Court below has erred in observing that the amendment sought<br \/>\nby the petitioner will change the nature of the suit preferred by the<br \/>\nrespondent-original plaintiff.  He submitted that the nature of the<br \/>\nsuit shall change only if the original plaintiff amends the suit and<br \/>\nnot by amending the written statement.\n<\/p>\n<p>4.\tThis<br \/>\ncourt has heard learned advocates for both the sides and perused the<br \/>\npapers on record.  The court below has gone through the various<br \/>\ndecisions of different courts and come to the conclusion that the<br \/>\napplication is required to be rejected. The court below has rightly<br \/>\nobserved that any amendment at that particular stage shall effect the<br \/>\nnature of the suit.  This court is in complete agreement with the<br \/>\nreasonings adopted and findings arrived at by the court below.<br \/>\nHowever, it shall be open to the petitioner to clarify the same when<br \/>\nhe turns up for evidence.
