Hence Rule confined to question of sentence<\/p>\n<p>                 only.\n<\/p>\n<p>                            Learned APP waives notice on behalf of the<\/p>\n<p>                 State.\n<\/p>\n<p>                              With the consent of parties, the application is<\/p>\n<p>                 being finally disposed of at this stage itself.<\/p>\n<p>                              Petitioner, along with others, was tried vide Tr.<\/p>\n<p>                 No. 303 of 1997 for the charges punishable under Sections<\/p>\n<p>                 25(A) and 26\/35 of the Arms Act and by judgment and order<\/p>\n<p>                 dated 6.3.1997 held guilty thereunder and sentenced to<\/p>\n<p>                 undergo R.I. for 03 years with fine having default clause<\/p>\n<p>                 and R.I. for 03 years under Sections 25(A) and 26\/35 of the<\/p>\n<p>                 Arms Act respectively with further direction that both the<\/p>\n<p>                 sentences shall run concurrently. Aggrieved thereby, the<\/p>\n<p>                 petitioner preferred appeal vide Cr. Appeal No. 19\/1997.<\/p>\n<p>                 Learned Appellate Court by judgment dated 19th May, 2008<\/p>\n<p>                 partly allowed the appeal in part. Conviction recorded under<\/p>\n<p>                 Section 25(A) was found not sustainable and set aside. He<\/p>\n<p>                 was, however, found rightly held guilty under Section 26\/35<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>of the Arms Act. Sentence imposed thereunder was reduced<\/p>\n<p>to R.I. for 02 years with fine having default clause leading to<\/p>\n<p>filing of the case.\n<\/p>\n<p>              Learned counsel for the petitioner submits that<\/p>\n<p>as per the prosecution case, on a tip off, house of one of the<\/p>\n<p>co-accuseds was searched wherefrom one gun and few<\/p>\n<p>cartridges were recovered. Petitioner was seen escaping<\/p>\n<p>therefrom and a chase was offered and he was captivated.<\/p>\n<p>He was, on search, found possessed with 02 live cartridges.<\/p>\n<p>It is contended that the occurrence as per the prosecution<\/p>\n<p>had taken place on 4.10.1986. Petitioner had to face the<\/p>\n<p>ordeal of trial for close to 11 years when the Trial Court by<\/p>\n<p>judgment and order dated 6.3.1997 held him guilty. The<\/p>\n<p>appeal thereafter remained pending for another 10 years. It<\/p>\n<p>is submitted that the petitioner was thus made to undergo<\/p>\n<p>several exasperating and excruciating circumstances which<\/p>\n<p>definitely had adverse impact on his mental, physical and<\/p>\n<p>economical condition. It is submitted that the petitioner thus<\/p>\n<p>deserves a lesser quantum of sentence for the proven<\/p>\n<p>charge particularly when there is no previous conviction<\/p>\n<p>found and recorded against him. It is also contended that at<\/p>\n<p>the time of recording conviction, petitioner was assessed 30<\/p>\n<p>years of age and by now he is a middle aged person.<\/p>\n<p>Learned counsel states that the petitioner has already<\/p>\n<p>remained in custody for about 16 months.<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>                   Learned A.P.P., on the other hand, submits that<\/p>\n<p>      in view of concurrent findings of guilt recorded by the two<\/p>\n<p>      Courts below, the matter does not require consideration on<\/p>\n<p>      merit.\n<\/p>\n<p>                   Having heard the parties, this Court finds merit<\/p>\n<p>      in the submission of the petitioner that long drawn criminal<\/p>\n<p>      proceeding taken against the petitioner had adversely<\/p>\n<p>      affected his mental, economical and physical conditions.<\/p>\n<p>      Fighting criminal litigation for a long time and thereby to<\/p>\n<p>      undergo rigours thereof is relevant consideration in the<\/p>\n<p>      matter of inflicting sentence for the proven charge(s). This<\/p>\n<p>      Court is thus satisfied that a lesser quantum of sentence, in<\/p>\n<p>      the facts and circumstances of the case, would subserve the<\/p>\n<p>      cause of justice.\n<\/p>\n<p>                   Accordingly, while upholding his conviction<\/p>\n<p>      recorded by the two Courts below under Section 26\/35 of<\/p>\n<p>      the Arms Act, the sentence awarded thereunder is reduced<\/p>\n<p>      to R.I. for 1 \u00bd years. The fine imposed by the learned<\/p>\n<p>      Appellate Court is also reduced to Rs. 500\/- in default<\/p>\n<p>      whereof, the petitioner shall undergo additional period of<\/p>\n<p>      R.I. for 15 days.\n<\/p>\n<p>                   With   this    modification   in   sentence,   the<\/p>\n<p>      application is dismissed.\n<\/p>\n<\/p>\n<p>                              ( Kishore K.
