SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 16\/12\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tAs<br \/>\nsuch by way of this petition under Article 227 of the Constitution<br \/>\nread with Section 482 of the Code of Criminal Procedure, the<br \/>\npetitioner-original complainant has prayed for an appropriate writ,<br \/>\norder or direction quashing and setting aside the order passed by the<br \/>\nlearned trial Court below Exhs. 81 &amp;  86 dated 15\/10\/2010 and<br \/>\n19\/10\/2010 respectively in Sessions Case No. 151\/2008.  It appears<br \/>\nthat after the impugned orders were passed one witness was examined<br \/>\nby the defense and thereafter they have submitted the closing purshis<br \/>\nto close their evidence vide application dated 23\/11\/2010.  However,<br \/>\nit appears that, before that, the defense had produced two documents<br \/>\nalongwith the list of documents   submitting an application dated<br \/>\n16\/11\/2010, which was permitted to be taken on record by the learned<br \/>\ntrial Court and they are given exhibit numbers also, and, therefore,<br \/>\nit is the case on behalf of the petitioner that as such the<br \/>\npetitioner should be given an opportunity to lead the evidence in<br \/>\nthose documents and\/or to controvert the same, if required.\n<\/p>\n<p>2.\tUnder<br \/>\nthe circumstances, the present petition is disposed of reserving the<br \/>\nliberty in favour of the petitioner to submit an appropriate<br \/>\napplication before the concerned Court to reopen their right to lead<br \/>\nthe evidence only qua the documents, which are produced alongwith the<br \/>\nlist while submitting the application dated 16\/11\/2010 and the<br \/>\nlearned trial Court is directed to consider the same giving an<br \/>\nopportunity to the petitioner-original complainant to meet with those<br \/>\ndocuments and permit the petitioner-original complainant to lead the<br \/>\nevidence on the aforesaid documents.
