Ravinder Kumar\n\nName of the Public Authority:           Union Public Service Commission\n         i\nFacts<\/pre>\n<p>:\n<\/p>\n<p>1.    In our Decision No.318\/IC(A)\/2006 dated 3rd October 2006, the following<br \/>\nDecision notice was issued:\n<\/p>\n<p>   \u0083     &#8220;The information sought relate to note sheets of the files dealing with<br \/>\n         disciplinary proceedings and imposition of penalty. Under the law, there<br \/>\n         are established procedures that are followed to ensure justice to the<br \/>\n         alleged offenders. The relevant details form the basis for formulating<br \/>\n         advice given by the UPSC to the concerned administrative Ministry, a<br \/>\n         copy of which is also supplied to the affected officer. The revealing of the<br \/>\n         note sheets containing the remarks and opinion of various officials on the<br \/>\n         matter of imposition of penalty, would identify their names, which might<br \/>\n         endanger their lives. The disclosure of such information is therefore<br \/>\n         barred u\/s 8(1)(e) &amp; (h) of the Act. In view of this, the decision of the<br \/>\n         appellate authority is upheld.\n<\/p>\n<p>   \u0083     As such, there is no denial of information to the appellant as the CPIO and<br \/>\n         the appellate authority have given a detailed response to the appellant.<br \/>\n         Moreover, there is no overriding public interest in disclosure of information<br \/>\n         relating to the prosecution of alleged offenders under the Civil Services<br \/>\n         conduct Rules.&#8221;\n<\/p>\n<p>2.    Being not satisfied with the above decision, the appellant submitted a<br \/>\nreview petition before the Commission, which was examined and rejected. The<\/p>\n<p>                   i<br \/>\n                       &#8220;If you don&#8217;t ask, you don&#8217;t get.&#8221; &#8211; Mahatma Gandhi<\/p>\n<p><span class=\"hidden_text\">                                               1<\/span><br \/>\n appellant was accordingly communicated vide the Commission&#8217;s letter dated<br \/>\nApril 19, 2007.\n<\/p>\n<p>3.     Subsequently, the appellant challenged the Commission&#8217;s decision before<br \/>\nthe High Court of Delhi, which has passed the following order:\n<\/p>\n<p>   \u00be &#8220;The prayer made by the petitioner for copies of the note sheets was<br \/>\n     rejected by the UPSC. The appeal filed before the appellate authority was<br \/>\n     also dismissed on 19.09.2006. The petitioner has thereafter, stated to<br \/>\n     have filed an appeal before the CIC which was also dismissed on<br \/>\n     03.10.2006. The petitioner who appears in person submits that the CIC<br \/>\n     has now given a decision in January, 2007, Shri. Pyare Lal Verma Vs.<br \/>\n     Ministry of Railways by virtue of which the CIC has held that the note<br \/>\n     sheets form part of the file and public authorities should give copies of the<br \/>\n     same. The petitioner in person prays that this matter may be remanded<br \/>\n     back to CIC to enable the CIC to hear the parties afresh in the light of the<br \/>\n     aforestated Full Bench judgment. Counsel for the respondents have no<br \/>\n     objection. Consequently, taking into consideration the stand of the<br \/>\n     parties, the present petition is disposed of with a direction to the CIC to<br \/>\n     issue notice to the parties and thereafter pass an order in the matter.<br \/>\n     Needles to say that in case the petitioner is aggrieved by the order passed<br \/>\n     by the CIC, it would be open to the petitioner to take recourse to such<br \/>\n     remedy as may be available to him in accordance with the law.\n<\/p>\n<p>   \u00be With these directions the present writ petition stands disposed of.\n<\/p>\n<p>                                                       (WP( C )No.4374\/2007)<\/p>\n<p>4.     In compliance with the Court&#8217;s order, notices were issued to both the<br \/>\nparties for the hearing held on 9\/7\/2009. The following were present:\n<\/p>\n<pre>      Appellant:           Sh. Ravinder Kumar\n\n      Respondents:         Sh. Y.P. Gupta, CPIO &amp; Dy. Secretary\n                           Sh. Kamal Bhagat, Jt. Secretary\n                           Sh. R.K. Sinha, J.S.\n                           Ms. Aditi Gupta, Advocate\n\n\n<\/pre>\n<p>5.      The appellant reiterated his earlier plea for providing access to the note<br \/>\nsheets containing the details of remarks and observations made by various<br \/>\nofficials of the respondent, in the matter of disciplinary action taken against the<br \/>\nappellant. In particular, he stated that the Commission has allowed disclosure of<br \/>\nthe file notings in different cases. Therefore, he should also be provided the<br \/>\ncopies of note sheets as asked for by him.\n<\/p>\n<p><span class=\"hidden_text\">                                        2<\/span><\/p>\n<p> 6.     The CPIO reiterated its earlier stand and maintained that the note sheets<br \/>\nasked for pertain to the information of different departments and offices in the<br \/>\nmatter of disciplinary action against the appellant, the disclosure of which is not<br \/>\nin public interest. Hence, the requested information mainly, the note sheets<br \/>\ncontaining the opinion and advices rendered by various officials cannot be<br \/>\ndisclosed, as per Section 8(1)(j) of the Act.\n<\/p>\n<p>Decision:\n<\/p>\n<p>7.      The information asked for relate to the file notings containing the views<br \/>\nand opinions of various officials, who have contributed to the process of the<br \/>\nconduct of disciplinary proceedings initiated against the charged officer. While<br \/>\nsuch an action is taken by a public authority against its employee is largely in the<br \/>\npublic interest, the request for disclosure of the details by the charged official is<br \/>\nmainly for promotion of personal interest. It is accepted that the note sheets of a<br \/>\nfile are covered under the definition of &#8220;information&#8221; and, therefore, a CPIO is free<br \/>\nto invoke section 8(1) of the Act for denial of information for which valid<br \/>\njustification has to be provided.\n<\/p>\n<p>8.     In the context of the disciplinary proceeding, which is initiated in the public<br \/>\ninterest as per the Civil Services (Conduct) Rules, the CPIO has justly invoked<br \/>\nSection 8(1)(j) of the Act for denial of access to the file notings containing opinion<br \/>\nand advices rendered by the officials of the respondent.\n<\/p>\n<p>9.
