Singh, A.P.P.\n<\/p>\n<\/p>\n<p>02.     16.08.2010                   Heard learned counsel for the six petitioners and<\/p>\n<p>                         Additional public prosecutor for the State.<\/p>\n<p>                                     Petitioners are named accused in this case carry allegation<\/p>\n<p>                         of assaulting the prosecution side, no doubt there is specific allegation<\/p>\n<p>                         against the petitioner nos. 4 to 6 inflicting injury upon informant and<\/p>\n<p>                         his brother, but as it appears the case was instituted for the offences<\/p>\n<p>                         which are bailable and they failed the privilege of bail granted by the<\/p>\n<p>                         police. No doubt, after submission of charge-sheet, taking a different<\/p>\n<p>                         view, court below took cognizance for the offence under Section 307<\/p>\n<p>                         I.P.C. also, but the position is not going to change, so far privilege of<\/p>\n<p>                         bail is concerned, once the petitioners are granted the privilege, they<\/p>\n<p>                         are to avail the same till they violate any terms and conditions or<\/p>\n<p>                         misuse the privilege.\n<\/p>\n<p>                                     Considering the facts and circumstances of the case,<\/p>\n<p>                         subject to verification by the court below on the point of misuse of<\/p>\n<p>                         privilege, in the event of their arrest\/surrender before the court below<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>          within four weeks of receipt of the copy of this order, petitioners,<\/p>\n<p>          namely, 1. Lakhi Singh @ Umesh Singh, 2. Shiv Kumar Singh, 3.<\/p>\n<p>          Siyaram Sharma, 4. Ashok Kumar, 5. Vikas Kumar &amp; 6. Dhiraj<\/p>\n<p>          Kumar , are directed to be released on bail on furnishing bail bond of<\/p>\n<p>          Rs. 10,000\/- (ten thousand only) each with two sureties of the like<\/p>\n<p>          amount each to the satisfaction of Chief Judicial Magistrate, Patna in<\/p>\n<p>          connection Bihta P.S.
