       Petition for anticipatory bail.\n<\/p>\n
       2. The alleged offence is under section 376 IPC.<\/p>\n
According to prosecution, de facto complainant was working in<\/p>\n
Amrita Hospital. Petitioner went to the hospital and stated that<\/p>\n
her father is sick and she was taken to a lodge at Vazhakulam<\/p>\n
and rape was committed on her.\n<\/p>\n
       3. Learned      counsel   for  petitioner  submitted   that<\/p>\n
petitioner has not committed any offence. He is the friend of de<\/p>\n
facto complainant’s father. On that day he was going to<\/p>\n
Thodupuzha to meet his son in the boarding house. At that time<\/p>\n
de facto complainant’s father gave some sweets and other<\/p>\n
articles to be handed over to de facto complainant and he went<\/p>\n
there and gave the articles. But later, on the same day, de facto<\/p>\n
complainant was missing, when telephone call was made to her<\/p>\n
by her father. To give an excuse, she gave a false complaint<\/p>\n
against petitioner, it is submitted.\n<\/p>\n
       4. It is also submitted that name of petition is shown as<\/p>\n
“Sivan”, but petitioner’s name is “Sadasivan”. Learned counsel<\/p>\n
for petitioner also submitted that the incident allegedly occurred<\/p>\n
on 6-11-2008 in the night, but she gave a complaint only on 8-<\/p>\n

11-2008. He also submitted that age of the girl is shown as 19 in<\/p>\n
the First Information Statement.\n<\/p>\n
         5. Learned Public Prosecutor submitted that as per the<\/p>\n
allegations made, she was raped by petitioner on 6-11-2008 and<\/p>\n
she had given reason for the delay in lodging the complaint. To<\/p>\n
the doctor also she had made allegation that she was sexually<\/p>\n
assaulted. Learned Public Prosecutor submitted that as per the<\/p>\n
school register, the age of the girl is 16 = years.<\/p>\n
       6. On hearing both sides, considering the serious nature<\/p>\n
of the allegations made, I am not inclined to grant anticipatory<\/p>\n
bail to petitioner. However, if petitioner has good ground to get<\/p>\n
bail, on facts, under section437 Cr.P.C., this order will not stand<\/p>\n
in the way of granting the same. Petitioner is bound to surrender<\/p>\n
and co-operate with the investigation. Hence, the following order<\/p>\n
is passed:-\n<\/p>\n
       1)   Petitioner is directed to surrender before the<\/p>\n
             Investigating Officer without any delay and co-<\/p>\n
             operate with the investigation. Whether he<\/p>\n
             surrenders or not, police is at liberty to arrest<\/p>\n
             him and proceed in accordance with law.<\/p>\n<\/blockquote>\n
       2)     No further application for anticipatory bail by<\/p>\n

           petitioner in this crime will be entertained by<\/p>\n
           this Court, since on the facts in this case, this<\/p>\n
           Court ordered that this is not a fit case to grant<\/p>\n
           anticipatory bail and any order to the contrary in<\/p>\n
           any subsequent anticipatory bail application will<\/p>\n
           amount to review, which is impermissible in law.<\/p>\n
      The petition is dismissed.\n<\/p><\/blockquote>\n
