PATTANAIK\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>   THE 7TH DAY MAY, 1997<br \/>\nPresent:\n<\/p>\n<blockquote><p>      Hon`ble Mr. Justice K.Ramaswamy<br \/>\n      Hon`ble Mr. Justice S.Saghir Ahmad<br \/>\n      Hon`ble Mr. Justice G.B.Pattanaik<br \/>\nG.V.Chandrashekhar and P.P.Singh, Advs.for thePetitioner<br \/>\n O R D E R<br \/>\n     Delay condoned.<\/p><\/blockquote>\n<p>     Itis  anundisputed\t fact  thatthe\tKarnatakaLand<br \/>\nReforms(Amendment) Acthad come into force with effectfrom<br \/>\nMarch 1,  1974.The  petitionerlaid claimed asan occupancy<br \/>\ntenant,in  respect of13 acres  and 24 gunthas of theland<br \/>\nsituated in  K.R. Nagar Taluk,Karnataka\t District. When he<br \/>\nfiled application  in Form-  7 for recognition of his rights<br \/>\nas an  occupancy tenant,  the Tribunal rejectedhis claim on<br \/>\nthe ground  that his  sons werecultivating theland. It was<br \/>\nheld that  since the petitionerhad notbeen cultivating the<br \/>\nland, he  couldnot  file the  application  inForm-7and,<br \/>\ntherefore, he  was not entitledto be treated as a protected<br \/>\ntenant.That  order came to be affirmedby the High Court in<br \/>\nLRRP No.2179\/88 and in C.P. No.499\/96on June10, 1996 and<br \/>\nJanuary6, 1997. Thus, this special leave petition.\n<\/p>\n<p>     Inview  of the  fact that a tenant\t in cultivation is<br \/>\nentitled to  lay the  claim under Section 44 and 48-A of the<br \/>\nKarnataka LandReformsAct  (for short,  the `Act&#8217;), on his<br \/>\nown admittedlyshowingthat hehad notbeen cultivating the<br \/>\nland ,the  petitioner&#8217;s\t right\tas  occupancy tenant was<br \/>\nrightlyrejected.  His status is that of the co-owner, Karta<br \/>\nof the joint family andas suchon behalf of his sons he had<br \/>\nfiled it and the sons were cultivating the landon behalf of<br \/>\nthe family;  since this land was  obtained ata\tpartition<br \/>\nbetweenthe  petitionerand hisbrotherway back in 1957, it<br \/>\nis joint  family property.  In view of the fact that he is<br \/>\nnot personallycultivating theland onhis ownshowing, the<br \/>\nfindingrecorded\t by the\t Tribunal and the HighCourt is not<br \/>\nvitiated by  any manifest  error of  law.  However,  due  to<br \/>\nmistaken standthe application in Form-7 cameto be filed.<br \/>\nHe washeld disentitled to theclaim as a protected tenant.<br \/>\nIf thesons were really occupying the land as tenants prior<br \/>\nto theAmendment Act  had comeinto force on March 1, 1974,<br \/>\nit maybe opento the sons to make an application in Form-7<br \/>\nand have  the matter  adjudicated. Thelimitation that has<br \/>\nbeen prescribed in the statute, in the peculiar facts, may<br \/>\nnot be taken asa ground for rejection of theirclaims.\n<\/p>\n<p>     The special  leavepetition\t are accordingly  dismissed<br \/>\nwith the above observations.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Y.R.
