The learned Judge of the \nhas rejected the claim mainly for  \nthat the claimant was not able'   \nthat there was an acoidentyleer  \nsuffered by the V'  \u00a30\nthe accident mvolvi\ufb01e the   \n\n4. 3'    die\u00bb fcedrrtended that\nthe V.   ignoring the%\n   tribunal on behalf\nof   clearly demonstrates\n\n \"there \"wcee____not only an incident of the\n\n' ;\"11e't*L1_re  but also that the claimant had\n\n and totally ignoring that\n\nevide\ufb02ce on record and recording a \ufb01nding to\n\n =  contrary is nothing but a perverse finding.\n\n5. Appeal had been adnrdtted and\n\nrespondent ~--KSRTC had been put on notice.<\/pre>\n

8. The factum of the claimant having<\/p>\n
travelled in the KSRTC bus when the incident<\/p>\n
tack place has been made good by examining a<\/p>\n

relating to the journey in the bus and What
\ntranspired during the journey, can be said to<\/p>\n
be hearsay, the son, who had taken his mother<\/p>\n

 doctor had clearly indicated that the injuries<\/p>\n
were suffered when the claimant was travelling
\nin a KSRTC. bus due to her fail from the seat<\/p>\n
and due to the bump rides she had. The<\/p>\n

independent witness could not  <\/p>\n
disregarded by the tribunal.   <\/p>\n

life time ‘when she was travelling in the KSRTC<\/p>\n
bus and the claim being essentially in the<\/p>\n

such a claim petition, the children   <\/p>\n
have put forth a claim for cougpensati-0-uh to  ”  <\/p>\n
the death of the mother.\n<\/p>\n

 her in a reasonable level of comfort and such<\/p>\n
other things. With the injured person was<\/p>\n
herself: a breadwinner and having been<\/p>\n

incapacitated, the family would have lost on <\/p>\n
that account also.\n<\/p>\n
:5. Though Sri Ravi <\/p>\n
learned counsel for the V.’Corporefion
\nurge that in the absence
\nand evidence to   emount of
\nexpenditure   and
\ntherefore,  awarded,<\/p>\n
we are eftHVe.t.’_we _-cennet ignore the<\/p>\n
factum ofethe’  who had been<\/p>\n
 initially eehosu;)i’t:-\ufb01ieedvi for one month and who<\/p>\n
 due to the injuries and<\/p>\n
having  for 11;: years and succumbed<\/p>\n
fjto t}1″e..i\u00a713fu:*ies ultimately, must have incurred<\/p>\n
“:i\u00a2o:eeiderab}e expenditure apart from losing<\/p>\n
  income during this period. This de\ufb01nitely<\/p>\n

by the family and therefore, the preseng\/\/__<\/p>\n
