Considering the facts and circumstances of the case and<br \/>\nkeeping in mind the interest of the original claimants, the Tribunal<br \/>\nconcerned is directed to invest the amount deposited by the<br \/>\nappellant-Insurance Company in F.D.R. with a nationalized bank,<br \/>\ninitially, for a period of one year and the same shall be renewed<br \/>\nfrom time to time, until the final disposal of the claim petition<br \/>\npending before the Tribunal concerned. The quarterly interest<br \/>\naccruing on such deposit shall be paid to the original claimants on<br \/>\nregular basis by way of Account Payee cheque after proper<br \/>\nverification.\n<\/p>\n<p>4.\tIt<br \/>\nis made clear that if, ultimately, the claim petition is allowed in<br \/>\nfavour of the original claimants and the appellant-Insurance Company<br \/>\nis held liable, then payment to the original claimants shall be made<br \/>\nout of the aforesaid amount at the relevant time; lest it shall be<br \/>\nreturned to the appellant-Insurance Company. Further, if the claim<br \/>\npetition is withdrawn, then also the amount shall be returned to the<br \/>\nappellant-Insurance Company. The Tribunal concerned is directed to<br \/>\ndispose of the claim petition within a period of three years from<br \/>\ntoday.\n<\/p>\n<p>5.\tIt<br \/>\nis made clear that this Court has not entered into the merits of the<br \/>\ncase and therefore, the Tribunal concerned shall decide the claim<br \/>\npetition on merits and being uninfluenced by this order.\n<\/p>\n<p>6.\tWith<br \/>\nthe above observation and direction, the appeal stands disposed of.<br \/>\nNo costs.\n<\/p>\n<p>[K.\n<\/p>\n<p>S. JHAVERI, J.]\t<\/p>\n<p> ORDER<br \/>\nIN CIVIL APPLICATION<\/p>\n<p>\tIn<br \/>\nview of the order passed in the main matter, the civil application<br \/>\nshall not survive.
