Sinha, J.\n<\/p>\n<\/p>\n<p>1.    Leave granted.\n<\/p>\n<\/p>\n<p>2.    The sole respondent was an employee of the State of Haryana. He has<\/p>\n<p>since retired. He was serving in the `Health Department&#8217; of the State having<\/p>\n<p>joined services on 26.11.1961. He retired on 7.9.1988 on health grounds.<\/p>\n<p>3.    He suffered an heart attack on 15.8.2002. He was treated in the Post<\/p>\n<p>Graduate Institute of Medical Sciences and Research, Chandigarh.           He<br \/>\n<span class=\"hidden_text\">                                        2<\/span><\/p>\n<p>underwent a bye-pass surgery at Fortis Heart Institute and Multi-Speciality<\/p>\n<p>Hospital, Mohali. It is on the recognized panel of the hospitals of the State<\/p>\n<p>of Haryana.     He submitted a bill for a sum of Rs.1,87,907.65 towards<\/p>\n<p>medical expenses borne by him for its reimbursement.<\/p>\n<p>      Relying on or on the basis of a circular issued by the State of Haryana<\/p>\n<p>dated 30.11.1993, the Department sanctioned payment for a sum of<\/p>\n<p>Rs.1,62,298\/- only.\n<\/p>\n<\/p>\n<p>4.    Aggrieved by the said order, the respondent filed a writ petition before<\/p>\n<p>the High Court of Punjab and Haryana. The said writ petition was allowed,<\/p>\n<p>holding:\n<\/p>\n<\/p>\n<blockquote><p>              &#8220;We have heard learned Counsel for the parties.\n<\/p><\/blockquote>\n<blockquote><p>              Shri W.R. Dua, learned counsel for the petitioner<br \/>\n              drew our attention to the Punjab Services (Medical<br \/>\n              Attendance) Rules 1940, as applicable to the<br \/>\n              Haryana employees\/pensioners and the instructions<br \/>\n              issued by the Haryana Government vide circular<br \/>\n              letter No. HD.HR. No.2\/82\/98-IHB-III dated<br \/>\n              31.10.2002 to show that Fortis Hospital, Mohali<br \/>\n              has been recognized by the Haryana Government<br \/>\n              for the treatment of Haryana Government<br \/>\n              employees\/Pensioners\/Family Pensioners. He then<br \/>\n              referred to the instructions issued vide letter dated<br \/>\n              11.8.1992 (Annexure P.5\/A) to show that heart<br \/>\n              disease has been treated as one of the chronic<br \/>\n              ailments and argued that the petitioner is entitled to<br \/>\n              full medical reimbursement in terms of the<br \/>\n<span class=\"hidden_text\">                                      3<\/span><\/p>\n<p>             instructions issued by the Government vide letter<br \/>\n             dated 25.8.2003.\n<\/p><\/blockquote>\n<blockquote><p>             Learned Assistant Advocate General could not put<br \/>\n             forward any tangible argument to controvert the<br \/>\n             submissions of Shri W.R. Dua.\n<\/p><\/blockquote>\n<blockquote><p>             Having considered the entire matter, we are<br \/>\n             convinced that the Petitioner is entitled to<br \/>\n             reimbursement of the entire expenses incurred by<br \/>\n             him in his treatment at Fortis Hospital, Mohali and<br \/>\n             the decision of the Respondents to pay only 75%<br \/>\n             thereof is legally unsustainable.&#8221;\n<\/p><\/blockquote>\n<p>5.    Mr. Manjit Singh, learned counsel appearing on behalf of the State,<\/p>\n<p>contended that the High Court committed a serious error in so far as it failed<\/p>\n<p>to give effect to the circulars issued by the State laying down the norms for<\/p>\n<p>reimbursement of the medical bill.\n<\/p>\n<\/p>\n<p>6.    Mrs. Nanita Sharma, learned counsel appearing on behalf of the<\/p>\n<p>respondent, on the other hand, urged that the heart disease having been<\/p>\n<p>considered to be one of the chronic diseases, the circular letter dated<\/p>\n<p>28.5.2003 would prevail.\n<\/p>\n<\/p>\n<p>7.    The Commissioner and Secretary of the state of Haryana, Health<\/p>\n<p>Department, by a circular dated 30.11.1993 directed as under :<\/p>\n<blockquote><p>             &#8220;I have been directed to invite your attention to the<br \/>\n             Haryana Government letter No.2\/296\/86-H.R.II-III<br \/>\n             dated 19.11.1985 (sic 1986) and to say that the<br \/>\n<span class=\"hidden_text\">                                      4<\/span><\/p>\n<p>            decision for granting recognition to Nivedic<br \/>\n            Prosyek Centre Daulat Singh Zirakpur (Punjab)<br \/>\n            Batra Hospital New Delhi for taking special<br \/>\n            treatment      to     serving    Haryana      Govt.\n<\/p><\/blockquote>\n<blockquote><p>            officers\/officials\/pensioners\/family pensioners and<br \/>\n            members of their family and dependants subject to<br \/>\n            the condition that the conditions that the<br \/>\n            officers\/officials\/pensioners who would undergo<br \/>\n            for treatment in those approved institutions will get<br \/>\n            reimbursement at the rates of All India Institute of<br \/>\n            Medical Sciences (AIIMS) New Delhi\/PGI. The<br \/>\n            75% of the excess expenditure in comparative to<br \/>\n            AIIMS will also be re-imbursed and the rest of<br \/>\n            25% will be borne by the claimant himself. If a<br \/>\n            Patient avails extra comfort as single room instead<br \/>\n            of double occupy room facilities, as such the<br \/>\n            whole expenditure will be borne by the claimant<br \/>\n            himself.\n<\/p><\/blockquote>\n<blockquote><p>            2.    This has the concurrence of the finance<br \/>\n            department vide their memo No.56\/80A\/86-6 Fin.<br \/>\n            Deptt. TT\/229-1532-2297 dated 13.10.93.\n<\/p><\/blockquote>\n<blockquote><p>            3.    This order will come into force from the<br \/>\n            date of issue.&#8221;\n<\/p><\/blockquote>\n<p>8.    However, it appears that on or about 28.5.2003, the same authority,<\/p>\n<p>referring to an earlier memo dated 11.8.1992, directed as under :<\/p>\n<blockquote><p>            &#8220;I have been directed to draw your attention on the<br \/>\n            above subject to the memo No.2\/160\/89-1 H.B. III<br \/>\n            dated 11.8.1992 whereby reimbursement on the<br \/>\n            out door treatment of chronic diseases upto<br \/>\n            maximum of Rs.6,000\/- to the Haryana Govt.<br \/>\n            employees\/officers\/pensioners\/family members of<br \/>\n            pensioners used to be allowed. The matter<br \/>\n            regarding removing the maximum limit for<br \/>\n            reimbursement of expenses incurred on the<br \/>\n<span class=\"hidden_text\">                                       5<\/span><\/p>\n<p>              treatment of chronic diseases has been under<br \/>\n              consideration of the Government keeping in view<br \/>\n              the interest of employees and pronouncements<br \/>\n              delivered by the Courts in this respect. Now the<br \/>\n              Government has decided that in view of<br \/>\n              instructions dated 11.8.1992 reimbursement of all<br \/>\n              the expenses incurred on the treatment of chronic<br \/>\n              diseases outdoor as well indoor shall be allowed.\n<\/p><\/blockquote>\n<blockquote><p>              All the other conditions issued on 11.8.92 shall<br \/>\n              remain in force.\n<\/p><\/blockquote>\n<blockquote><p>              These instructions will take effect from the issue of<br \/>\n              this letter.\n<\/p><\/blockquote>\n<blockquote><p>              The concurrence of the Finance Department has<br \/>\n              been obtained vide their endst. No.70\/20\/2000-6<br \/>\n              H.A. III\/1450 dated 28.5.2003.&#8221;\n<\/p><\/blockquote>\n<p>9.     The High Court, as noticed hereinbefore, was of the opinion that heart<\/p>\n<p>disease having been treated to be one of the chronic ailments in terms of the<\/p>\n<p>circular letter dated 11.8.1992, the respondent was entitled to reimbursement<\/p>\n<p>of the medical bill in its entirety.\n<\/p>\n<\/p>\n<p>       We see no reason to differ with the views of the High Court.<\/p>\n<p>Although the circular dated 28.5.2003 does not expressly supersede the<\/p>\n<p>circular letter dated 30.11.1993, but the latter having been issued subsequent<\/p>\n<p>to the former and in relation to a particular category of disease, namely, the<\/p>\n<p>chronic diseases, shall prevail over the earlier general circular letter. The<\/p>\n<p>said circular letter dated 28.5.2003 brings within its umbrage not only the<br \/>\n<span class=\"hidden_text\">                                        6<\/span><\/p>\n<p>expenses incurred for the treatment of chronic disease outdoor but also<\/p>\n<p>indoor.      In that view of the matter, the impugned judgment must be<\/p>\n<p>sustained.\n<\/p>\n<\/p>\n<p>10.    Mr. Singh had relied upon a decision of this Court in <a href=\"\/doc\/1563564\/\">State of Punjab<\/p>\n<p>&amp; Ors. v. Ram Lubhaya Bagga &amp; Ors.<\/a> [(1998) 4 SCC 117] to urge that<\/p>\n<p>obligation on the part of the State to foot the medical bill of its employee can<\/p>\n<p>be restricted by framing appropriate rules and\/or by issuance of requisite<\/p>\n<p>circular.     No exception to the dicta laid down therein can be taken.<\/p>\n<p>However, the said decision is itself an authority for the proposition that the<\/p>\n<p>State can change its policy decision from time to time. Once the State in its<\/p>\n<p>magnanimity adopted a decision that the medical bills in their entirety in<\/p>\n<p>connection with the heart diseases shall be reimbursed, the authorities of the<\/p>\n<p>State being bound thereby were obligated to comply therewith.<\/p>\n<p>11.    The question has also been considered by this Court in <a href=\"\/doc\/259597\/\">State of<\/p>\n<p>Karnataka &amp; Anr. v. R. Vivekananda Swamy<\/a> [(2008) 5 SCC 328] in the<\/p>\n<p>following terms :\n<\/p>\n<\/p>\n<blockquote><p>               &#8220;24. In view of the aforementioned settled<br \/>\n               principles of law there cannot be any doubt that the<br \/>\n               Rules regarding reimbursement of medical claim<br \/>\n               of an employee when he obtains treatment from a<br \/>\n               hospital of his choice can be made limited. Such<br \/>\n               Rules furthermore having been framed the proviso<br \/>\n<span class=\"hidden_text\">                                     7<\/span><\/p>\n<p>            to Article 309 of the Constitution of India<br \/>\n            constitute conditions of service in terms whereof<br \/>\n            on the one hand the employee would be granted<br \/>\n            the facility of medical aid free of cost from the<br \/>\n            recognized government hospital and on the other<br \/>\n            he, at his option, may get himself treated from<br \/>\n            other recognized hospitals\/institutions subject of<br \/>\n            course to the condition that the reimbursement by<br \/>\n            the State therefor would be limited.&#8221;\n<\/p><\/blockquote>\n<p>12.   For the reasons aforementioned, there is no merit in the appeal. It is<\/p>\n<p>dismissed accordingly with costs.
