Home &amp; 2 Ors.\nPetitioner Counsel :- Diwakar Singh,Sudhir Kumar Singh\nRespondent Counsel :- C.S.C.\n\nHon'ble Shabihul Hasnain,J.\n<\/pre>\n<p>By means of the instant writ petition, the petitioner has<br \/>\nassailed the order dated 20.9.2007 a contained in Annexure<br \/>\nNo. 1 to the writ petition, whereby the services of the<br \/>\npetitioner has been terminated.\n<\/p>\n<p>The petitioner was appointed as a Bandi Rakshak in the<br \/>\nyear 2005. While the petitioner was posted at Adarsh<br \/>\nKaragar, Lucknow, he was issued a show cause notice from<br \/>\nthe office of Senior Superintendent, Adarsh Karagar,<br \/>\nLucknow on 20.07.2007 to show cause with regard to the<br \/>\nHomeguards Certificate produced by him at the time of<br \/>\nseeking appointment. The petitioner submitted his reply<br \/>\nwithin the time granted. Then by the impugned order dated<br \/>\n20.9.2007, he has been terminated from service.<br \/>\nChallenging the said order, this writ petition has been filed.\n<\/p>\n<p>The submission of the learned Counsel for the petitioner,<br \/>\nbesides others, is that no formal inquiry was ever conducted<br \/>\nin the matter nor any enquiry report was submitted and prior<br \/>\nto the passing of the impugned order, no opportunity was<br \/>\ngiven to him and thus the procedure as laid down under the<br \/>\nU.P. Government Servants (Discipline and Appeal) Rules,<br \/>\n1999 with regard to imposition of major penalty has not been<br \/>\nfollowed.\n<\/p>\n<p>Rule 7 of the 1999 Rules lays down the procedure for<br \/>\nimposing major penalty. The same categorically provides<br \/>\nthat before imposing any major penalty on a government<br \/>\nservant an enquiry shall be held. The manner in which the<br \/>\nenquiry is to be held has been clearly given in the said rule.<br \/>\nIf the charges not admitted by the charged employee, the<br \/>\nenquiry officer is required to record oral and documentary<br \/>\nevidence and submit his report. On completion of enquiry, a<br \/>\nreport is to be submitted to the disciplinary authority along<br \/>\nwith all the records of the enquiry. Thereafter, if the<br \/>\ndisciplinary authority is of the view that any penalty is to be<br \/>\n imposed, a copy of the enquiry report is to be given the<br \/>\ncharged employee who may be required to submit his<br \/>\nrepresentation within a reasonable time. In the present case,<br \/>\nthe respondents in the counter affidavit have not stated that<br \/>\nany enquiry report was submitted and thus the question of<br \/>\ngiving opportunity to the petitioner to file his representation<br \/>\nagainst the enquiry report does not arise. Thus, it is clear the<br \/>\nprocedure as laid down under the Rules of 1999 has not<br \/>\nbeen complied with by the respondents prior to the passing<br \/>\nof the impugned order. The order thus deserves to be set-<br \/>\naside.\n<\/p>\n<p>Accordingly, this writ petition stands allowed. The order<br \/>\ndated 20.9.2007 is hereby quashed. The petitioner shall be<br \/>\nentitled to all consequential benefits. However, it is made<br \/>\nclear that the respondents shall be at liberty to pass fresh<br \/>\norder, in accordance with law, after complying with the<br \/>\nprocedure as laid down in the Rules of 1999.\n<\/p>\n<p>Order Date: 30.7.2010<\/p>\n<p>RKM.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Abhishek Kumar vs State Of U.P.
