No.2592 Of 2007\n                   = = = = = = = = = = = = = =\n\n                Dated this the 16th day of August, 2007\n\n                                ORDER\n<\/pre>\n<p>      Petitioners face indictment in a prosecution for the offences<\/p>\n<p>punishable, inter alia, under Sections 341, 323 and 324 read with 149<\/p>\n<p>I.P.C. Of course the allegations under Sec.143, 147 and 148 have also<\/p>\n<p>been raised. Investigation is complete. Final report has already been<\/p>\n<p>filed.  Committal court has taken cognizance and registered the<\/p>\n<p>committal proceedings. The petitioners were not available for arrest,<\/p>\n<p>hence the case against them was split up. Trial against the co-accused<\/p>\n<p>continued.   They were found not guilty and acquitted.       In fact the<\/p>\n<p>complainant did not raise any grievance against them, it is submitted.<\/p>\n<p>The case against the petitioners was split up and later transferred to<\/p>\n<p>the list of long pending cases.     The learned Magistrate has issued<\/p>\n<p>coercive processes against the petitioners. The petitioners apprehend<\/p>\n<p>imminent arrest. The learned counsel for the petitioners submits that<\/p>\n<p>the petitioners are absolutely innocent. The absence of the petitioners<\/p>\n<p>earlier was not wilflul. The petitioners are willing to surrender before<\/p>\n<p>the learned Magistrate and seek regular bail. It is further submitted<\/p>\n<p>that the complainant has compounded all the offences alleged against<\/p>\n<p>the petitioners also. The offences under Secs.143,147 and 148 are<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No. 2592 of 2007             2<\/span><\/p>\n<p>non compoundable.\n<\/p>\n<p>      2.    It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate and explain to the learned Magistrate the circumstances<\/p>\n<p>under which they could not earlier appear before the learned<\/p>\n<p>Magistrate. I have no reason to assume that the learned Magistrate<\/p>\n<p>would not consider such application on merits, in accordance with law<\/p>\n<p>and expeditiously.   Every court must do the same.         No special or<\/p>\n<p>specific direction appears to be necessary.           Sufficient general<\/p>\n<p>directions have already been issued in <a href=\"\/doc\/147290035\/\">Alice George v. The Deputy<\/p>\n<p>Superintendent of Police<\/a> [2003(1) KLT 339].\n<\/p>\n<p>      3.    This application is, in these circumstances, dismissed, but<\/p>\n<p>with the specific observation that if the petitioners appear before the<\/p>\n<p>learned Magistrate and apply for bail after giving sufficient prior notice<\/p>\n<p>to the Prosecutor in charge of the case, the learned Magistrate must<\/p>\n<p>proceed to pass appropriate orders on merits and expeditiously &#8211; on<\/p>\n<p>the date of surrender itself, unless there are compelling reasons.<\/p>\n<p>      4.  The learned counsel for the petitioners submits that the<\/p>\n<p>learned Magistrate may be directed while reading over the particulars<\/p>\n<p>of the offences to take note of the fact that no charges under<\/p>\n<p>Sec.143,147 and 148 are liable to be raised and other offences are<\/p>\n<p>compoundable.\n<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No. 2592 of 2007          3<\/span><\/p>\n<p>     5.   It is further submitted that there may be direction for<\/p>\n<p>expeditious disposal of the case, inasmuch as the petitioners are<\/p>\n<p>employed abroad and have to go back to their place of employment.<\/p>\n<p>     6.
