No. 139 of 1986 and C.M. No. 903<br \/>\nof 1986, affirming the Judg-\n<\/p>\n<p><span class=\"hidden_text\">512<\/span><\/p>\n<p>ment  of  the Single Judge rendered in R.F.A.  390\/75  dated<br \/>\n25.10.1985  regarding the award of compensation\t made  under<br \/>\nland  Acquisition  Act.\t The  appellant-Society\t is  running<br \/>\neducational  and  charitable Institutions in  the  State  of<br \/>\nharyana.  For providing a playground to one of its colleges,<br \/>\nthe   appellant-Society\t got  acquired\t7  bighas  of\tland<br \/>\nbelonging to the second respondent in this appeal  (original<br \/>\nclaimant  in  the land acquisition proceedings),  under\t the<br \/>\nLand Acquisition Act, 1894, hereinafter referred to as\t&#8216;the<br \/>\nAct&#8217;.  Notifications under section 4 of the Act were  issued<br \/>\non  15.05,1968,\t and  11.06.1968.  The\tnotification   under<br \/>\nsection\t 6  was\t issued on 13.8.1969.  fly  an\taward  dated<br \/>\n29.9.1970, compensation was awarded to the second respondent<br \/>\nthe land owner, at the rate of Rs. 12000\/- per acre and\t Rs.<br \/>\n1000\/-\tas  price  of well apart from 15%  solatium  and  6%<br \/>\ninterest,  from the date of Notification up to the  date  of<br \/>\naward.\n<\/p>\n<p>3.In the reference to court at the instance of the appellant<br \/>\nas well as the third respondent, the Addl.  District  Judge,<br \/>\nbyjudgment   dated   30.12.1974,   awarded   the    enhanced<br \/>\ncompensation at the rate of Re. 1\/per sq.yard for the entire<br \/>\nland and further interest at the rate of 6% per annum  under<br \/>\nsection 4 of the Act from the date of Notification till\t the<br \/>\nadditional  amount was paid to the claimant.  In the  appeal<br \/>\nfiled  by the claimant before the High Court of\t Punjab\t and<br \/>\nHaryana in R.F.A. No.390 of 1975, a learned Single Judge  of<br \/>\nthat  court by Judgment dated 25.10,1985 enhanced  the\tcom-<br \/>\npensation  for the land acquired at the rate of\t Rs.g\/-\t per<br \/>\nsq.yard.  The learned Single Judge also awarded 30%  of\t the<br \/>\nmarket\tvalue of the land acquired as solatium,\t along\twith<br \/>\n12% of such market value from the date of Notification under<br \/>\nsection\t 4 of the Act till the date of taking possession  of<br \/>\nthe  land and interest at the rate of 9% per annum  for\t the<br \/>\nfirst  year and thereafter at the rate of 15% till the\tdate<br \/>\nof  payment  of compensation for the land acquired.   It  is<br \/>\nagainst\t the  aforesaid\t Judgment  the\tpetitioner\/appellant<br \/>\nfiled LPA No. 139 of 1986 before the Division Bench, wherein<br \/>\nthe award of compensation was not interfered with.\n<\/p>\n<p>4.We  heard counsel for the appellant Sri.  H.M.  Singh\t and<br \/>\nalso the counsel for the respondents Sri Mahabir Singh.\t The<br \/>\nmain  grievance\t of counsel for the appellant was  that\t the<br \/>\nDivision  Bench\t was in error in declining to  consider\t the<br \/>\nissue  of  enhancement\tof compensation\t and  the  resultant<br \/>\nbenefits awarded by the learned Single Judge.  We find\tfrom<br \/>\na  close perusal of the Judgment of the District  Judge\t and<br \/>\nalso  the  learned  Single Judge,  that\t the  land  acquired<br \/>\npossessed  all characteristics of a potential building\tsite<br \/>\nfor  both  residential\tas  also  commercial  or  industrial<br \/>\npurposes  and  it  was\tnear  to  other\t buildings  and\t es-<br \/>\ntablishments.  Considering the totality of the circumstances<br \/>\nand  other  relevant particulars, the learned  Single  Judge<br \/>\nnoticed that the rate of land in the locality had gone up to<br \/>\nRs.  9\/-  per sq.yard in 1967 and has still gone up  to\t Rs.<br \/>\n11\/-  per sq.yard in 1970 and 1971.  In\t the  circumstances,<br \/>\nthe learned Single Judge fixed the market value for the land<br \/>\nacquired  at  Rs.8\/- per sq.yard. We are of  the  view\tthat<br \/>\nconsidering the importance of the locality, the potential of<br \/>\nthe land, and the user to which it can be put, the  fixation<br \/>\nof  the\t market\t value of the land acquired  at\t Rs.8\/-\t per<br \/>\nsq.yard\t is reasonable and the Division Bench in appeal\t did<br \/>\nnot rightly interfere with the above determination.  We hold<br \/>\nthat  the fixation of the market value of the land  acquired<br \/>\nat<br \/>\n<span class=\"hidden_text\">513<\/span><br \/>\nRs. 8\/- per sq. yard is reasonable and proper.\n<\/p>\n<p>5.The  Land Acquisition (Amendment) Act, 1984  (ActNo-68  of<br \/>\n1984) became law on 24th September, 1984.  The appeal  filed<br \/>\nby the claimant was pending before the learned Single  Judge<br \/>\nof  the\t High Court on the day when the Amendment  Act\tcame<br \/>\ninto force.  The learned Single Judge delivered the Judgment<br \/>\non  25.10.1985., So the award of 30% solatium on the  market<br \/>\nvalue  of  the land acquired is\t justified.   Similarly\t the<br \/>\naward  of the interest on excess compensation fixed  by\t the<br \/>\nCourt at the rate of 9% for the first year from the date  of<br \/>\ntaking\tpossession, and thereafter at 15% till the  date  of<br \/>\npayment\t of  the  compensation for  the\t land  acquired,  is<br \/>\nequally\t justified.  But we are of the view that the  amount<br \/>\nof  12% per annum awarded on the market value from the\tdate<br \/>\nof  publication of the Notification under section 4  of\t the<br \/>\nAct till the date of taking possession of the land,  awarded<br \/>\nas  per section 23(1A), is not legally justified.   In\tthis<br \/>\ncase,  the  proceedings for land acquisition  cornmenced  as<br \/>\nearly  as 15.5.1968 and the award was made by the  Collector<br \/>\non  29.2.1970,\tand  the possession of the  land  was  taken<br \/>\nimmediately  thereafter.   All\tsuch  events  happened\tlong<br \/>\nbefore\tthe  Land Acquisition (Amendment) Act of  1984.\t  In<br \/>\nsuch  cases  the claimants are not entitled to\tthe  benefit<br \/>\nunder  section 23(1-A) of the Land  Acquisition\t (Amendment)<br \/>\nAct  (Amendment Act 68 of 1984).  This view is fortified  by<br \/>\nthe decision of this Court in <a href=\"\/doc\/501453\/\">Union of India v. B. V. Saroja<br \/>\n&amp; Anr.<\/a> (1995 (1) SCALE 309).\n<\/p>\n<p>6.In  the result, we hold that the claimant is not  entitled<br \/>\nto the benefit of section 23(1-A) of the Act &#8211;,award of  an<br \/>\namount calculated at the rate of 12% per annum on the market<br \/>\nvalue from the date of publication of the notification under<br \/>\nsection\t 4 of the Act till the date of taking possession  of<br \/>\nthe  land.  Subject to this modification, the  decisions  of<br \/>\nthe  courts below are affirmed.\t There shall be no order  as<br \/>\nto costs in this appeal.\n<\/p>\n<p><span class=\"hidden_text\">515<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Sa.
