K.S.RADHAKRISHNAN)<\/p>\n<p>\tHeard<br \/>\nlearned counsel for the appellant-petitioner.\n<\/p>\n<p>\tWe<br \/>\nfind no infirmity in the reasonings of the learned Single Judge in<br \/>\nthe order impugned in this Letters Patent Appeal.\n<\/p>\n<p>\tEven<br \/>\non facts also, it reveals that the Joint Charity Commissioner has<br \/>\nrejected the application of the Mehsana Panjarapole Trust under<br \/>\nSection 36 of the Bombay Public Trust giving liberty to the trust to<br \/>\ninitiated the process afresh. Some adverse observations were made by<br \/>\nthe Joint Charity Commissioner against the Trustee of the Trust which<br \/>\nled the trustees to file an appeal before the Gujarat Revenue<br \/>\nTribunal. Since the application of the trust was rejected, the<br \/>\nappellant-petitioner who was highest bidder in the auction<br \/>\nproceedings, also preferred an appeal before the Gujarat Revenue<br \/>\nTribunal praying to confirm the sale of the trust property in his<br \/>\nfavour. The Tribunal partly allowed the appeal of the trustee<br \/>\nexpunging the remarks, and dismissed the appeal of the<br \/>\nappellant-petitioner. We find that now the trust is not interested to<br \/>\nsell the property. Therefore, the trust cannot be compelled to sale<br \/>\nthe property against their interest.\n<\/p>\n<p>\tThat<br \/>\nbeing the fact situation, we will not be justified to interfere with<br \/>\nthe order passed by the Joint Charity Commissioner as well as the<br \/>\norder passed by the Tribunal.\n<\/p>\n<p>\tWith<br \/>\nthe above observations, the Letters Patent Appeal and Civil<br \/>\nApplication for stay stand dismissed.\n<\/p>\n<p>    (K.S.
