DAVE\n\t\t\t\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 13\/11\/2008 \n\n \n\n \nCOMMON\nORAL ORDER<\/pre>\n<p>The<br \/>\n\tpetitioners have filed these petitions under Article 226 of the<br \/>\n\tConstitution of India inter alia with the following main prayers :-\n<\/p>\n<p> 12(b) Your<br \/>\nLordships may be pleased to issue a writ of mandamus or any other<br \/>\nappropriate writ, direction and\/or orders directing the respondents<br \/>\nto get the encroachment in the Gauchar land of Sarvai village in Tal.<br \/>\nBotad of Bhavnagar District. The respondents be further directed to<br \/>\ntake suitable action within a time bound program.\n<\/p>\n<p>(c) Your<br \/>\nLordships be pleased to direct the respondents to take suitable<br \/>\nactions to report the Hon&#8217;ble Court about the actions taken and<br \/>\nproposed to be taken for the purpose of removing the encroachment in<br \/>\nthe Gauchar land.\n<\/p>\n<p>(d) Your<br \/>\nLordships be further pleased to direct that pending admission,<br \/>\nhearing and final disposal of this petition the respondents should<br \/>\nsee that there is no further encroachment over the Gauchar land of<br \/>\nSarvai village .\n<\/p>\n<p>According<br \/>\n\tto learned counsel for the petitioners they are carrying out<br \/>\n\tactivity of animal husbandry and grazing cattle.  As per the policy<br \/>\n\tof the Government certain piece of land nearby the village is to be<br \/>\n\tkept as Gauchar land which is encroached by the encroachers and<br \/>\n\ttherefore the petitioners are unable to maintain livestock.  The<br \/>\n\tpetitioners further submit that some of the encroachers are<br \/>\n\tpolitically influenced and such persons include even Sarpanch of the<br \/>\n\tvillage and President and members of the Taluka Panchayat and<br \/>\n\ttherefore the authorities are loath in taking appropriate action in<br \/>\n\taccordance with law. In reply to the notice and earlier directions<br \/>\n\tgiven by this Court, respondent No.6-Taluka Development Officer,<br \/>\n\tBotad had filed affidavit in reply and submitted that the<br \/>\n\tpetitioners have suppressed vital facts about status of the<br \/>\n\tpetitioners inasmuch as the petitioner No.1 of Special Civil<br \/>\n\tApplication No.21792 of 2007 is ad-hoc Gram Mitra, an employee of<br \/>\n\tthe Gram Panchayat is father of Nathubhai, who is residing together<br \/>\n\twith petitioner No.1 has encroached upon disputed gauchar land and<br \/>\n\tthe said fact is not disclosed in the petition and on notice being<br \/>\n\tissued on 27.8.2007 said Shri Nathubhai has removed encroachment.<br \/>\n\tNot only that but relatives of the petitioners, including brother<br \/>\n\thave encroached upon simthal land of the Government for which<br \/>\n\tMamlatdar, Botad has taken action.  Thus, the petitioners have not<br \/>\n\tapproached this Court with clean hands and by suppressing the very<br \/>\n\tvital facts about encroaching the land, obtained the order from this<br \/>\n\tCourt.  Not only that a prayer is made to remove the encroachment of<br \/>\n\tthe gauchar land  and allegations have been levelled against the<br \/>\n\tpersons who have encroached the land belonging to gauchar land are<br \/>\n\tnot joined as party and any order that may be passed by this Court<br \/>\n\tis likely to affect such persons. It is further submitted that<br \/>\n\tTaluka Development Officer has stated that the measurement of the<br \/>\n\tgauchar land is undertaken and immediate action will be taken to<br \/>\n\tclear the gauchar land.  It is further submitted that as the first<br \/>\n\tstep of the measurement the Panchayat has removed eight different<br \/>\n\tpersons and panchnama was also drawn by which 24 acres of land has<br \/>\n\tbeen cleared.  Therefore, according to learned counsel for the<br \/>\n\trespondent No.6 all possible measures have been undertaken.\n<\/p>\n<p>Learned<br \/>\n\tAGP appearing for the respondent-State submits that necessary<br \/>\n\tinstructions have been passed to the Competent authority of the<br \/>\n\tDistrict as well as Taluka Panchayat and after following procedure<br \/>\n\tunder Bombay Land Revenue Code, which requires issuance of notice<br \/>\n\tetc. under Sections 61 and 202 further proceedings will be<br \/>\n\tundertaken.\n<\/p>\n<p>Considering<br \/>\n\tthe above facts and circumstances of the case and the affidavit in<br \/>\n\treply filed by the Taluka Development Officer, Botad and submissions<br \/>\n\tmade by learned AGP that the authorities have taken sufficient steps<br \/>\n\tto remove the encroachment from the gauchar land after undertaking<br \/>\n\tmeasurement so as to determine the exact area of gauchar land.  Not<br \/>\n\tonly that but as a part of the above measures 24 acres of land is<br \/>\n\tcleared.  So far as removal of remaining encroachment is concerned,<br \/>\n\tthey are following the procedure as envisaged under law, at this<br \/>\n\tstage, no further direction can be given to the petitioners who have<br \/>\n\tsuppressed the very vital facts about encroaching gaucher land by<br \/>\n\tthemselves without joining the persons likely to be affected, if<br \/>\n\tany, directions  are given to remove the encroachment.  No case is<br \/>\n\tmade out to exercise extra-ordinary writ jurisdiction under Article<br \/>\n\t226 of the constitution of India.  It is needless to say that the<br \/>\n\tpowers vested in the authority under the statute are to be exercised<br \/>\n\tby such authority and a perusal of the record if it is found that<br \/>\n\tthe authority has taken necessary steps to comply with the<br \/>\n\tprovisions of the statue, powers under Article 226 of the<br \/>\n\tConstitution of India cannot be invoked by this Court as held by the<br \/>\n\tApex Court in the case of <a href=\"\/doc\/339885\/\">Muni Suvrat Swami Jain S.M.P.Sangh<br \/>\n\tv. Arun Nathuram Gaikwad<\/a> reported in AIR 2007 SC 38.\n<\/p>\n<p>In<br \/>\n\tview of the above discussion, all these petitions fail and are<br \/>\n\thereby dismissed.\n<\/p>\n<p>\tRule<br \/>\ndischarged.
