The brief facts of the case<\/p>\n<p>are the following. The respondent\/applicant was a Junior Deck<\/p>\n<p>Hand working under the writ petitioners.        He was granted 18<\/p>\n<p>months study leave from 26.12.1994 to 24.6.1996 to undergo a<\/p>\n<p>special course of study, so that he can take the Mate (Fishing<\/p>\n<p>Vessel) Certificate Examination. He also executed a bond in form<\/p>\n<p>7 as provided under Rule 53(4) of the CCS(Leave) Rules. He<\/p>\n<p>completed the course and took the examination. But he could<\/p>\n<p>clear only parts B and C and failed in Part A of the examination.<\/p>\n<p>In other words, he failed to clear the examination in full. In view<\/p>\n<p>of the said position, second petitioner took steps to recover the<\/p>\n<p>salary paid to him during the leave period. Challenging those<\/p>\n<p>proceedings O.A.550\/2004 was filed. The Tribunal after hearing<\/p>\n<p>both sides took the view that going by the rules, there is no<\/p>\n<p>stipulation that the applicant should clear the examination.<\/p>\n<p>Completion of the course alone is sufficient as per rules. Based<\/p>\n<p>W.P.(C).No.3969 of 2006 &#8211; S<\/p>\n<p><span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>on that finding the proceedings initiated against the applicant to<\/p>\n<p>recover salary during the leave period were quashed.                The<\/p>\n<p>respondents therein aggrieved by the said decision of the CAT,<\/p>\n<p>have filed the present writ petition. The petitioners mainly rely<\/p>\n<p>on Rule 63(1) and Rule 53(4) of the CCS (Leave) Rules in support<\/p>\n<p>of their contentions. Rule 63(1) reads as follows:<\/p>\n<blockquote><p>         &#8220;63. Resignation or retirement after study leave or<br \/>\n         non-completion of the course of study.\n<\/p><\/blockquote>\n<blockquote><p>         (1) If a Government servant resigns or retires from<br \/>\n         service or otherwise quits service without returning to<br \/>\n         duty after a period of study leave or within a period of<br \/>\n         three years after such return to duty or fails to<br \/>\n         complete the course of study and is thus unable to<br \/>\n         furnish the certificates as required under sub-rule (5) of<br \/>\n         Rule 53 he shall be required to refund &#8211;\n<\/p><\/blockquote>\n<blockquote><p>         (i)   the actual amount of leave salary, Study<br \/>\n         Allowance, cost of fees, travelling and other expenses,<br \/>\n         if any, incurred      by the Government of India;<br \/>\n         and &#8230;&#8230;&#8230;&#8230;&#8230;\n<\/p><\/blockquote>\n<blockquote><p>         Provided that except in the case of employees who fail<br \/>\n         to complete the course of study nothing in this rule<br \/>\n         shall apply &#8211;\n<\/p><\/blockquote>\n<blockquote><p>         (a)   to a Government servant who, after return to<br \/>\n         duty from study leave, is permitted to retire from<br \/>\n         service on medical grounds; or &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..&#8221;.\n<\/p><\/blockquote>\n<p>The above quoted Rule 63 provides that the incumbent should<\/p>\n<p>furnish the certificate as required under sub-rule 5 of Rule 53.<\/p>\n<p>Otherwise he will be required to refund leave salary. Sub-rule 5<\/p>\n<p>W.P.(C).No.3969 of 2006 &#8211; S<\/p>\n<p><span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>of Rule 53 reads as follows:\n<\/p>\n<blockquote><p>         &#8220;53. Sanction of study leave.\n<\/p><\/blockquote>\n<pre>                     x     x    x     x     x\n\n                     x     x    x     x     x\n\n<\/pre>\n<blockquote><p>         (5)(a)   On completion of the course of study, the<br \/>\n         Government servant shall submit to the authority<br \/>\n         which granted him the study leave, the certificates of<br \/>\n         examinations passed or special courses of study<br \/>\n         undertaken, indicating the date of commencement and<br \/>\n         termination of the course with the remarks, if any, of<br \/>\n         the authority in charge of the course of study&#8221;.\n<\/p><\/blockquote>\n<p>The said rule provides for producing the certificate of the<\/p>\n<p>examination passed or the course of study undertaken. The said<\/p>\n<p>rule does not say that he should clear the examination and<\/p>\n<p>present the certificate. He should submit whatever examination<\/p>\n<p>he was able to clear.      But according to the petitioners, when<\/p>\n<p>these two rules are read together it is mandatory to complete the<\/p>\n<p>course, pass the examination and produce the certificates as<\/p>\n<p>proof thereof. The respondent on the other hand would submit<\/p>\n<p>that the Rules do not expressly state that the applicant should<\/p>\n<p>pass the examination after the completion of the course of study<\/p>\n<p>and otherwise he should repay the leave salary that was received<\/p>\n<p>by him.\n<\/p>\n<p>W.P.(C).No.3969 of 2006 &#8211; S<\/p>\n<p><span class=\"hidden_text\">                                   4<\/span><\/p>\n<p>     2.    Going by the rules, two views are possible. A view in<\/p>\n<p>favour of the employee has been taken by the Tribunal. Both<\/p>\n<p>sides did not cite any precedent on this point.         Normally, by<\/p>\n<p>interpreting a rule additional burden cannot be cast on an<\/p>\n<p>incumbent who is governed by the rule. If there is vagueness in<\/p>\n<p>the rule regarding any liability arising therefrom, normally,<\/p>\n<p>vagueness should go in favour of the person affected.
