Name and designation of the PIO in favour of whom the IPO will be given.\n<\/p>\n<p>Reply of the Public Information Officer (PIO):\n<\/p>\n<p>PIO\/Director Sh.V.K Singh vide his letter dated 03.11.09 transferred the case to Sh. R.L Singh,<br \/>\nPIO\/Director, DJET, HQ, Labour and Employment Ministry, Shram Shakti Bhawan, Rafi Marg, New<br \/>\nDelhi, who further transferred it vide his letter dated 17.12.2009 to the Director, DJET, Guru Gobind<br \/>\nSingh Marg, Lucknow-226004 (U.P).\n<\/p>\n<p><span class=\"hidden_text\">                                                                                               Page 1 of 3<\/span><\/p>\n<p> Grounds for the First Appeal:\n<\/p>\n<p>Unsatisfactory information provided by the PIO.\n<\/p>\n<p>Order of the First Appellate Authority (FAA):\n<\/p>\n<p>The FAA transferred the RTI application to the Director Directorate of Employment and Training, Guru<br \/>\nGobind Singh Marg, Lucknow- 2266004 (UP) by his letter of 17\/12\/2009.\n<\/p>\n<p>Grounds for the Second Appeal:\n<\/p>\n<p>Unsatisfactory information provided by the PIO<\/p>\n<p>Relevant Facts emerging during the hearing held on 16\/08\/2010:<br \/>\nThe following were present:\n<\/p>\n<p>Appellant: Mr. Shiv Kumar Tiwari representing Smt. Anguri Devi;<br \/>\nRespondent: Absent;\n<\/p>\n<p>        &#8220;The appellant states that no information has been received by him so far. The Commission directs<br \/>\nthe Director Directorate of Employment and Training, Guru Gobind Singh Marg, Lucknow- 2266004 (UP<br \/>\nto send the information to the appellant.&#8221;\n<\/p>\n<p>Decision dated 16\/08\/2010:\n<\/p>\n<p>The Appeal was allowed.\n<\/p>\n<p>      &#8220;The Director, Directorate of Employment and Training, Guru Gobind Singh Marg,<br \/>\nLucknow- 2266004 (UP) is directed to send the complete information to the appellant<br \/>\nbefore 10 September 2010.\n<\/p>\n<p>The issue before the Commission is of not supplying the complete, required information by the PIO<br \/>\nwithin 30 days as required by the law.\n<\/p>\n<p>From the facts before the Commission it is apparent that the PIO is guilty of not furnishing information<br \/>\nwithin the time specified under sub-section (1) of Section 7 by not replying within 30 days, as per the<br \/>\nrequirement of the RTI Act.\n<\/p>\n<p>It appears that the PIO&#8217;s actions attract the penal provisions of Section 20 (1). A showcause notice is<br \/>\nbeing issued to him, and he is directed give his reasons to the Commission to show cause why penalty<br \/>\nshould not be levied on him.\n<\/p>\n<p>He will present himself before the Commission at the above address on 24 September 2010 at 2.30pm<br \/>\nalongwith his written submissions showing cause why penalty should not be imposed on him as mandated<br \/>\nunder Section 20 (1). He will also submit proof of having given the information to the appellant.&#8221;\n<\/p>\n<p>Facts leading to showcause hearing on 26\/05\/2011:\n<\/p>\n<p>       On 24\/09\/2010, the PIO did not appear and the Commission did not receive any written<br \/>\nexplanations from him for delay in providing the information to the Appellant. On the basis of which the<br \/>\nCommission again issued another showcause notice to the PIO to appear before the Commission on<br \/>\n23\/11\/2010. However, the PIO again did not appear before the Commission on 23\/11\/2010 and the<br \/>\nCommission did not receive any written explanations from him for explaining his absence on 24\/09\/2010<br \/>\nand on 23\/11\/2010. The Commission also directed him to provide the complete information sought in<br \/>\nqueries 6 and 7 of the RTI application dated 27\/10\/2009 to the Appellant before 18\/10\/2010 with a copy to<br \/>\nthe Commission. However, a representative of the Appellant appeared on 23\/11\/2010 and submitted that<br \/>\nno information has been provided to him after the Commission&#8217;s direction.\n<\/p>\n<p><span class=\"hidden_text\">                                                                                             Page 2 of 3<\/span><\/p>\n<p> Therefore, the Commission directed the PIO to provide the complete information sought in queries 6 and<br \/>\n7 of the RTI application dated 27\/10\/2009 to the Appellant before 20\/05\/2011 with a copy to the<br \/>\nCommission. Further, the Commission decided to schedule another hearing on 26\/05\/2011 at 02:30 pm.<\/p>\n<p>Relevant facts emerging during the showcause hearing on 26\/05\/2011:<br \/>\nAppellant: Absent;\n<\/p>\n<p>Respondent: Mr. Birendra Bahadur Singh, Technical Officer &amp; PIO;\n<\/p>\n<p>        The Respondent states that the RTI application has been filed with Director General of<br \/>\nEmployment and Training (DGET), Ministry of Labour and Employment, Shram Shakti Bhawan, Rafi<br \/>\nMarg, Delhi. The information sought was regarding a complaint filed by the Appellant on 06\/10\/2009 at<br \/>\nthe office of the DGET. The PIO DGET wrongly transferred the RTI application to the PIO at Lucknow<br \/>\nOffice. Whereas the entire information sought by the Appellant was of the DGET office at New Delhi.<br \/>\nPIO Lucknow has transferred the RTI application to PIO DGET New Delhi on 08\/09\/2010. The<br \/>\nCommission therefore directs the PIO Director General of Employment and Training (DGET), Ministry of<br \/>\nLabour and Employment, Shram Shakti Bhawan, Rafi Marg, Delhi to send the complete information to<br \/>\nthe Appellant based on available records.\n<\/p>\n<p>Regarding the complaint of the Appellant the Commission directs that apart from providing the<br \/>\ninformation sought by the Appellant the information shall also be provided to her in the following format:\n<\/p>\n<blockquote><p>          Date on which      Name and designation of Action taken Date on which forwarded to<br \/>\n          Complaint received The officer receiving it.            Next officer\/office.<\/p>\n<p>             *there will be as many rows as the number of officers who handled the complaint.<\/p>\n<\/blockquote>\n<p>Attested photocopies of all letters and notings will be provided.\n<\/p>\n<p>Adjunct decision:\n<\/p>\n<p>The PIO Director General of Employment and Training (DGET), New Delhi is directed to<br \/>\nprovide the information to the Appellant before 15 June 2011.\n<\/p>\n<p>The issue before the Commission is of not supplying the complete, required information by the PIO,<br \/>\nDGET New Delhi within 30 days as required by the law.\n<\/p>\n<p>From the facts before the Commission it is apparent that the PIO is guilty of not furnishing information<br \/>\nwithin the time specified under sub-section (1) of Section 7 by not replying within 30 days, as per the<br \/>\nrequirement of the RTI Act.
