(Oral)\n<\/pre>\n<p>              The petitioner is an institution established to impart education<\/p>\n<p>for various engineering courses. The institute was duly recognised by the<\/p>\n<p>AICTE vide letter dated 29.06.2008 as an Engineering College for girls<\/p>\n<p>only.      The intake capacity of the college is 270 for three different<\/p>\n<p>engineering courses with 90 intake capacity for each course. The petitioner<\/p>\n<p>approached the AICTE vide letter dated 28.08.2008 for permission to<\/p>\n<p>convert the girls college to a co-education institution from academic session<\/p>\n<p>2008-2009.         Receiving no response, the petitioner sent another<\/p>\n<p>representation     dated 16.10.2008     for the same purpose.         Even this<\/p>\n<p>representation of the petitioner has not been responded to. The petitioner<br \/>\n<span class=\"hidden_text\"> CWP No.11846 of 2009                                   : 2:<\/span><\/p>\n<p>has accordingly approached this Court seeking a direction in the mature of<\/p>\n<p>mandamus to permit the petitioner to convert the Institute from Girls<\/p>\n<p>Institute of Engineering to Co-educational Institute for Engineering as the<\/p>\n<p>petitioner has not been able to attract enough number of girl students to fill<\/p>\n<p>up the intake capacity. It is stated that during the academic session 2008-<\/p>\n<p>2009 only 24 girl students could be admitted and for the session 2009-<\/p>\n<p>2010, only 9 girl students have been admitted.\n<\/p>\n<p>             It is contended that the petitioner has created all infrastructure<\/p>\n<p>and has also requisite number of the faculty members according to the<\/p>\n<p>intake capacity of the students. However, the girl students are not available.<\/p>\n<p>The petitioner-institute is starving and is at the stage of collapse.<\/p>\n<p>             The AICTE has not filed the reply and has argued the matter.<\/p>\n<p>However, Mr. Sharma appearing on its behalf submits that the petitioner<\/p>\n<p>should possess the requisite infrastructure and faculty members for the<\/p>\n<p>purpose.     It is further contended that the petitioner institution cannot be<\/p>\n<p>converted into a co-educational institution as various incentives were given<\/p>\n<p>to the petitioner-Institute at the time of its establishment as a girls institute.<\/p>\n<p>             A similar issue came to be considered by this Court in CWP<\/p>\n<p>No.8318 of 2009 (Shree Siddhivinayak Educational Trust Vs. State of<\/p>\n<p>Haryana and others), decided on 15.07.2009. In the aforesaid writ petition<\/p>\n<p>also, the issue of conversion of the girls institute into a co-educational<\/p>\n<p>institute has been considered after rejection of the request by the AICTE.<\/p>\n<p>While considering the aforesaid issue, this Court made the following<\/p>\n<p>observations:-\n<\/p>\n<blockquote><p>                           &#8220;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; The petitioner now wanted to<\/p>\n<p>                           convert the Women Institutions into Co-education<br \/>\n<span class=\"hidden_text\"> CWP No.11846 of 2009                                : 3:<\/span><\/p>\n<p>                       Institutions.<\/p>\n<pre>                                       In the     short reply filed by the\n\n                       respondents,      the     grounds   for   rejection   as\n\n<\/pre>\n<blockquote><p>                       mentioned in Annexure P-7, have been reiterated.<\/p>\n<\/blockquote>\n<blockquote><p>                                       Vide order dated 10.07.2009, further<\/p>\n<p>                       information was sought from the AICTE. The said<\/p>\n<p>                       order reads as follows:-\n<\/p><\/blockquote>\n<blockquote>\n<p><span class=\"hidden_text\">                             &#8220;Reply on behalf of respondents No.3 and 4<\/span><\/p>\n<\/blockquote>\n<blockquote><p>                             filed in Court is taken on record.<\/p>\n<p>                             The moot question that needs consideration<\/p>\n<p>                             is whether the policy of the AICTE<\/p>\n<p>                             permitting establishment of girls institute is<\/p>\n<p>                             an absolute bar for its alteration at any<\/p>\n<p>                             subsequent stage or there is no embargo for<\/p>\n<p>                             such an established institution to apply for<\/p>\n<p>                             deviation for conversion into a co-education<\/p>\n<p>                             institution.       Mr.Sharma shall produce the<\/p>\n<p>                             requisite policy on the next date of hearing.<\/p>\n<p>                             List on 14.07.2009.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                                       Mr.SK     Sharma,    learned    counsel<\/p>\n<p>                       appearing for the AICTE has produced the Policy<\/p>\n<p>                       Decisions of the Council with regard to Approval<\/p>\n<p>                       Process. He has referred paragraphs 9.20, 9.21<\/p>\n<p>                       and 9.28 of the Policy Decision to argue that the<\/p>\n<p>                       petitioner is not entitled to convert its existing<br \/>\n<span class=\"hidden_text\"> CWP No.11846 of 2009                            : 4:<\/span><\/p>\n<p>                       institutions into integrated Campus as a Co-<\/p>\n<\/blockquote>\n<blockquote><p>                       education institution. Paragraph 9.20 deals with the<\/p>\n<p>                       change      of name of an institution, whereas<\/p>\n<p>                       paragraph 9.21 deals with change of category of an<\/p>\n<p>                       Institution i.e. from Self-financing to Aided etc.<\/p>\n<p>                       Both these paragraphs have no application in the<\/p>\n<p>                       present case. Paragraph 9.28 deals          with the<\/p>\n<p>                       establishment of New Technical institutions for<\/p>\n<p>                       Women, which is reproduced as under:-<\/p>\n<\/blockquote>\n<blockquote><p>                             &#8221; 9.28 Establishment of New Technical<\/p>\n<p>                             Institutions for Women.\n<\/p><\/blockquote>\n<blockquote><p>                             For    establishment      of    new    technical<\/p>\n<p>                             institutions exclusively set up for women<\/p>\n<p>                             certain norms have been relaxed which are<\/p>\n<p>                             as follows:-\n<\/p><\/blockquote>\n<blockquote><p>                             a.    Land: For the technical institutions<\/p>\n<p>                             exclusively set up for women, the land<\/p>\n<p>                             norms prescribed for establishment of all<\/p>\n<p>                             other Technical Institutions have been<\/p>\n<p>                             relaxed up to 50% in rural category and 20%<\/p>\n<p>                             in Metro &amp; State Capital category and 10%<\/p>\n<p>                             in Mega Cities category.\n<\/p><\/blockquote>\n<blockquote><p>                             b. FDR and Processing Fee: 20% relaxation<\/p>\n<p>                             are allowed in FDR amount and processing<\/p>\n<p>                             fees for establishment         of new technical<br \/>\n<span class=\"hidden_text\"> CWP No.11846 of 2009                                 : 5:<\/span><\/p>\n<p>                             institutions exclusively set up for women.<\/p>\n<p>                             c. Built up area &amp; Number of courses and<\/p>\n<p>                             intake: The total built up area required for<\/p>\n<p>                             setting up of new institutions are as per<\/p>\n<p>                             existing norms. However, to start with<\/p>\n<p>                             institutions for women will be allowed up to<\/p>\n<p>                             5 courses with total annual intake of 300<\/p>\n<p>                             with each course intake not exceeding 90.<\/p>\n<\/blockquote>\n<pre>                             d.     Single window system for processing\n\n                             proposals: Two copies          o the application\n\n<\/pre>\n<blockquote><p>                             shall be submitted to the Member Secretary,<\/p>\n<p>                             AICTE along with a proof                of having<\/p>\n<p>                             submitted a copy of the application each to<\/p>\n<p>                             the     affiliating     University   and        State<\/p>\n<p>                             Government        and    a Demand       Draft     of<\/p>\n<p>                             Rs.5000\/- drawn on a nationalized bank in<\/p>\n<p>                             favour of &#8220;The Member Secretary, AICTE&#8221;<\/p>\n<\/blockquote>\n<blockquote><p>                             payable at New Delhi.          One copy of the<\/p>\n<p>                             application shall be directly submitted each<\/p>\n<p>                             to the affiliating University and the State<\/p>\n<p>                             Government either in person or through<\/p>\n<p>                             Speed\/Registered Post.&#8221;.<\/p><\/blockquote>\n<\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                                     From the perusal of the aforesaid<\/p>\n<p>                       paragraph,    it   is   abundantly    clear    that     for<\/p>\n<p>                       establishment of the New Technical Institutions for<br \/>\n<span class=\"hidden_text\"> CWP No.11846 of 2009                             : 6:<\/span><\/p>\n<p>                       Women, the AICTE          had introduced various<\/p>\n<p>                       incentives stipulated therein. It is not in dispute<\/p>\n<p>                       that the petitioner did avail all incentives while<\/p>\n<p>                       introducing two Women Institutions referred to<\/p>\n<p>                       above and now the petitioner-Trust has approached<\/p>\n<p>                       AICTE for conversion of these Institutions into co-<\/p>\n<p>                       educational institutions and for integration of the<\/p>\n<p>                       Campus.\n<\/p><\/blockquote>\n<blockquote><p>                                   Mr.Sunil Chadha, learned counsel for<\/p>\n<p>                       the petitioner has made a statement at the Bar and<\/p>\n<p>                       has also referred to the averments made in his<\/p>\n<p>                       application Annexure P-3 to the effect that the<\/p>\n<p>                       petitioner is still ready and willing to forego all<\/p>\n<p>                       incentives. Not only this, the petitioner has given<\/p>\n<p>                       the details in paragraph 21 of the writ petition to<\/p>\n<p>                       indicate that petitioner has already surrendered all<\/p>\n<p>                       incentives and benefits secured at the time of<\/p>\n<p>                       establishment of the two Women Institutions. It is<\/p>\n<p>                       also    stated    that    the    land    for     co-\n<\/p><\/blockquote>\n<blockquote><p>                       educational\/integrated Campus has already been<\/p>\n<p>                       purchased and the necessary infrastructure is<\/p>\n<p>                       complete and     ready.   It is also stated that the<\/p>\n<p>                       petitioner even deposited the additional fee for<\/p>\n<p>                       establishing a co-educational Institution.     It is,<\/p>\n<p>                       accordingly, prayed that the petitioner may be<\/p>\n<p>                       permitted to switch over to the co-educational<br \/>\n<span class=\"hidden_text\"> CWP No.11846 of 2009                             : 7:<\/span><\/p>\n<p>                       institution because the petitioner has completed all<\/p>\n<p>                       norms as required by the AICTE.\n<\/p><\/blockquote>\n<blockquote><p>                                     Even though        the AICTE in its<\/p>\n<p>                       impugned letter Annexure P-7 has rejected the<\/p>\n<p>                       claim of the petitioner for conversion of the Girls<\/p>\n<p>                       Institutions to Co-educational Institutions, no but<\/p>\n<p>                       rules, regulations or norms or policy decision has<\/p>\n<p>                       been brought to the notice of this Court with<\/p>\n<p>                       regard to conversion of the Girls Institutions into<\/p>\n<p>                       co-education Institutions. What has been brought<\/p>\n<p>                       to my notice is paragraph 9.28 of the Policy<\/p>\n<p>                       decision which only provides for relaxation of<\/p>\n<p>                       norms in case one intends to establish a girl<\/p>\n<p>                       institute. It does not, in any manner, create an<\/p>\n<p>                       embargo for conversion of the girls Institution to<\/p>\n<p>                       co-educational institution if the Institution is ready<\/p>\n<p>                       and willing to meet all norms\/requirements of the<\/p>\n<p>                       AICTE.\n<\/p><\/blockquote>\n<blockquote><p>                                     In view of the above, present petition<\/p>\n<p>                       is allowed.    Impugned letter dated 04.03.2009,<\/p>\n<p>                       Annexure P-7, is hereby set aside. The AICTE is<\/p>\n<p>                       directed to take a fresh decision on the application<\/p>\n<p>                       of the petitioner for conversion of the existing girls<\/p>\n<p>                       Institutions to that of    co-education Institutions<\/p>\n<p>                       with integrated campus on the basis of the norms<\/p>\n<p>                       meant for the Co-education Institutions\/integrated<br \/>\n<span class=\"hidden_text\"> CWP No.11846 of 2009                                : 8:<\/span><\/p>\n<p>                         campus, as stipulated in Annexure P-2.           The<\/p>\n<p>                         petitioner has also notified the courses intended to<\/p>\n<p>                         be started after conversion,          even though,<\/p>\n<p>                         presently, the petitioner is running different kinds<\/p>\n<p>                         of courses. AICTE will also examine this aspect of<\/p>\n<p>                         the matter and may permit the petitioner to switch<\/p>\n<p>                         over to new courses as may be considered<\/p>\n<p>                         appropriate.      The AICTE is further directed to<\/p>\n<p>                         pass a fresh order keeping in view the above<\/p>\n<p>                         aspects subject     to fulfillment of the necessary<\/p>\n<p>                         conditions\/norms by the petitioner in this regard.<\/p>\n<p>                         Let the decision in this regard be taken within a<\/p>\n<p>                         period of one week from the date a certified copy<\/p>\n<p>                         of this order is made available to the competent<\/p>\n<p>                         authority.&#8221;<\/p><\/blockquote>\n<p>            In the present case also, the petitioner has stated that the<\/p>\n<p>petitioner is ready and willing to forego all the incentives obtained by it for<\/p>\n<p>establishment of the girls institute. Not only this, in paragraph 14 of the<\/p>\n<p>writ petition, the petitioner has also stated that the petitioner is ready and<\/p>\n<p>willing to pay the additional processing fee. It is also averred that the<\/p>\n<p>petitioner has also purchased the additional adjoining land of 5 acres and<\/p>\n<p>has already created the additional FDR of Rs.15 lacs.\n<\/p>\n<p>            In view of the above circumstances, this petition is allowed in<\/p>\n<p>the light of the judgment mentioned hereinabove. It is directed that the<\/p>\n<p>petitioner be allowed to convert the girls institute to a co-educational<br \/>\n<span class=\"hidden_text\"> CWP No.11846 of 2009                                : 9:<\/span><\/p>\n<p>institute subject to completion of all formalities. Respondent No.4 will<\/p>\n<p>accordingly allot the students to the petitioner institute after it acquires the<\/p>\n<p>status of co-educational institute. It is further directed that the AICTE will<\/p>\n<p>take decision on the request of the petitioner for conversion of the present<\/p>\n<p>girls institute into a co-educational institute within a period of 10 days. In<\/p>\n<p>the meantime, respondent No.4 will allot students to the petitioner<\/p>\n<p>institution treating as a co-educational institute.
