SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 11\/07\/2008 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.<br \/>\nPresent appeal from order is filed by the appellants-original<br \/>\ndefendants challenging the order passed by the learned 6th<br \/>\nAdditional Civil Judge (S.D.), Vadodara dated 28.2.2008 passed below<br \/>\nExh.5 in Special Civil Suit No.974 of 2002 by which the trial court<br \/>\nhas directed the appellants herein-original defendants to maintain<br \/>\nstatus-quo position of the suit land till the final disposal of the<br \/>\nsuit.\n<\/p>\n<p>2.<br \/>\n The original plaintiffs had filed a Special Civil Suit No.974 of<br \/>\n2002 before the trial court for declaration to declare the decree as<br \/>\nnull and void and for permanent injunction.  In the said suit, the<br \/>\nplaintiffs submitted application Exh.5 for temporary injunction to<br \/>\nrestrain the defendants from transferring the same in any manner<br \/>\nwhatsoever and from implementing the decree passed in view of<br \/>\nKarardad with respect to the land in question.  Considering the<br \/>\nserious disputes with regard to Karardad and the consent decree and<br \/>\nthe allegations and with a view to avoid further multiplicity of the<br \/>\nproceeding and third parties rights are not created, the trial court<br \/>\nin a well reasoned speaking order has exercised discretion and has<br \/>\ngranted application Exh.5 by directing the appellants-original<br \/>\ndefendants to maintain status-quo.\n<\/p>\n<p>3.\tShri<br \/>\nP.F.Makwana, learned advocate appearing on behalf of the appellants<br \/>\nhas submitted that even the original plaintiffs have gone to the<br \/>\nextent of making allegations against the learned Judge.  However,<br \/>\nlearned advocate is not in a position to substantiate the same.  On<br \/>\nthe contrary, looking to the application, it appears that the<br \/>\noriginal defendants  have submitted that though the trial court<br \/>\npointed out that the Karardad is not in the interest of the parties,<br \/>\nstill the learned advocate appearing on behalf of the original<br \/>\ndefendants  insisted to pass the consent decree.  There are serious<br \/>\nallegations against the learned advocate appearing on behalf of<br \/>\ndefendants  which are required to be considered and dealt with at the<br \/>\ntime of trial.\n<\/p>\n<p>4.\tConsidering<br \/>\nthe above, when the trial court has exercised discretion judiciously<br \/>\nand has passed the order of status-quo, the same is not required to<br \/>\nbe interfered with by this Court.  At this stage, the judgment of the<br \/>\nlearned Single Judge of this Court in the case of <a href=\"\/doc\/1728969\/\">Khimjibhai<br \/>\nHarjivanbhai Patadia vs. Patel Govindbhai Bhagvanbhai and others<\/a><br \/>\nreported in 2006(4) GLR p.3058  is required to be referred<br \/>\nto in this behalf.\n<\/p>\n<p>5.\tIn<br \/>\nview of the above, there is no substance in the appeal from order and<br \/>\nhence the same requires to be dismissed and is accordingly dismissed.\n<\/p>\n<p>6.\tIn<br \/>\nview of dismissal of appeal from order, no order in civil<br \/>\napplication.\n<\/p>\n<p>(<br \/>\nM.R.
