ANJANA PRAKASH<\/p>\n<p>Anjana Prakash, J:              Heard.\n<\/p>\n<p>                                This is an application for quashing the order dated<\/p>\n<p>                     22.8.2003, passed by the District &amp; Sessions Judge, Buxer, in<\/p>\n<p>                     Cr. Revision No. 174 of 2003 by which he has dismissed the<\/p>\n<p>                     application of the petitioner against the order dated 31.7.2003<\/p>\n<p>                     passed by Judicial Magistrate, 1st Class, Buxar, in Complaint<\/p>\n<p>                     Case No. 221(C) of 2003, Trial No. 1460 of 2003 by which he<\/p>\n<p>                     has taken cognizance under Sections 419, 420, 467, 471, 120B<\/p>\n<p>                     and 34 of the Indian Penal Code in so far as the petitioner is<\/p>\n<p>                     concerned.\n<\/p>\n<p>                                On 18.5.2005, notices were issued to the opposite<\/p>\n<p>                     party no. 2 and further proceeding in the court below was<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>stayed. Thereafter, the opposite party no. 2 appeared through a<\/p>\n<p>validly executed Vakalatnama and is present in Court.<\/p>\n<p>           The case of the Complainant is that one accused<\/p>\n<p>Santosh Kumar Singh prepared certain documents showing<\/p>\n<p>that he was the Complainant&#8217;s son. In some documents,<\/p>\n<p>allegedly the petitioner as a lawyer had identified him as being<\/p>\n<p>the son of Gopal Singh.\n<\/p>\n<p>           The counsel for the petitioner has submitted that he<\/p>\n<p>being an Advocate, on production of certain documents before<\/p>\n<p>him, he had identified the co-accused Santosh Singh as the son<\/p>\n<p>of the Complainant and he did not stand to gain in any manner<\/p>\n<p>even if he did so wrongfully. The further submission is that there<\/p>\n<p>is total absence of any &#8216;mens rea&#8217; attributed to the petitioner in<\/p>\n<p>the identification of the co-accused as the son of the<\/p>\n<p>Complainant and hence, no offence whatsoever is made out<\/p>\n<p>against the petitioner.\n<\/p>\n<p>           On the other hand, the learned counsel for the<\/p>\n<p>opposite party no. 2 contends that the petitioner happened to<\/p>\n<p>be a co-villager of the said co-accused Santosh Singh and he<\/p>\n<p>was hand in glove with him and, therefore, the proceeding<\/p>\n<p>against him may not be quashed.\n<\/p>\n<p>           In my view, the entire Complaint against the<\/p>\n<p>petitioner is totally misplaced since there is total absence of<\/p>\n<p>&#8216;mens rea&#8217; on the part of the petitioner in identifying the co-<\/p>\n<p>accused as son of the Complainant. Moreover, a number of<br \/>\n<span class=\"hidden_text\">                                            3<\/span><\/p>\n<p>                       documents have been filed with the present petition including<\/p>\n<p>                       the service book of the Complainant which shows one Santosh<\/p>\n<p>                       as his son and, therefore, in my view, the Complaint so far the<\/p>\n<p>                       petitioner is concerned, is nothing but an abuse of the process<\/p>\n<p>                       of court.\n<\/p>\n<p>                                   In view of such, this application is allowed and the<\/p>\n<p>                       proceeding, in so far as the petitioner is concerned, in<\/p>\n<p>                       Complaint Case No. 221 (C) of 2003, Trial No. 1460 of 2003, is<\/p>\n<p>                       hereby quashed.\n<\/p>\n<\/p>\n<p>                                                ( Anjana Prakash, J.)<br \/>\nPatna High Court, Patna<br \/>\nDated, the 23rd July, 2010<br \/>\nNAFR\/S.ALI\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court Raj Kumar Singh vs State Of Bihar on 23 July, 2010 Author: Smt.
