The Government Resolution dated 23rd<br \/>\n\tAugust 1973 issued by Education and Labour Department, resolved to<br \/>\n\temploy teachers of Ashram Schools run by voluntary agencies to be<br \/>\n\tappointed and absorbed as primary teachers for District Education<br \/>\n\tCommittee falling under Panchayats. Therefore, such teachers were<br \/>\n\tallowed to have lien in services of respective District Education<br \/>\n\tCommittee. The present petitioner was selected as a primary teacher<br \/>\n\tof District Education Committee and was also given lien of service<br \/>\n\twide order dated 7th December 1979. According to<br \/>\n\tpetitioner, though lien was given in service and he was absorbed in<br \/>\n\tyear of 1979 but respondents are denying pensionary benefit as a<br \/>\n\tprimary teacher of District Education Committee. The benefits of<br \/>\n\tpension are given from date of absorption in service with effect<br \/>\n\tfrom 7th December 1979 in District Education Commission<br \/>\n\tand not from date of appointment in Ashram Schools. In view of fact<br \/>\n\tthat petitioner is entitled pensionary benefit as per G.R. Dated<br \/>\n\t23rd August 1973, 25th January 1974 and order<br \/>\n\tdated  7th December 1979 and Circular dated 16th<br \/>\n\tApril 1998, 6th April, 2002 and 10th April,<br \/>\n\t2002.\n<\/p>\n<p>In<br \/>\n\tview of these factual aspects, denying pensionary benefits to<br \/>\n\tpetitioner by respondents from date of appointment in Ashram<br \/>\n\tSchools, petitioner was absorbed from Ashram Schools to District<br \/>\n\tEducation Committee keeping lien with Ashram Schools while<br \/>\n\ttransferring provident fund amount to District Education Committee<br \/>\n\tin respect to petitioners.\n<\/p>\n<p>In<br \/>\n\tview of these facts, it is open for petitioner to make detailed<br \/>\n\trepresentation about their grievance by sending copy of petition<br \/>\n\twith all annexures to respondents No.1 &#8211; The Chief Secretary,<br \/>\n\tGujarat State, Sachivalaya, Gandhinagar and respondent No.2 &#8211;<br \/>\n\tThe Secretary, Education and Labour Department, Sachivalaya,<br \/>\n\tGandhinagar within a period of two weeks from date of receiving the<br \/>\n\tcopy of the said order. As and when respondents No.1 and 2 receive<br \/>\n\tcopy of petition which have been referred above, same may be treated<br \/>\n\tas representation with all annexures from petitioners then examine<br \/>\n\tgrievance of petitioner in light of this factual background that<br \/>\n\tonce petitioner was appointed in Ashram Schools in year 1968 and<br \/>\n\tremained continue in Ashram Schools. Thereafter, they are absorbed<br \/>\n\tby District Education Committee with continuity and lien and lien is<br \/>\n\talso keeping with the Ashram Schools.\n<\/p>\n<p>Therefore,<br \/>\n\tit is directed to respondents to examine this issue on the basis of<br \/>\n\tvarious Government Resolutions issued by State Government time to<br \/>\n\ttime in respect to such issue and pass appropriate reasoned order<br \/>\n\tafter considering various circulars which are attached to petition<br \/>\n\twithin a period of three months from date of receiving copy of<br \/>\n\tpetition\/representation with all annexures.\n<\/p>\n<p>In<br \/>\n\tview of above observations and direction, present petition is<br \/>\n\tdisposed of without expressing any opinion on merits. However, it is<br \/>\n\tmade clear that if ultimately respondents will pass any adverse<br \/>\n\torder against petitioner, it is open for petitioner to challenge<br \/>\n\tsame before appropriate higher forum in accordance with law.
