No.18718 of 2010\n                                 JAMADAR MANDAL\n                                          Versus\n                                THE STATE OF BIHAR\n                                        -----------\n<\/pre>\n<p>3.   25.6.2010               Heard learned counsel appearing on behalf<\/p>\n<p>                 of the petitioner and learned counsel appearing on<\/p>\n<p>                 behalf of the State.\n<\/p>\n<p>                             The bail application of the petitioner was<\/p>\n<p>                 twice earlier been rejected by this court.<\/p>\n<p>                             Learned counsel for the petitioner with<\/p>\n<p>                 reference     to    the    allegation   of    recovery      of    the<\/p>\n<p>                 incriminating articles at the instance of the petitioner,<\/p>\n<p>                 submits that the seizure list does not contain his<\/p>\n<p>                 signature. He further submits that petitioner for the<\/p>\n<p>                 alleged   offence     has     remained       in   custody        since<\/p>\n<p>                 4.3.2009 and thus his prayer may be reconsidered.<\/p>\n<p>                              Taking         into        consideration             the<\/p>\n<p>                 circumstances, aforesaid let the petitioner, namely<\/p>\n<p>                 Jamadar Mandal            be released on bail on furnishing<\/p>\n<p>                 bail bond of Rs. 10,000\/- (ten thousand) with two<\/p>\n<p>                 sureties of the like amount each to the satisfaction of<\/p>\n<p>                 the   Learned       Sub-Divisional      Judicial     Magistrate,<\/p>\n<p>                 Naugachia,         District-Bhagalpur in connection with<\/p>\n<p>                 Gopalpur (Rangra) P.S. Case No. 82 of 2009 subject to<\/p>\n<p>                 the following conditions:-\n<\/p>\n<p><span class=\"hidden_text\">                                   -2-<\/span><\/p>\n<p>                          (1) That one of the close relative of the<\/p>\n<p>            petitioner would stand as a bailor and who would file<\/p>\n<p>            an affidavit indicating his\/her relationship with the<\/p>\n<p>            petitioner.\n<\/p>\n<p>                          (2) The said bailor would be under a duty<\/p>\n<p>            to inform the Court below in case the petitioner is<\/p>\n<p>            named or gets involved in any other criminal case<\/p>\n<p>            after his release in this case and whereupon the Court<\/p>\n<p>            concerned, shall be at liberty to cancel the bail bond<\/p>\n<p>            of the petitioner on ground of misuse.<\/p>\n<p>                          (3)   The   petitioner   would   ensure   his<\/p>\n<p>            representation before the Court below on each and<\/p>\n<p>            every date fixed and upon failure of the petitioner to<\/p>\n<p>            ensure his representation in the Court below on two<\/p>\n<p>            consecutive dates, without reasonable explanation to<\/p>\n<p>            the satisfaction of the Court below would entitle the<\/p>\n<p>            Court below to initiate proceedings for cancellation of<\/p>\n<p>            his bail bonds and for taking him into custody.<\/p>\n<pre>Anand Kr.
