No.4346 of 2008 (P)\n              ---------------------------------\n             Dated, this the 20th day of January, 2010\n\n                              J U D G M E N T\n<\/pre>\n<p>      The petitioner&#8217;s grievance is against the notification issued by<\/p>\n<p>the respondents under Section 3A of the National Highways Act,<\/p>\n<p>including the land occupied by Muringoor Sree Narasimhamoorthy<\/p>\n<p>Kshetram.      According to the petitioner on publication of the<\/p>\n<p>notification, they filed their objections, and that without considering<\/p>\n<p>the objections and representations, further proceedings are being<\/p>\n<p>continued.\n<\/p>\n<p>      2.    In paragraph 3 of the statement filed by the 1st<\/p>\n<p>respondent, it is stated thus :-\n<\/p>\n<blockquote><p>      &#8220;This stretch of land from km 270 to 332 (Mannuthy-Aluva<br \/>\n      Section) is situated in Thrissur Ernakulam District in the State of<br \/>\n      Kerala.  The land mentioned in Writ Petition is included in the<br \/>\n      proposal of junction improvement at Karukutty Road Junction. The<br \/>\n      exact Sy.No. of this land of the temple is Sy.113\/9 of Muringoor<br \/>\n      Vadakkummuri village which is a National Highway Puramboke.<br \/>\n      National Highway Puramboke does not require 3A notification. So<br \/>\n      the aforesaid Sy.No.was not included in 3A notification. The Land<br \/>\n      where the temple is situated is the property of the National<br \/>\n      Highway as it is a National Highway Puramboke. The petitioner<br \/>\n      had no right over this land which is proposed under acquisition.&#8221;\n<\/p><\/blockquote>\n<p>WP(C) No.4346\/2008<br \/>\n<span class=\"hidden_text\">                                   -2-<\/span><\/p>\n<p>Therefore, according to the respondents, it is a National Highway<\/p>\n<p>Puramboke, which is required for widening of the National Highway.<\/p>\n<p>      3.    The petitioner has not produced any document to show<\/p>\n<p>that they have any legal right or possession, either contractual or<\/p>\n<p>otherwise, on the property in question.           If that be so, being<\/p>\n<p>trespassers, they cannot raise any justifiable objection resisting the<\/p>\n<p>proceedings initiated by the respondents.<\/p>\n<p>      4.    Thus on the merits, I do not find any case for<\/p>\n<p>interference. At this stage, the learned counsel for the petitioner<\/p>\n<p>seeks a reasonable time of one month to shift the structure now<\/p>\n<p>available.\n<\/p>\n<p>      5.
