SIRI JAGAN, J.\n                  ------------------------------\n                  W.P.(C) No.21549 OF 2010\n                  -------------------------------\n             Dated this the 29th day of July, 2010\n\n                       J U D G M E N T\n<\/pre>\n<p>      The petitioners are the students of the first respondent<\/p>\n<p>College.   On disciplinary grounds they were suspended.       It<\/p>\n<p>appears that they had some shortage of attendance for writing<\/p>\n<p>the examination. The petitioners were not permitted to write the<\/p>\n<p>examination on 6.5.2010, although they had written the first<\/p>\n<p>paper on 3.5.2010, on the ground that the University had not<\/p>\n<p>condoned the shortage of attendance.        But according to the<\/p>\n<p>petitioners, they came to understand that the application for<\/p>\n<p>condonation of shortage of attendance was not forwarded by the<\/p>\n<p>Principal. Therefore, the petitioners submitted a representation<\/p>\n<p>to the Vice Chancellor. The next semester classes started from<\/p>\n<p>23.6.2010.    Although the petitioners met the Principal and<\/p>\n<p>submitted a representation for permitting them to attend the<\/p>\n<p>next semester classes, in the light of the pendency of the<\/p>\n<p>application for condonation of shortage of attendance before the<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.21549\/10                     2<\/span><\/p>\n<p>University, the Principal did not permit them to attend the<\/p>\n<p>classes. It is under the above circumstances, they have filed<\/p>\n<p>this writ petition seeking the following reliefs:<\/p>\n<blockquote><p>           &#8220;(I) call for the records leading to the issuance of<br \/>\n           Ext.P1 &#8211; P14 and<br \/>\n           (II) issue a writ of mandamus or any other writ<br \/>\n           order\/direction directing the respondents 1 &amp; 2 to<br \/>\n           send back the condonation application to the<br \/>\n           university without any further delay after taking<br \/>\n           necessary decision for condoning the shortage of<br \/>\n           attendance    as   that   of other   students  whose<br \/>\n           condonation applications were positively considered.<br \/>\n           (III) Direct the respondents 1 to 3 to pass orders on<br \/>\n           the condonation applications of the petitioners which<br \/>\n           were returned by the University to the 1st respondent<br \/>\n           college for clarification by taking appropriate steps<br \/>\n           without any further delay.\n<\/p><\/blockquote>\n<blockquote><p>           (IV) Direct the respondents 2,3 &amp; 5 to permit the<br \/>\n           petitioners provisionally to attend the next semester<br \/>\n           classes which have already started from 23.06.2010<br \/>\n           onwards without any further delay pending disposal of<br \/>\n           the Original Writ Petition&#8221;.<\/p><\/blockquote>\n<p>      2.     The University has taken the stand that the<\/p>\n<p>application for condonation of shortage of attendance received<\/p>\n<p>from the Principal was returned to the Principal, since it was<\/p>\n<p>not in order. A counter affidavit has been filed by the first<\/p>\n<p>respondent, wherein he has taken the stand that the<\/p>\n<p>application for condonation of shortage of attendance has been<\/p>\n<p>forwarded to the Controller of Examinations with all materials<\/p>\n<p>required for considering the same.             According to the first<\/p>\n<p>respondent, all information required for the purpose are<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.21549\/10                3<\/span><\/p>\n<p>contained in Ext.R1(i) dated 1.7.2010 forwarded to the<\/p>\n<p>Controller of Examinations.\n<\/p>\n<p>      3.    I have heard the parties. In so afar as the matter<\/p>\n<p>involves future of some students, despite their alleged<\/p>\n<p>misdoings, I think that all parties should take a lenient attitude<\/p>\n<p>towards them, in so far as the shortage of attendance is very<\/p>\n<p>low as seen from Ext.R1(i).\n<\/p>\n<p>      In the above circumstances, the fifth respondent is<\/p>\n<p>directed to consider the request of the petitioners for<\/p>\n<p>condonation of shortage of attendance on the basis of Ext.R1<\/p>\n<p>(i) considering the sentiments expressed by this court as<\/p>\n<p>above, as expeditiously as possible, at any rate, within a<\/p>\n<p>period of two weeks from the date of receipt of a copy of this<\/p>\n<p>judgment.\n<\/p>\n<p>      The writ petition is disposed of as above.\n<\/p>\n<\/p>\n<p>                                     S.
