No.4578\/2010\n03.08.2010\n\n     Shri A.P.Singh, Advocate for the applicants.\n     Shri   R.N.Yadav,    Panel       Lawyer     for   the\nrespondent\/State.<\/pre>\n<p>     Heard both the parties.\n<\/p>\n<p>     Case diary of Crime No.59\/2010 registered at<br \/>\nPolice Station Tala District Satna for the offence<br \/>\npunishable under Sections 498, 304-B of IPC is<br \/>\nperused.\n<\/p>\n<p>     The applicants are apprehending their arrest<br \/>\nin connection with the aforesaid crime.\n<\/p>\n<p>     Learned counsel for the applicants submits<br \/>\nthat the applicant No.1 is mother-in-law of the<br \/>\ndeceased, whereas applicant No.3 is brother-in-law<br \/>\nof the deceased and applicant No.2 is the wife of<br \/>\napplicant No.3. He further submits that this Court<br \/>\nvide order dated 18\/5\/2010 has granted ad-interim<br \/>\nanticipatory bail to the applicants No.2 and 3 and<br \/>\nthey have not misused the liberty granted to them.<br \/>\nHe   further   submits   that   the    parents    of   the<br \/>\ndeceased have made omnibus allegation against<br \/>\nthe present applicants for demand of dowry,<br \/>\nactually the deceased Maya was suffering from<br \/>\nstomach pain, which was intolerable, therefore,<br \/>\nshe committed suicide. There was no harassment<br \/>\nto the deceased on the basis of dowry demand etc.,<br \/>\ntherefore, they pray for anticipatory bail.\n<\/p>\n<p>      On the other hand learned Panel Lawyer for<br \/>\nthe State opposes the application mainly on the<br \/>\nground that the applicant No.1 is the main accused<br \/>\nof the case. There is direct allegation against her<br \/>\nregarding dowry demand and, therefore, in such<br \/>\ngrave case bail of anticipatory nature cannot be<br \/>\ngiven to the present applicants.\n<\/p>\n<p>     After considering the arguments advanced by<br \/>\nlearned counsel for the parties and looking to the<br \/>\nfacts and circumstances of the case, at present I<br \/>\nam of the view that this is not a fit case for grant<br \/>\nanticipatory bail to the applicant No.1 Sheela<br \/>\nYadav. Accordingly, the application under Section<br \/>\n438, Cr.P.C. of applicant No.1 is hereby dismissed.\n<\/p>\n<p>     So far as case of applicants No.2 and 3 is<br \/>\nconcerned, this Court vide order dated 18\/5\/2010<br \/>\nhas granted ad-interim anticipatory bail to them<br \/>\nand they have not misused the liberty granted to<br \/>\nthem. In such circumstances, there is no ground by<br \/>\nwhich a different view can be taken, hence the<br \/>\norder dated 18\/5\/2010 is hereby confirmed. It shall<br \/>\nbe deemed to be the order passed under Section<br \/>\n438, Cr.P.C. from today.\n<\/p>\n<p>     The applicants No.2 and 3 shall further abide<br \/>\nby the conditions enumerated in sub-Section (2) of<br \/>\nSection 438 of Cr.P.C.\n<\/p>\n<p>     This order shall remain in force for a period of<br \/>\n30 days and in the meanwhile, if the applicants so<br \/>\n           desire, may move an application for regular bail<br \/>\n          before the competent Court.\n<\/p>\n<p>              M.Cr.C. stands disposed of.\n<\/p>\n<p>              C.C. as per rules.\n<\/p>\n<p>                                            (N.K.Gupta)<br \/>\n                                               Judge<\/p>\n<p>Ansari.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Madhya Pradesh High Court Sheela Yadav vs The State Of Madhya Pradesh on 3 August, 2010 M.Cr.C.
