Heard the learned Counsel for the appellant.<\/p>\n<p>The respondents though served are unrepresented.<\/p>\n<p>3. The only question for consideration in this<\/p>\n<p>appeal is as to Whether the liability to pay and rgecovger<\/p>\n<p>could have been directed against the appel1an_t\u00a7Co19tipaiq;g:ig<\/p>\n<p>after having come to the conclusion that_-ti&#8217;1e..iinsuranc::ju <\/p>\n<p>company is not liable to indemnify the:&#8217;ir1*surie&#8217;d ii<\/p>\n<p>present case since the claiman&#8217;t.._Vwas*aipersorii\ufb01whwog was , *<\/p>\n<p>beyond the seating capacity of thewehicle hiriciuestiion. in<\/p>\n<p>this regard, the Tribunalhas of the fact that<\/p>\n<p>the seating capacity\u00bbpifrthegifehicle was 12+ 1. In respect of<\/p>\n<p>the 14 c1aiIr_1srVarising\u00bb&#8211;o:u.t4of the same accident, the<\/p>\n<p>insurarice &#8216;compaiiyg has satisfied 12 claims in View of the<\/p>\n<p>isgeatinggcapacityvof the vehicle. Therefore, in that context,<\/p>\n<p>in respect  claims the Tribunal was of the View<\/p>\n<p> g that  capacity is 12+1, the compensation has to<\/p>\n<p>  be  the insurance company in respect of the other<\/p>\n<p><span class=\"hidden_text\">1<\/span><br \/>\n\u00abi:\n<\/p>\n<p>I&#8217;:\n<\/p>\n<p>claimants. The said aspect in any event is not for<\/p>\n<p>consideration in this appeal.\n<\/p>\n<p>4. By the common judgment in  i<\/p>\n<p>the Tribunal, in any event, has c=;ome_it&#8217;o.v thei&#8217;co.nclu:sioVni&#8217;7<\/p>\n<p>that in respect of the present claim thye&#8211;&#8216;?l..in&#8217;suranc&#8217;e <\/p>\n<p>company would not be liable.\n<\/p>\n<p>the compensation and    interim<br \/>\ncompensation is alreadyy..paid,   has directed<br \/>\nthe  and recover the<br \/>\namount.  th\u00a7eiiiTribunal has taken<br \/>\nnote of the  of National Insurance Co.<\/p>\n<p>Ltd. Vs.
