GOVERNMENT PLEADER for Respondent(s) :\n2, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE AKIL KURESHI\n\t\t\n\t\n\n \n\nDate\n: 16\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tIn Sant Shri<br \/>\nAsharamji Ashram, situated in the outskirts of city of Ahmedabad, an<br \/>\nincident of unnatural and unfortunate death of two young inmates of<br \/>\nthe Ashram school took place, in the month of July, 2008.  The State<br \/>\nGovernment, thereupon, appointed one man Commission of Hon&#8217;ble Mr.<br \/>\nJustice D.K. Trivedi(Retd.), under the Commissions of Inquiry Act,<br \/>\n1952.  Terms of the Commission are as follows:\n<\/p>\n<p>&#8220;The commission to<br \/>\ninquire into (I) the facts and circumstances leading to the death of<br \/>\nsaid two school boys and (ii) the police investigation to solve the<br \/>\ncase of death of two children and adequacy of action taken.&#8221;\n<\/p>\n<p>2.\t\tThis petition has<br \/>\nbeen filed by Sant Shri Asharamji Ashram, challenging an order dated<br \/>\n20.10.2010, passed by the Commission, by which the petitioner&#8217;s<br \/>\napplication Exhibit-2042 came to be disposed of, observing that the<br \/>\ncontentions raised in such application can be considered as<br \/>\naverments, on behalf of the Ashram.  In the application Exhibit-2042,<br \/>\nfollowing prayers were made:\n<\/p>\n<p>&#8220;31.\t\tIn<br \/>\nview of the above mentioned facts, it is humbly submitted that:-\n<\/p>\n<p>a.  The evidence of all<br \/>\nthe above stated witnesses should be considered as false and fake and<br \/>\nhence should be struck off from the record of the Hon&#8217;ble Commission.\n<\/p>\n<p>b.  The facts mentioned<br \/>\nin the points from (a) to (n) in the point no.28 above should be<br \/>\nstudied in depth.\n<\/p>\n<p>c.  Mr.  Praful Vaghela<br \/>\nand Mr. Amrut Prajapati should be summoned to produce the complete<br \/>\ncassette of which only a part of 2 minutes is produced.\n<\/p>\n<p>d.  If Mr. Praful<br \/>\nVaghela and Mr. Amrut Prajapati fail to produce the complete<br \/>\ncassette, then the CD produced earlier should not be considered as<br \/>\ntrue, fair and legal evidence.\n<\/p>\n<p>e.  The summons related<br \/>\nto dead persons should be disposed off unconditionally.\n<\/p>\n<p>f.  The above mentioned<br \/>\nall the witnesses, had left the Ashram long before the unfortunate<br \/>\nincident of Dipesh and Abhishek.  They have also mentioned in their<br \/>\ndepositions, that they do not know anything regarding the incident.<br \/>\nUnder such  circumstances, the case of Dipesh and Abhishek should be<br \/>\ninvestigated in the light of the scientific reports of FSL and post<br \/>\nmortem note, the facts and findings of the Police and CID and the<br \/>\n(fake) evidence of the above mentioned witnesses should not be taken<br \/>\ninto consideration at any juncture.\n<\/p>\n<p>g.  The issue of Black<br \/>\nMagic is fake, fabricated and self-generated by Conspirators and<br \/>\nMedia.  Hence the topic of Black Magic should be dropped from the<br \/>\nscope of inquiry of this Hon&#8217;ble Commission.&#8221;\n<\/p>\n<p>3.\t\tIn the present<br \/>\npetition, in addition to the questioning the legality of the said<br \/>\norder dated 20.10.2010, the petitioner Ashram has also prayed for<br \/>\nfurther direction that the Commission has no power to hold inquiry or<br \/>\nto examine the witnesses or to carry out any investigation into the<br \/>\nsubject of Black Magic or Tantrik Vidhya and further that, all the<br \/>\nwitnesses, who have been examined, their depositions be canceled and<br \/>\nthe Commission be directed not to hold any further inquiry in this<br \/>\ndirection.\n<\/p>\n<p>4.\t\tIn nutshell, it is<br \/>\nthe case of the petitioner that there is no evidence of any Black<br \/>\nMagic having been performed, leading to the death of the two young<br \/>\nboys.  In fact, there is voluminous evidence to the contrary. Such<br \/>\nangle is sought to be involved by certain disgrunted persons to<br \/>\nmalign and defame Sant Asaram.  The angle of Black Magic is not part<br \/>\nof the scope of the Commission&#8217;s inquiry, and therefore, no witness<br \/>\ncould have been examined by the Commission in this regard.<br \/>\nDepositions of the witnesses, already examined, therefore, should be<br \/>\nquashed and the Commission should be prevented from examining the<br \/>\nfurther witnesses, in this regard.\n<\/p>\n<p>5.\t\tIn my opinion, the<br \/>\nCommission has been appointed under the Commissions of Inquiry Act,<br \/>\n1952, and is carrying out a fact finding inquiry.  Its procedure is<br \/>\nlargely left to be judged by the Commission itself.  The power of the<br \/>\nCommission are specified in Section-4 of the Act, which includes the<br \/>\npowers of the Civil Court, for summoning and enforcing the attendance<br \/>\nof any person from any part of India and examining him on oath,<br \/>\nrequiring the discovery and production of any document, receiving<br \/>\nevidence on affidavits, etc..\n<\/p>\n<p>6.\t\tThe Commission has<br \/>\nrecorded evidence of several witnesses. It is in the process of<br \/>\ncollecting further evidence. It is yet to complete the inquiry, to be<br \/>\nable to submit a final report.  At this stage, I do not find that any<br \/>\ninterference is called for. The Commission has kept the entire issue,<br \/>\nraised by the petitioner in his application Exhibit-2042, open.  No<br \/>\nfinal decision is rendered, thereon.  At this interlocutory stage, it<br \/>\nis neither necessary nor appropriate for me to go into the question,<br \/>\nwhether certain aspect or an angle has already been concluded in any<br \/>\nother proceedings or not. It would always be for the Commission to<br \/>\ntake into consideration such issues, at the time of hearing, all the<br \/>\nsides concerned and before submitting its final report.\n<\/p>\n<p>7.\t\tTo enable the<br \/>\nCommission, to inquire into the facts and circumstances leading to<br \/>\nthe death of two school boys and the police investigation to solve<br \/>\nthe case of their death and the adequacy of the action taken, it is<br \/>\nlargely the discretionary powers of the Commission to collect the<br \/>\nevidence, on different issues and aspects.
