Justice K.HEMA\n\n Dated :24\/07\/2008\n\n O R D E R\n                            K.HEMA, J.\n                 --------------------------------------\n                  Bail Application No.4661 of 2008\n                 ---------------------------------------\n                Dated this the 24th day of July, 2008\n\n\n                               O R D E R\n<\/pre>\n<p>      This petition is for bail.\n<\/p>\n<p>      2.   The alleged offence is under Section 55(g) of Abkari<\/p>\n<p>Act. The article involved is 1200 litres of wash. Petitioner is the<\/p>\n<p>first accused in the crime. The incident occurred on 7.2.2004 and<\/p>\n<p>the petitioner surrendered before the Magistrate court on<\/p>\n<p>23.6.2008. He was remanded to judicial custody.<\/p>\n<p>      3.   Learned public prosecutor submitted that charge sheet<\/p>\n<p>has been filed and hence, he has no objection in granting bail to<\/p>\n<p>the petitioner on conditions.      It is also to be noted that the<\/p>\n<p>petitioner is involved in another crime also under the Abkari Act<\/p>\n<p>and though the incident occurred in 2004, he was absconding<\/p>\n<p>until he surrendered before the court after four years.<\/p>\n<p>      Hence, the following order is passed:<\/p>\n<blockquote><p>           Petitioner shall be released on bail on his executing<\/p>\n<p>           bond for Rs.25,000\/- with two solvent sureties each<\/p>\n<p>           for the like sum to the satisfaction of the Magistrate<\/p>\n<p>           Court concerned on the following conditions:<\/p>\n<p><span class=\"hidden_text\">BA No.4661\/08                      2<\/span><\/p>\n<\/blockquote>\n<blockquote><p>             (i) Petitioner shall report before the Investigating<\/p>\n<p>                  Officer on every alternate Saturday between 10<\/p>\n<p>                  a.m. and 1 p.m. until further orders.\n<\/p><\/blockquote>\n<blockquote><p>             (ii) Petitioner shall not commit any offence while on<\/p>\n<p>                  bail and in case of breach of this condition, bail is<\/p>\n<p>                  liable to be cancelled.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<p>    The petition is allowed.\n<\/p>\n<\/p>\n<p>                                                   K.HEMA, JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Vijayakumar vs State Of Kerala Represented By The on 24 July, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 4661 of 2008() 1.
