Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :29\/05\/2009\n\n O R D E R\n            THOTTATHIL B.RADHAKRISHNAN, J.\n                   -------------------------------------------\n                   W.P(C).No.10853 OF 2009\n                  -------------------------------------------\n               Dated this the 29th day of May, 2009\n\n\n                              JUDGMENT\n<\/pre>\n<p>1.The petitioner is an unfortunate landlord, who wanted to re-<\/p>\n<p>  construct a building belonging to him. He obtained an order of<\/p>\n<p>  eviction under Act 2 of 1965. However, when he applied for<\/p>\n<p>  building permit, respondents 1 and 2 refused to issue such<\/p>\n<p>  permit on the premise that unless eviction has been effected,<\/p>\n<p>  permit cannot be issued without the written consent of the<\/p>\n<p>  tenant. I state these facts because this is nothing but the peak<\/p>\n<p>  of administrative absurdity. Such decision having come out at<\/p>\n<p>  the hands of a special grade secretary is intriguing.           The<\/p>\n<p>  issuance of permit to re-construct a building is not made<\/p>\n<p>  dependent on the consent of the occupier either under the<\/p>\n<p>  provisions of the Kerala Municipality Act or under the<\/p>\n<p>  Panchayat Raj Act or under the Kerala Municipal Building<\/p>\n<p>  Rules or any other law for the time being in force. No such<\/p>\n<p>  provision is pointed out on behalf of respondents 1 and 2. The<\/p>\n<p>  stand of respondents 1 and 2 therefore fails.<\/p>\n<p>WPC.10853\/09<\/p>\n<p>                             Page numbers<\/p>\n<p>2.A counter affidavit is filed by respondents 1 and 2 that they<\/p>\n<p>  were under the &#8220;bonafide&#8221; belief that consent of the tenant is<\/p>\n<p>  necessary for permit to re-construct a building.       The word<\/p>\n<p>  &#8220;bonafide&#8221; denotes something coupled with rationality.<\/p>\n<p>  Perverse and irrational thinking can never be placed under the<\/p>\n<p>  carpet of bonafides. I am satisfied that the impugned action<\/p>\n<p>  results in manifest miscarriage of justice.<\/p>\n<p>3.In the result, the writ petition is allowed directing that the<\/p>\n<p>  building permit applied for by the petitioner shall be issued<\/p>\n<p>  within a fortnight from now, without insisting for any consent<\/p>\n<p>  letter of the tenant, if the application is otherwise in order. I<\/p>\n<p>  am inclined to impose an order of exemplary costs in favour of<\/p>\n<p>  the petitioner.
