(J)\n\nCITATION:\n JT 1996 (6)   621\t  1996 SCALE  (5)382\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     Counsel for parties are heard.\n<\/p>\n<p>     The  respondents\tin  these   four  appeals   are\t the<br \/>\nGovernment employees.  All the\tfour were  convicted by\t the<br \/>\nJudicial Magistrate, Erode for various criminal offences and<br \/>\nsentenced to  undergo various sentences. The said conviction<br \/>\nand sentences  were affirmed by the Sessions Judge \/ Special<br \/>\nJudge, Erode. The respondents then approached the High Court<br \/>\nin Criminal  Revision accompanied  with an application under<br \/>\nSection 389(1) Cr.P.C. for suspension of convictions as well<br \/>\nas the sentences. The High Court after considering the ambit<br \/>\nand scope  of the  provisions contained\t in Sections 374 and<br \/>\n880(1) of  the Code  of Criminal  Procedure and the relevant<br \/>\nprovisions of  Law and relying on the decision of this Court<br \/>\nrendered in <a href=\"\/doc\/1398571\/\">Rama Narang v. Ramesh Narang and others<\/a> [ (1995)<br \/>\n2 S.C.C.  513 ],  took the  view that  for the reasons to be<br \/>\nrecorded in  writing by\t the appellate Court, the conviction<br \/>\nor order of sentence can be suspended during the pendency of<br \/>\nthe same.  The High  Court also took the view that the power<br \/>\nof the\tappellate Court\t or the\t High Court  to suspend\t the<br \/>\nconviction  or\tsentence  is  always  inherent\tand  can  be<br \/>\nexercised at  any stage,  subject to  the condition that the<br \/>\nappellate Court should be approached and satisfied with the<br \/>\nreasonings to be recorded in writing and further, if any one<br \/>\nwants to  stop the proceedings which have been initiated for<br \/>\ndisqualification or  removal from  service or  reduction  in<br \/>\nrank in respect of a public servant one has to look into the<br \/>\nmoral conduct  very much  involved in  such a  case and only<br \/>\nwhen the  Court is  satisfied with  such conduct,  then\t the<br \/>\nremedy provided\t under different  statute cannot  at all  be<br \/>\nstopped.  After\t  taking   the\t aforesaid   view   and\t  on<br \/>\nconsideration of  the fact  that the  respondents will loose<br \/>\nthe  meagre  stipend,  if  the\tprayer\tfor  suspending\t the<br \/>\nconviction during  the pendency\t of  the  revisions  is\t not<br \/>\ngranted,  passed   the\timpugned   orders   suspending\t the<br \/>\nconviction  as\t well  as   the\t sentences  awarded  to\t the<br \/>\nrespondents. It\t is against  these orders that the State has<br \/>\nfiled these  appeals. The  submission of the learned counsel<br \/>\nappearing for  the State  is that  the High Court has passed<br \/>\nthe impugned orders relying on the decision in Rama Narang&#8217;s<br \/>\ncase (supra)  wherein this  Court  took\t the  view  that  in<br \/>\nappropriate  oases  the\t conviction  and  sentences  can  be<br \/>\nsuspended in  exercise of  powers under. Section 482 Cr.P.C,<br \/>\nAfter going  through the  decision referred to above and the<br \/>\nfacts of  the present  case we find that the decision relied<br \/>\nupon has no application to the facts of the cases before us.<br \/>\nIn Rama\t Narang&#8217;s case\t(supra) the conviction and sentences<br \/>\nboth were  suspended on the reasoning that if the conviction<br \/>\nand sentences  are not\tsuspended the damage would be caused<br \/>\nwhich could  not be undone if ultimately the revision of the<br \/>\nappellants of  that case  was allowed.\tBut in\tthe  present<br \/>\ncase, we  find that in the event the revisions against their<br \/>\nconviction and\tsentences are  allowed by the High Court the<br \/>\ndamage, if  any, caused\t to the\t respondents with  regard to<br \/>\npayment of stipend etc. can well be revived and made good to<br \/>\nthe respondents.  If such  trifling matters  are taken\tinto<br \/>\nconsideration, we  think, then every conviction will have to<br \/>\nbe  suspended  pending\tappeal\tor  revision  involving\t the<br \/>\nslightest disadvantage to a convict. That being so the facts<br \/>\nof the decision relied on have no application to the present<br \/>\ncase. This  apart, the High Court though made an observation<br \/>\nbut did\t not consider  at  all\tthe  moral  conduct  of\t the<br \/>\nrespondents inasmuch  as respondent  Jaganathan who  was the<br \/>\nPolice Inspector  attached to  Erode Police Station has been<br \/>\nconvicted under\t Sections 392,\t218 and\t 466 IPC,  while the<br \/>\nother respondents  who are  also public\t servants have\tbeen<br \/>\nconvicted under\t the provision\tof Prevention  of Corruption<br \/>\nAct. In\t such a\t case the discretionary power to suspend the<br \/>\nconviction either under Sections 389(1) or under Section 482<br \/>\nCr.P.C. should\tnot have been exercised. The orders impugned<br \/>\nthus cannot be sustained.\n<\/p>\n<p>     For the  reasons stated  above the\t impugned orders are<br \/>\nset aside  to the  extent of  suspension of  conviction. The<br \/>\norder with  regard to  the suspension of sentences, however,<br \/>\nis maintained.
