SANKARAN,J.\n                            --------------------------------------\n                            W.P.(C) No.26431 of 2008 V\n                            --------------------------------------\n                   Dated this the 2nd day of September, 2008.\n\n                                   J U D G M E N T\n<\/pre>\n<p>                  The petitioner was appointed as Full Time Urdu Teacher in<\/p>\n<p>Parassinikadavu U.P. School from 1.6.2007 against the retirement vacancy of<\/p>\n<p>Shri E.Ramunnikutty. It is stated that the appointment was approved as Part<\/p>\n<p>Time Urdu Teacher. It is stated that as per the staff fixation from 15.7.1981<\/p>\n<p>onwards, a Full Time Urdu Teacher post was granted by diverting three periods<\/p>\n<p>from Group &#8216;C&#8217; subjects and that the same position was continuing. It is stated<\/p>\n<p>that all of a sudden, without notice, the Full Time Post was converted as Part<\/p>\n<p>Time   pointing out G.O.(Ms.) No.62\/73\/G.Edn. dated 2.5.1973, ignoring         the<\/p>\n<p>previous staff fixation orders. The contention of the petitioner is that G.O.(Ms.)<\/p>\n<p>No.62\/73\/G.Edn. dated 2.5.1973 is not at all applicable in the case of Urdu<\/p>\n<p>Teacher and that G.O.(Ms.) No.129\/78\/G.Edn. dated 19.9.1978 would apply.<\/p>\n<p>The petitioner also relies on Ext.P3 Government Order dated 13.11.2000<\/p>\n<p>wherein it is stated thus &#8211;\n<\/p>\n<\/p>\n<blockquote><p>                                         &#8220;3.          In the letter read as<\/p>\n<p>                     seventh paper above the Director of Public<\/p>\n<p>                     Instruction   has      reported      that    there are<\/p>\n<p>                     instances where the Educational Officer mis-<\/p><\/blockquote>\n<p>                     interpret the relevant Government Orders and<\/p>\n<p>WP(C) No.26431\/2008<\/p>\n<p><span class=\"hidden_text\">                                            2<\/span><\/p>\n<p>                    mention the posts sanctioned by virtue of<\/p>\n<p>                    group &#8220;C&#8221; diversion; and the posts held by the<\/p>\n<p>                    beneficiaries of orders read as fifth paper<\/p>\n<p>                    above as protected. Hence he has sought for<\/p>\n<p>                    clarification in this regard.\n<\/p>\n<\/p>\n<p>                                        4. Government            have<\/p>\n<p>                    examined the matter in detail and are pleased<\/p>\n<p>                    to clarify that the posts created by virtue of<\/p>\n<p>                    Group &#8216;C&#8217; diversion cannot be treated as<\/p>\n<p>                    protected and that such full time posts cannot<\/p>\n<p>                    be converted into part time posts.\n<\/p>\n<\/p>\n<p>                                        5. If any Educational Officer<\/p>\n<p>                    has already proceeded with the staff fixation<\/p>\n<p>                    and issued irregular orders as mentioned<\/p>\n<p>                    above, he shall review such orders in<\/p>\n<p>                    accordance with this clarificatory Government<\/p>\n<p>                    Order.&#8221;\n<\/p>\n<\/p>\n<p>                  2.        The petitioner states that as per Ext.P4 order, the<\/p>\n<p>Deputy Director of Education, Kannur, rejected the contentions put forward by<\/p>\n<p>the petitioner and that the Director of Public Instruction also has not accepted the<\/p>\n<p>petitioner&#8217;s contentions.   The petitioner has submitted Ext.P8 revision dated<\/p>\n<p>18.7.2008 before the Government challenging the order passed by the Director<\/p>\n<p>of Public Instruction. Ext.P8 revision is pending disposal.<\/p>\n<p>WP(C) No.26431\/2008<\/p>\n<p><span class=\"hidden_text\">                                        3<\/span><\/p>\n<p>                   3.     The reliefs prayed for    in the Writ Petition are the<\/p>\n<p>following:-\n<\/p>\n<\/p>\n<p>                                   &#8220;(a)       call for the records<\/p>\n<p>                  relating to Exhibit P-4 and quash the original of<\/p>\n<p>                  the same by the issue of a writ of certiorari or<\/p>\n<p>                  other appropriate writ or order.\n<\/p>\n<\/p>\n<pre>                                   (b)        declare   that     the\n\n                  Petitioner is entitled to    have approval and\n\n<\/pre>\n<p>                  service benefits as Full-time teacher in the light<\/p>\n<p>                  of Exhibits P-3, P-5, P-6 and P7.\n<\/p>\n<\/p>\n<p>                                   )          issue   a   writ    of<\/p>\n<p>                  mandamus or other appropriate writ order or<\/p>\n<p>                  direction commanding the 1st Respondent to<\/p>\n<p>                  effectively consider and pass appropriate orders<\/p>\n<p>                  upon Exhibit P-8 after affording an opportunity<\/p>\n<p>                  of being heard to the Petitioner within a time<\/p>\n<p>                  limit.\n<\/p>\n<\/p>\n<p>                                   (d)        pass    such    other<\/p>\n<p>                  order or direction which this Hon&#8217;ble Court may<\/p>\n<p>                  deem     fit and    proper    to  grant  in   the<\/p>\n<p>                  circumstances of the case.&#8221;\n<\/p>\n<p>WP(C) No.26431\/2008<\/p>\n<p><span class=\"hidden_text\">                                            4<\/span><\/p>\n<p>                    4.         Since Ext.P8 revision is pending disposal, the learned<\/p>\n<p>counsel for the petitioner submits that for the present, the petitioner would be<\/p>\n<p>satisfied if relief No.&#8217;c&#8217; is granted leaving open the right of the petitioner to pray<\/p>\n<p>for other reliefs at the appropriate stage, if found necessary.<\/p>\n<p>                        In the facts and circumstances of the case, the Writ Petition<\/p>\n<p>is disposed of as follows:-\n<\/p>\n<\/p>\n<p>                    (i)        The first respondent shall dispose of Ext.P8 revision<\/p>\n<p>dated 18.7.2008 as expeditiously as possible and at any rate within a period of<\/p>\n<p>three months, after affording an opportunity of being heard to the petitioner and<\/p>\n<p>the Manager of the school (fifth respondent).<\/p>\n<p>                    (ii)       The petitioner shall produce a copy of the Writ Petition<\/p>\n<p>and a certified copy of the judgment before the first respondent.<\/p>\n<p>                    (iii)      The petitioner shall send a copy of the judgment by<\/p>\n<p>registered post to the fifth respondent and shall produce proof of the same<\/p>\n<p>before the first respondent.\n<\/p>\n<\/p>\n<p>                                                         K.T.
