healthy and was a bread earner in the family. On 06\/ 12\/2003 at
\nabout 6.30 am. when the deceased and one Mukthiyar Aharnmad<\/p>\n
Mestri were coming from Haveri to Hosaritti on a rnotor\u00e9cycle<\/p>\n
bearing No. KA~27\/J–3068, the deceased was a pi11ior1–<\/p>\n
when they came near Gandhipur i.e., Akkasar   <\/p>\n
Ornni coming from opposite direction    spee_c1; uanid<\/p>\n
negligent manner dashed against the motor ..cycle,:V.’as: a iresulltl of;<\/p>\n
which the deceased fell down from’le\u00abc.the motoifcycle  halla, on<\/p>\n
account of the grievous injuries sustainedyliim\ufb02\u00e9the head and other
\nparts of the body, he succumbed ltolthe on the spot. On<\/p>\n
account of the deathqof  dec:eased~vlithe “respondent claimants<\/p>\n
\ufb01led a claim”  of Motor Vehicles Act
\nclaiming cornpen_sation’o;f . 1\u00a7\u00e9s;..:ji6,2<3,o0o\/ ~. The said claim petition<\/p>\n
had come up for "co_nVsidc_ra'tion before the Tribunal and the<\/p>\n

evlidence =a_n'd other ~-material on \ufb01le allowed the same in part<\/p>\n

llqyinterest  65fo…per annum from the date of petition till the date of<\/p>\n
=.realisation,& The said quantum of compensation awarded by the<\/p>\n
lV~._Tri1'bur;all  disproportionate, excessive and liable to be reduced.<\/p>\n

Further it is a speci\ufb01c case of appellant that the Maruti Omni car<\/p>\n
was not involved in the accident. The question of fixing theliability<\/p>\n
against the appellantvinsurer is not justifiable and  ti.,j__ib~e<\/p>\n
set aside and they felt necessitated to present this.Vappeal:.C"  T<\/p>\n
3. The principal submission  thie’vv’lveiarr;ed<\/p>\n
counsel for appellant that, the driver ofithe’ <\/p>\n
acquitted in a criminal case and the__li’Fribunal. has committed a
\ngrave error in holding that i”C)mni~–lwas involved in the
\naccident due to the rash and negligenitbthe driver of said<\/p>\n
vehicle. The accicleiitrp:ioccurre;dvandv  died on the spot<\/p>\n
cannot be  when the motor vehicle
\nis not involve.d.ii  that the Tribunal has not
\njustified forftxing..th’e  liability on the alleged vehicle involved in\n<\/p>\n
–.l?:vithoutiiifixirirratleast contributory negligence on the<\/p>\n
par,t’ofithe_ride’r of  motor cycle also. Further he submitted that<\/p>\n
 quantum’ compensation awarded by the Tribunal is on<\/p>\n
Vlgghigher side. andhiit requires reduction by modifying the impugned<\/p>\n
,j  award passed by the Tribunal.\n<\/p>\n

6. Further the Tribunal has rightly taken the income of
\ndeceased at the rate of Rs.3,000\/– per month. He is aged about 30
\nyears and by profession he is a mason and deducted 1\/ 3*$3′”of the<\/p>\n
amount towards personal expenses and applied the<\/p>\n
multipiier and awarded a reasonable compensationtiunderpiloss. <\/p>\n
