NO. 1213 OF 2009\n              = = = = = = = = = = = = = = =\n         Dated this the 8th day of October, 2009.\n\n                      J U D G M E N T\n<\/pre>\n<p>       This appeal is preferred by the insurance company<\/p>\n<p>against the award passed by the Motor Accidents Claims<\/p>\n<p>Tribunal, Ottapalam in O.P.(MV)738\/06.           The claimant<\/p>\n<p>sustained injuries in a road accident while he was riding as a<\/p>\n<p>pillion rider. The question that is posed for consideration is<\/p>\n<p>whether Ext.P1 also covers the risk of a pillion rider.<\/p>\n<p>Learned Tribunal held that since an additional premium of<\/p>\n<p>Rs.70 is collected for the personal accident coverage of two<\/p>\n<p>number of persons it covers the pillion rider and therefore<\/p>\n<p>the insurance company cannot be exonerated from the<\/p>\n<p>liability. Personal accident coverage policy is issued and it is<\/p>\n<p>based on the happenings of certain contingencies.         P.A.<\/p>\n<p>coverage is generally extended and is covered by schedules<\/p>\n<p>which would show that either death would have occurred or<\/p>\n<p>there would have been loss of two limbs or of loss of one<\/p>\n<p>limb or loss of sight of one eye or a permanent total<\/p>\n<p>M.A.C.A. 1213 OF 2009<br \/>\n<span class=\"hidden_text\">                                -:2:-<\/span><\/p>\n<p>disablement.    Suppose a person travels as a pillion rider<\/p>\n<p>sustains any of these things then the P.A. coverage extended<\/p>\n<p>by the policy for two persons will be applicable to them. In<\/p>\n<p>this case there is no such injury sustained by the claimant<\/p>\n<p>and therefore he cannot be covered under the P.A. coverage<\/p>\n<p>as ordered by the Tribunal.        Therefore the said finding<\/p>\n<p>requires to be vacated.\n<\/p>\n<p>     2.    But at the same time another question may loom<\/p>\n<p>large for consideration as it is a package policy. This Court<\/p>\n<p>has come across package policies and comprehensive policies<\/p>\n<p>wherein S.II(i) condition is there which states that the risk of<\/p>\n<p>a person who travels in a motor vehicle of the insured other<\/p>\n<p>than for hire or reward is covered by the conditions of the<\/p>\n<p>policy. This question also was considered when there is an<\/p>\n<p>additional rider &#8216;except so far as it is necessary to satisfy the<\/p>\n<p>requirements of the Motor Vehicles Act&#8217;.            Both these<\/p>\n<p>instances were considered by two Division Benches in the<\/p>\n<p>decision reported in <a href=\"\/doc\/135962\/\">New India Assurance Co. Ltd. v.<\/p>\n<p>Hydrose<\/a> (2008 (3) KLT 778) and <a href=\"\/doc\/1457758\/\">Mathew v. Shaji<\/p>\n<p>Mathew<\/a> (2009 (3) KLT 813). If those conditions are there<\/p>\n<p>these decisions pin point regarding the liability of the<\/p>\n<p>M.A.C.A. 1213 OF 2009<br \/>\n<span class=\"hidden_text\">                                -:3:-<\/span><\/p>\n<p>insurance company but I am informed by the learned counsel<\/p>\n<p>for the insurance company that the matter is pending<\/p>\n<p>consideration before a larger Bench of the Supreme Court.<\/p>\n<p>Whatever it may be, now the question to be considered is<\/p>\n<p>whether there are such conditions or not and what will be the<\/p>\n<p>impact of such condition on the date of deciding the case<\/p>\n<p>with the available decisions on the point.      Therefore the<\/p>\n<p>finding regarding the interse liability is set aside and he<\/p>\n<p>matter   is  remitted   back   to    the  Tribunal  for  fresh<\/p>\n<p>consideration whether the insurance company is liable. For<\/p>\n<p>the said purpose the insurance company as well as other<\/p>\n<p>parties are permitted to raise all contentions which they want<\/p>\n<p>to raise and produce all documents and evidence which they<\/p>\n<p>choose and the matter be decided in accordance with law.<\/p>\n<p>Parties are directed to appear before the Tribunal on<\/p>\n<p>20.11.2009.\n<\/p>\n<\/p>\n<p>                           M.N.
