Nos.298 &amp; 615 of 2008\n        - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n       Dated this the 3rd day of DECEMBER, 2009\n\n                               O R D E R\n<\/pre>\n<p>Raman, J<\/p>\n<p>     1. Both these revisions arise from the same judgment<\/p>\n<p>and decree passed by Wakf Tribunal, Ernakulam in<\/p>\n<p>W.O.S.12\/2002. While C.R.P 298\/2008 has been filed by the<\/p>\n<p>defendants, C.R.P.615 is filed by the plaintiffs. The suit is<\/p>\n<p>filed seeking declaration, consequential injunction and<\/p>\n<p>fixation of boundary and other reliefs.<\/p>\n<p>     2.    The suit was originally filed before the Munsiff<\/p>\n<p>Court, Chittoor as O.S.No.283\/1995 and subsequently, the<\/p>\n<p>plaint, was transferred to the Wakf Tribunal and numbered<\/p>\n<p>as W.O.S.12\/2002. Parties went for trial and ultimately a<\/p>\n<p>decree was passed. The suit was decreed partly.<\/p>\n<p>     3.      Since the suit is instituted prior to the<\/p>\n<p>commencement of Wakf Act 1995, the question that arises<\/p>\n<p>C.R.P Nos. 298 &amp; 615 of 2007<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>for consideration is whether Wakf Tribunal has jurisdiction<\/p>\n<p>over a pending matter instituted before the Civil Court prior<\/p>\n<p>to the commencement of the Act. A Division Bench of this<\/p>\n<p>Court in Muhammed Sahib v. Mohammed Ibrahim2007<\/p>\n<p>(2) KLT 56 after noticing the Judgment of earlier Division<\/p>\n<p>Bench of this Court in Pukoya Haji Vs. Cheriya Haji<\/p>\n<p>2003 KLT 32, held that Pukoya Haji&#8217;s case considered only<\/p>\n<p>the question regarding maintainability of the suit filed<\/p>\n<p>before the Civil Court, after the introduction of Section 85<\/p>\n<p>of the Act, but with respect to the pending suits, it was held<\/p>\n<p>that the Civil court will continue to have jurisdiction. In the<\/p>\n<p>light of the above decision of the Division Bench of this<\/p>\n<p>court, it has to be held that the Tribunal has no jurisdiction<\/p>\n<p>in pending matters. The present suit was instituted before<\/p>\n<p>Munsiff court prior to the commencement of Wakf Act 1995.<\/p>\n<p>     4. Accordingly, the judgment and decree passed by<\/p>\n<p>the Wakf Tribunal is set aside and we direct the Wakf<\/p>\n<p>Tribunal to transfer all records to the Munsiff court,<\/p>\n<p>C.R.P Nos. 298 &amp; 615 of 2007<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>Chittoor, whereupon the Munsiff court shall dispose of the<\/p>\n<p>same as expeditiously as possible within a period of six<\/p>\n<p>months.
