Justice ANTONY DOMINIC\n\n Dated :19\/12\/2008\n\n O R D E R\n                 ANTONY DOMINIC,J.\n            -----------------------\n                W.P.(C).No.37606\/ 2008\n           ------------------------\n       Dated this the 19th day of December, 2008.\n\n                       JUDGMENT\n<\/pre>\n<p>        Petitioner states that he was granted leave<\/p>\n<p>without allowance based on his application, for the period<\/p>\n<p>from 1.10.2001 to 30.3.2002 subject to the condition<\/p>\n<p>that the period will not be reckoned for service benefits<\/p>\n<p>including increments. According to the petitioner the said<\/p>\n<p>clause is in conflict with the rules contained in the KSR<\/p>\n<p>and the judgment of this court reported in 2007(1) KLT<\/p>\n<p>71.<\/p>\n<p>        2. Highlighting these grievance and seeking the<\/p>\n<p>deletion of the condition referred to above,    Petitioner<\/p>\n<p>states that he has filed Exts.P1 and P2 before the first<\/p>\n<p>respondent and the complaint now raised is that orders<\/p>\n<p>have not been passed on the representations so made.<\/p>\n<p>       3. If as stated by the petitioner, he has filed<\/p>\n<p>Exts.P1 and P2 objecting to the conditions incorporated in<\/p>\n<p>the   order   granting   leave  without   allowance,   the<\/p>\n<p><span class=\"hidden_text\">                           2<\/span><\/p>\n<p>respondent shall consider the same.<\/p>\n<p>     Therefore, I dispose of this writ petition directing<\/p>\n<p>that the respondent shall consider and pass orders on<\/p>\n<p>Exts.P1 and P2.
