Justice K.HEMA\n\n Dated :28\/01\/2009\n\n O R D E R\n                           K.HEMA, J.\n\n               -----------------------------------------\n                       B.A.No. 7546 of 2008\n               -----------------------------------------\n\n             Dated this the 28th January, 2009\n\n                            O R D E R\n<\/pre>\n<p>      This petition is for anticipatory bail.\n<\/p>\n<p>      2. The alleged offences are under Sections 342, 326, 308<\/p>\n<p>read with 34 of the Indian Penal Code. According to<\/p>\n<p>prosecution, petitioners (accused 1 and 2), in furtherance of<\/p>\n<p>common intention, assaulted de facto complainant and another<\/p>\n<p>and inflicted injuries, including fracture.<\/p>\n<p>      3. Learned counsel for petitioners submitted that first<\/p>\n<p>petitioner has three sons and a daughter and he is aged 66<\/p>\n<p>years. Second petitioner is the son. First petitioner intended to<\/p>\n<p>convey certain properties to second petitioner, which was<\/p>\n<p>objected to by his wife and two other sons. There was a fight<\/p>\n<p>on this issue for a considerably long period and petitioners<\/p>\n<p>were harassed by them. On the date of occurrence, first<\/p>\n<p>petitioner was present in a shed in the coconut garden while<\/p>\n<p>his son along with goondas came to the place and tried to<\/p>\n<p>attack first petitioner. In exercise of self defence, he waved<\/p>\n<p>iron crowbar and escaped from the scene. He was also<\/p>\n<p><span class=\"hidden_text\">  BA.7546\/08                     2<\/span><\/p>\n<p>assaulted by the persons, who came there and a complaint was<\/p>\n<p>lodged by him.\n<\/p>\n<p>      4. This petition is opposed. Learned Public Prosecutor<\/p>\n<p>submitted that de facto complainant and another have<\/p>\n<p>sustained serious injuries, including fracture and scull exposed<\/p>\n<p>lacerated wound by the use of iron rod and they were also<\/p>\n<p>admitted in the hospital. Those persons are not even related to<\/p>\n<p>petitioners. The weapon is not recovered. A counter case is<\/p>\n<p>registered under Sections 324, 323 and 506 Part-I of the<\/p>\n<p>Indian Penal Code. Petitioners have protested against the<\/p>\n<p>persons, who had come to pluck the coconut trees from the<\/p>\n<p>property and hence, the incident occurred.<\/p>\n<p>      5. On hearing both sides and on going through the case<\/p>\n<p>diary, I find that the injured sustained considerable injuries<\/p>\n<p>with an iron rod. The doctor also noted iron rod marks, but<\/p>\n<p>admittedly, petitioner did not sustain any serious injury,<\/p>\n<p>though he is allegedly assaulted by the injured in this case.<\/p>\n<p>Learned counsel for petitioners submitted that the doctor<\/p>\n<p>manipulated the records at the instance of first petitioner&#8217;s<\/p>\n<p>son, who is closely acquainted with him. However, at this<\/p>\n<p>stage, it may not be possible for me to make any such<\/p>\n<p><span class=\"hidden_text\">  BA.7546\/08                      3<\/span><\/p>\n<p>conclusions especially in an application for anticipatory bail.<\/p>\n<p>Considering the nature of allegations made and the nature of<\/p>\n<p>investigation required, I do not think that it is a fit case to<\/p>\n<p>grant anticipatory bail.\n<\/p>\n<p>     6.    However,    if  petitioners   surrender  before  the<\/p>\n<p>Magistrate Court concerned and file application under Section<\/p>\n<p>437 Cr.P.C, they will be at liberty to raise all these<\/p>\n<p>contentions, in which event, the learned Magistrate shall<\/p>\n<p>consider the same and dispose of the petition on merit,<\/p>\n<p>untrammelled by any of the observations made by this Court in<\/p>\n<p>this order. It is made clear that rejection of anticipatory bail<\/p>\n<p>application may not by itself be a ground to reject application<\/p>\n<p>for bail under Section 437 Cr.P.C.\n<\/p>\n<p>                Petitioners are directed to surrender<\/p>\n<p>           before the investigating officer and co-operate<\/p>\n<p>           with the investigation.
