SIRI JAGAN, J.\n                   ------------------------------\n                  W.P.(C) No.35263 OF 2009\n                  -------------------------------\n              Dated this the 3rd day of JUNE, 2010\n\n\n                        J U D G M E N T\n<\/pre>\n<p>      The petitioner claims to be the owner of certain lands in<\/p>\n<p>Manarkad Village in Manarkad Panchayat. The petitioner has filed<\/p>\n<p>Ext.P3 application for mutation. The petitioner complains that<\/p>\n<p>the same is not being considered and orders passed.<\/p>\n<p>      2.   I have heard the learned counsel appearing for the<\/p>\n<p>additional third respondent and the learned Government Pleader<\/p>\n<p>also. The additional third respondent opposes the petitioner&#8217;s<\/p>\n<p>prayers. According to them, the additional third respondent bank<\/p>\n<p>has a charge over the property and therefore, mutation cannot<\/p>\n<p>be allowed.\n<\/p>\n<p>      3.   I am not going into the disputed questions, in so far as<\/p>\n<p>Ext.P3 is pending before the appropriate authority. It is for that<\/p>\n<p>authority to consider the matter in the first instance. The learned<\/p>\n<p>Government Pleader submits that Ext.P3 has to be considered by<\/p>\n<p>the Tahsildar, Kottayam Taluk and not the first respondent<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.35263\/09                 2<\/span><\/p>\n<p>Village Officer as claimed by the petitioner. After hearing both<\/p>\n<p>sides, I dispose of this writ petition with the following terms.<\/p>\n<p>      The first respondent shall place Ext.P3, if it is pending<\/p>\n<p>before him, before the Tahsildar, Kottayam Taluk.             The<\/p>\n<p>Tahsildar, Kottayam Taluk shall pass appropriate orders on<\/p>\n<p>Ext.P3 as expeditiously as possible, at any rate, within a period<\/p>\n<p>of one month from the date of receipt of a copy of this<\/p>\n<p>judgment, after affording an opportunity of being heard to the<\/p>\n<p>petitioner as well as the additional third respondent.<\/p>\n<p>                                      S.
