SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 02\/09\/2008 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India,<br \/>\nthe petitioners   original plaintiffs have prayed for appropriate<br \/>\nwrit, order and\/or directions, quashing and setting aside the order<br \/>\ndated 01.02.2008 passed by learned 6th Senior Civil Judge,<br \/>\nPatan on application below Ex.33 as well as order dated 18.03.2008<br \/>\npassed by learned 4th Senior Civil Judge, Patan on<br \/>\napplication below Ex.35 in Regular Civil Suit No.10 of 2003, by which<br \/>\nlearned trial Court has rejected both the application submitted by<br \/>\npetitioners-original plaintiffs to reopen the right to lead evidence.\n<\/p>\n<p>2.\tHaving<br \/>\nheard Shri M.K.Patel, appearing on behalf of petitioners as well as<br \/>\nMr.Pranav M.Raval for Shri Bharat Jani, for respondents considering<br \/>\nimpugned orders and the time gap between the closing of the right to<br \/>\nlead evidence by the plaintiffs and the applications submitted by the<br \/>\npetitioners   original plaintiffs to reopen their right to lead<br \/>\nevidence, the impugned order passed by the learned trial Court<br \/>\ndeserves to be quashed and set aside and an opportunity should be<br \/>\ngiven to the petitioners to lead the evidence.\n<\/p>\n<p>3.\tUnder<br \/>\nthe circumstances and for the reasons stated above, the petition<br \/>\nsucceeds. The order dated 01.02.2008, passed by learned 6th<br \/>\nSenior Civil Judge, Patan on application below Ex.33 as well as order<br \/>\ndated 18.03.2008 passed by learned 4th Senior Civil Judge,<br \/>\nPatan on application below Ex.35 in Regular Civil Suit No.10 of 2003<br \/>\nare hereby quashed and set aside and it is ordered to reopen the<br \/>\nright of the plaintiffs to lead the further evidence.\n<\/p>\n<p>\tRule<br \/>\nis made absolute.
