The quarter in question was<\/p>\n<p>                   allotted to him in regular course by order dated<\/p>\n<p>                   20.3.2009. The allotment order does not state that it<\/p>\n<p>                   was an ad-hoc appointment. The impugned order,<\/p>\n<p>                   therefore, cannot subsequently re-designate the nature<\/p>\n<p>                   of     the    allotment.   The        petitioner        is     due    for<\/p>\n<p>                   superannuation on 31.1.2012. The petitioner is a<\/p>\n<p>                   member of the Bihar Administrative Service and is also<\/p>\n<p>                   entitled to the allotment of &#8216;D&#8217; category Quarter.<\/p>\n<p>                                 The impugned order describes the allotment<\/p>\n<p>                   as ad-hoc. The allotment order dated 20.3.2009 does<\/p>\n<p>                   not say so. The petitioner is being asked to vacate, so<\/p>\n<p>                   that    the    Quarter     may    be      allotted       to     another<\/p>\n<p>                   Government servant, who is residing in a rented<\/p>\n<p>                   accommodations.\n<\/p>\n<p>                                 The   petitioner   is     stated     to        have    been<\/p>\n<p>                   represented on 5.8.2010. Permission is granted to<\/p>\n<p>                   supplement the representation, if so advised.<\/p>\n<p>                                 Let the petitioner represents before the<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>       District Magistrate, supporting his claim of a regular<\/p>\n<p>       allotment and entitlement of &#8216;D&#8217; category Quarter in<\/p>\n<p>       accordance with the Rules regulating allotment of<\/p>\n<p>       Quarters.\n<\/p>\n<p>                   No arguments have been addressed from<\/p>\n<p>       any Rules regulating allotment of Quarter.<\/p>\n<p>                   Needless to state that, if the petitioner is<\/p>\n<p>       entitled to the allotment as per Rules, he cannot be<\/p>\n<p>       asked to vacate in favour of those, who may be<\/p>\n<p>       occupying    rented    accommodations    elsewhere.   He<\/p>\n<p>       cannot be asked to shift to rented accommodation,<\/p>\n<p>       except as per Rules.\n<\/p>\n<p>                   Let the District Magistrate consider and<\/p>\n<p>       decide the representation of the petitioner within a<\/p>\n<p>       maximum period of four months from the date of<\/p>\n<p>       receipt\/production of a copy of this order. Till such<\/p>\n<p>       disposal, the District Magistrate is expected not to take<\/p>\n<p>       any coercive action so as to render the representation<\/p>\n<p>       infructuous.\n<\/p>\n<p>                   The application stands disposed.\n<\/p>\n<\/p>\n<pre>P.K.
