              IN THE HIGH COURT OF JUDICATURE AT PATNA\n                      Cr.Misc. No.13683 of 2010\n    INDAL DAS son of Banwari Das, resident of village- Khadiha,\n                              P.S.Dhanarua, Distt. Patna.\n                                Versus\n                              petitioner\n\n                         1.   THE STATE OF BIHAR\n                               -----------\n<\/pre>\n

                              The petitioner has sought quashing of<\/p>\n
                   the    order      dated       22.2.2006    passed   by   the<\/p>\n
                   S.D.J.M. Mashaurhi in Dhanarua P.S Case No.<\/p>\n
                   111\/2005 by which he has refused to recall<\/p>\n
                   P.W    1   and    P.W     2     on   the   prayer   of   the<\/p>\n
                   petitioner.\n<\/p>\n
                                On     going        through      the   impugned<\/p>\n
                   orders,     I     find    that       the   petitioner    was<\/p>\n
                   present on the date of examination of these<\/p>\n
                   witnesses who were police officer and despite<\/p>\n
                   repeated calls the defence refused to cross<\/p>\n
                   examine     these    witnesses.        Even    though    this<\/p>\n
                   order was passed on 22.2.2006, the trial has<\/p>\n
                   not concluded even after four years due to<\/p>\n
                   dilatory tactics of the petitioner.<\/p>\n
                              In view of such the application is<\/p>\n
                   dismissed.\n<\/p>\n
                               The Sessions Judge Patna is directed<\/p>\n
                   to make an inquiry as to how the criminal
\n                             2<\/span><\/p>\n
         revision filed in the year 2006 was disposed<\/p>\n
         of about three years later. He is directed to<\/p>\n
         impress     upon       the   rest   of     the     Judicial<\/p>\n
         Officers    not    to    keep   such     matters    pending<\/p>\n
         which     unnecessarily delay the trials.<\/p>\n
