Justice V.GIRI\n\n Dated :15\/07\/2009\n\n O R D E R\n                              V.GIRI,J.\n                        -------------------------\n                  W.P ( C) No.19791 of 2009\n                       --------------------------\n                  Dated this the 15th July,2009\n\n                         J U D G M E N T\n<\/pre>\n<p>      Petitioner is aggrieved by Ext.P7 order passed by the<\/p>\n<p>Revenue Divisional Officer requiring him to remove all<\/p>\n<p>the earth deposited in his property. Petitioner challenges<\/p>\n<p>Exhibit-P7 on several grounds including the ground that<\/p>\n<p>it is without jurisdiction and at any rate , it is violative of<\/p>\n<p>the principles of natural justice in as much as that the<\/p>\n<p>petitioner was not heard before Exhibit-P7 order was<\/p>\n<p>passed. It is further contended that the land had been<\/p>\n<p>converted as dry land more than 20 years ago. An order<\/p>\n<p>in the nature of Exhibit-P7 should be passed only after<\/p>\n<p>notice to the concerned persons and after hearing them.<\/p>\n<p>Leaving other contentions open, I direct the Revenue<\/p>\n<p>Divisional Officer to treat Exhibit-P7 as a show cause<\/p>\n<p>notice. Petitioner will be entitled to file objections thereto<\/p>\n<p>within four weeks from the date of receipt of a copy of this<\/p>\n<p>judgment. Thereafter a hearing shall be convened and a<\/p>\n<p>W.P ( C) No.19791 of 2009<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>reasoned order may be passed by the RDO, including on<\/p>\n<p>the question as to whether he has jurisdiction to pass an<\/p>\n<p>order under the Kerala Conservation of Paddy Land and<\/p>\n<p>Wet Land Act 2008 and in the course of the same, he may<\/p>\n<p>also consider whether he has jurisdiction to pass an order<\/p>\n<p>under the Kerala Land Utilisation Order. Obviously, since<\/p>\n<p>Ext.P7 is directed to be treated only as a show cause notice,<\/p>\n<p>coercive proceedings shall not be taken except after final<\/p>\n<p>orders are passed by the Revenue Divisional Officer.
