Respondents\n\n        Petition under Article 226  of  the  Constitution  of  India  for  the\nissuance  of  a  Writ  of  Habeas  Corpus to call for the records of the first\nrespondent herein concerned in  Cr.M.P.No.59\/2005,  set  aside  the  order  of\ndetention  passed  therein  dated 24.09.2005 against the detenu and direct the\nrespondents to produce the detenu by name Ondimuthu S\/o Chinnaiyan before  the  \nCourt and set him at liberty, detained in Central Prison, Trichi.\n\n!For Petitioner         :  Mr.K.Manivasakam\n\n^For Respondents        :  Mr.M.K.Subramanian\n                Govt. Side)\n\n:O R D E R \n<\/pre>\n<p>(Order of the Court was made by P.SATHASIVAM, J.)   <\/p>\n<p>        The  petitioner is the sister of the detenu by name Ondimuthu, who was<br \/>\ndetained as &#8216;Bootlegger&#8217; as contemplated under the Tamil  Nadu  Prevention  of<br \/>\nDangerous   Activities  of  Bootleggers,  Drug  Offenders,  Forest  Offenders,<br \/>\nGoondas, Immoral Traffic Offenders, Slum Grabbers and Video Pirates Act,  1982<br \/>\n(Tamil Nadu Act 14 of 1982), by the impugned detention order dated 24.09.2005,<br \/>\nchallenges the same in this Petition.\n<\/p>\n<p>        2.   Heard  learned  counsel  for  the  petitioner  as well as learned<br \/>\nGovernment Advocate for the respondents.\n<\/p>\n<p>        3.  At the foremost, learned counsel for the petitioner submitted that<br \/>\nthere is unexplained delay in  the  disposal  of  the  representation  of  the<br \/>\ndetenu, which  vitiates  the  ultimate order of detention.  With regard to the<br \/>\nabove contention, learned Government  Advocate  has  placed  certain  details,<br \/>\nwhich show that the representation of the detenu dated 01.10.2005 was received<br \/>\nby  the Government on 07.10.2005 and remarks were called for on 10.10.2005 and<br \/>\nremarks were received by the Government on 19.10.2005.  Thereafter,  the  file<br \/>\nwas  submitted  on  20.10  .2005  and  the  same  was  dealt with by the Under<br \/>\nSecretary and Deputy Secretary on the  same  date  i.e.    on  20.10.2005  and<br \/>\nfinally,  the Minister for Prohibition and Excise passed orders on 21.10.2005.<br \/>\nThe rejection letter was prepared on 28.10.2005 and the same was sent  to  the<br \/>\ndetenu on  29.10.2005 and served to him on 03.11.2005.  As rightly pointed out<br \/>\nby the learned counsel for the petitioner, though the Minister for Prohibition<br \/>\nand Excise passed an order on 21.10.2005, there is no explanation at  all  for<br \/>\ntaking time  for  preparation  of  rejection  letter  till 28.10.2005.  In the<br \/>\nabsence of any explanation by the person concerned even  after  excluding  the<br \/>\nintervening  holidays,  we are of the view that the time taken for preparation<br \/>\nof rejection letter is on the higher side and we hold that the said delay  has<br \/>\nprejudiced the  detenu  in disposal of his representation.  On this ground, we<br \/>\nquash the impugned order of detention.\n<\/p>\n<p>        4.  Accordingly,  the  Habeas  Corpus  Petition  is  allowed  and  the<br \/>\nimpugned order of detention is set aside.
