By
\n\tmeans of filing this application u\/s.5 of the Limitation Act, the
\n\tapplicant has prayed to condone the delay of 12 days caused in
\n\tpreferring the appeal challenging the impugned judgment and order
\n\tdated 27.10.2010 rendered by ld.Judge of ESI Court in ESI Second
\n\tAppeal No.23 of 2006. The ground for which the delay came to be
\n\tcaused have been set-forth in the application, which is supported by
\n\taffidavit of Officer of applicant – Corporation.\n<\/p>\n
None
\n\tappeared for the respondent.\n<\/p>\n
Having
\n\theard the submissions advanced by ld.advocate Mr.Vasavada for the
\n\tapplicant and considering the grounds stated in the application,
\n\twhich is supported by the affidavit and considering the extent of
\n\tdelay, this Court is of the opinion that sufficient cause is shown
\n\tfor condonation of delay and, therefore, delay deserves to be
\n\tcondoned.\n<\/p>\n
For
\n\tthe foregoing reasons, delay of 12 days caused in preferring the
\n\tappeal, is condoned.\n<\/p>\n
Rule
\n\tis made absolute.\n<\/p>\n
