3. We have heard Sri.G.Gangireddy, learned counsel for<\/p>\n
the appellant and Sri.S.Ramdas learned senior counserlillfor<\/p>\n
M\/ s. Sundaraswamy 8: Ramdas, Advocate?”for’;-I _<\/p>\n
respondents.\n<\/p>\n
4. It is contended on behalf of the”a_ppellant’  <\/p>\n
several charges were framed against the   respect
\nof these charges, there loss  to the
\nbank. There were certain” which
\nwere not appai’entljr*  vva.ppellant and in the
\nabsence of   to the bank the
\naward  is a major penalty is
\n He further submits that<\/p>\n
the enquirydwasv also Vi-tiated in as much as the documents<\/p>\n
 g_vreq1.1:e5s.tedp’for by Altheappellant were not furnished and that<\/p>\n
 there-.was_lViolation of principles of natural justice and this is<\/p>\n
a 1’it.caseVWl’.ierep1’the award of punishment has to be set aside.<\/p>\n
   _pe19 contra, learned counsel supporting the decision of<\/p>\n
—  the ‘disciplinary authority as well as the learned single Judge<\/p>\n
” has submitted that the charges against the o\ufb01icer were with<\/p>\n
regard to not obtaining sanction for the disbursement of loan<\/p>\n
and several other procedural irregularities, as a result of<\/p>\n
93:.\n<\/p>\n
issues except for one issue the Enquiry Officer recorded a
\n\ufb01nding, that the charges levelled against the oraee1:’i~l_:l<\/p>\n
respect of twelve issues had been proved.<\/p>\n
‘7. As far as the non–furnishing_ of:-..thfe ‘deeen;e’ntgi\u00a7\u00a7_ae.ee7<\/p>\n
concerned though \ufb01fteen docurrientsdgvlere _:\u00a7the <\/p>\n
appellant, five documents wereV’Vl’\ufb01trr1i.shed learned
\nsingle Judge has given\ufb02a  that the
\ndocuments which were  appellant by the
\nEnquiry Officer;irrelevant;to'”the”:charl\u00a7es framed against
\nthe appellantilarildi essential to determine
\nthe disputs\ufb01 ,  thelllapplication made by the
\nof documents and apart from<\/p>\n
the five documents ‘which’~~–itrere ordered to be furnished to<\/p>\n
~'”~._the  the \u00ab\u00ab\u00ab\u00ab —other documents related to the<\/p>\n
l.’–..Aperl.”orl?nance”the petitioner as a Branch Manager which<\/p>\n
.are.i1″l=’nolvxtlgrlilconcemed with the charges framed by the<\/p>\n

  The learned single Judge has also recorded that the<\/p>\n
‘v\ufb01lcloncluct of the Enquiry O\ufb01icer was in accordance with the<\/p>\n
it rules of natural justice and that the same cannot be faulted<\/p>\n
with. As far as the nature of the penalty imposed is<\/p>\n
9\u00bb<\/p>\n
I<\/p>\n
concerned, it is seen that the disciplinary authority imposed<\/p>\n
a penalty of compulsory retirement, which was by<\/p>\n
the appellate authority. The learned single  _<\/p>\n
regard to the fact that there were as    <\/p>\n
accounts amounting to Rs. 36.56  iwerel <\/p>\n
without following proper procedure or yeri\ufb01cati’oi*J <\/p>\n
that the appellant had exceededVl’i’his authoiityi  sanctioning
\nthe said loans althougliilie  powered to do so,
\nIt has also been noted  Judge that
\ncertain loans},   taking collateral
\nsecurity of  exposing funds of the
\nbank totvthe   lalthough there has been
\nno actual  by the appellant, but<\/p>\n
considenngl;”t.he’ fact AAt}_ia’t~*;the appellant was dealing with<\/p>\n
 =   fiinds_, he was-duty bound to take all care and caution<\/p>\n
 While .di’sbursing—-loans to customers of the respondent\/ bank.<\/p>\n
‘p9. it .. ‘Considering the total number of loan accounts in<\/p>\n
 llfrespecpt  which the appellant had not followed proper and<\/p>\n
—  requisite procedure, we are of the view that the learned<\/p>\n
” “single Judge was justified in not interfering with the penalty<\/p>\n

appellate authority and we find no good ground to take<\/p>\n
contrary View in the matter.\n<\/p>\n
10. For the aforesaid reasons we find that  .appeal <\/p>\n
