The brief facts giving vriseto the pgirezgent&#8217; case&#8217;,,as ; <\/p>\n<p>per the prosecution story are, as.fo\u00a7i_oi;$}s:&#8217;ii&#8221;\u00ab   .<br \/>\nAccused No.3 is the-son as Accuse&#8217;d;;Nvof1 and _2&#8242;..<\/p>\n<p>Deceased Manjavva,   and 16<br \/>\nSmt.Kashawa and eatieptia  _Madar,&#8221;was married<br \/>\nto accused __E\\io.3 _.o.n:&#8217;_&#8217;\u00ab.8..4V.;i.0G0tv.'&#8221;b~:&#8217;..&#8217;:vvieccording to the<\/p>\n<p>proisecetioVnV,&#8221;7a:&#8217;t..:g&#8217;the&#8217;=.tirne&#8217; of marriage talks, there was<br \/>\ndemandof  the form of cash as weii as gold<\/p>\n<p>eii\ufb01amentsnandiaiiter negotiations, the accused agreed to<\/p>\n<p>  of Rs.5,000\/~ and goid weighing 2-1\/2 thoias.<\/p>\n<p> ~. hit&#8217;is&#8221;t:h&#8217;e\u00ab._ce;se. of the prosecution that though initiaiiy, the<\/p>\n<p>reiatiognshiip between the deceased and her husband and<\/p>\n<p>it &#8221; =\u00a7n_-tents was cordiai, Eater on they started iii-treating and<\/p>\n<p>harassing her for not bringing enough dowry as they had<\/p>\n<p>0 demanded and uitirnateiy had resulted in the death of<\/p>\n<p>Manjavva on 31.10.2000 by committing suicide by setting<\/p>\n<p>herself on \ufb01re.\n<\/p>\n<\/p>\n<p>3. Coming to the incident, accordih&#8217;g&#8217;\u00ab\u00ab&#8217;..&#8217;_&#8217;te\u00a37 <\/p>\n<p>prosecution, in the evening of,,%s1.1o,2edd,i.c <\/p>\n<p>accusw and the deceased were\ufb02in thceflhe-use&#8217;,&#8221;*on&#8221;Vhearinsg<\/p>\n<p>the cry of Manjawa, peepie gath_e&#8217;red, <\/p>\n<p>inside, they saw her bodyvut4t&#8221;eingu,i_fed'&#8221;saith&#8221;: \ufb01re. After<br \/>\nexxtinguishing \ufb01re,  was shi&#8217;fi:ed.\ufb02tehospital, wherein<br \/>\nshe succumbedto the. day. In the<\/p>\n<p>interregnum,&#8217; the  PW.9 Giriyappa<\/p>\n<p>Fakircaehta&#8221;Mad,ar,;;&#8217;eVs  a &#8216;case of un-naturai death, the<br \/>\njurisdixc\ufb02dnai &#8216; pdliifcei&#8221;&#8211;~.reg.istered a case under UDR<\/p>\n<p>No.2?\/2056 ,_:and&#8217;v&#8217;*inquest proceedings was held under<\/p>\n<p> &#8216;Sections: 1% orV&#8217;Cr;&#8217;P&#8217;.c. During the inquest, as it was<br \/>\n &#8216;Vieiieaied;.t4h&#8217;et:&#8217;_Manjavva died within 7 years of marriage<br \/>\n demand, acceptance as wait as harassment<\/p>\n<p> and creeity over not meeting the further demands of the<\/p>\n<p>eccizsed, the case in Crime No.135\/2000 came to be<\/p>\n<p>h   registered against ail the accused for the offences under<\/p>\n<p>sections 498&#8211;A, 306, 304-3 IPC as weii as under Sections<\/p>\n<p>3, 4 and 6 of the Act.\n<\/p>\n<p><span class=\"hidden_text\">5<\/span><\/p>\n<p>4. The usual procedures like holding of mahazars,<br \/>\nsending the dead body for autopsy, gathering evidence<\/p>\n<p>including recording the statements of witn%ses*&#8217;:.f&#8217;a&#8211;n&#8217;d,4<\/p>\n<p>neighbours takes place and thereafter charge   <\/p>\n<p>against the accused for the aforesai.d*~offencesy&#8221;  &#8221; <\/p>\n<p>5. On committal, the learned Sessions Judge it<\/p>\n<p>the accused..tfo;.&#8217;the}3&#8243;afo~resaidA&#8221;ofi&#8217;ences. As the accused<br \/>\ndenied the  to be tried, they are tried<\/p>\n<p>in s.c.No.1s7\/2ooii1l &#8216;  <\/p>\n<p>  prosecuhtihon has relied upon the evidence of<\/p>\n<p>wi_tnesses_  home the guilt of the accused as well<\/p>\n<p>it  _ as r&#8221;e\u00ab!.ian.;:&#8217;e&#8217; placed on Exs.P1 to P21 and Mos.1 to 6.<\/p>\n<p>completion of the evidence of the prosecution, when<\/p>\n<p> &#8216;ecicused were questioned under Section 313 Cr.P.C.,<\/p>\n<p> have simply denied the prosecution case as false.<\/p>\n<p>it  &#8221; &#8221; &#8216;Neither explanation is offered nor any defence evidence is<\/p>\n<p>led except marking Exs.D1 to D4, marked portions from<\/p>\n<p>the statements of PWs.11, 15 and 22 recorded during the<\/p>\n<p>5\/&#8221;\n<\/p>\n<p>investigation. On appreciation of evidence&#8230;'&#8221;&#8216;aVs&#8221;-.fa!.l&#8217;ea\u00a73Y<\/p>\n<p>noted, the trial Court giving benefit of doubtgjaceaiiitedhthan <\/p>\n<p>accused of all the charges. :He&#8217;nce,tthe  V&#8221;i:\u00abhe&#8217;i. <\/p>\n<p>State.\n<\/p>\n<p>7. Smt.Gayathri,  .Add&#8217;iti&#8211;o_nai&#8217;:  Public<br \/>\nProsecutor for the the entire<br \/>\nevidence,  judgment of<br \/>\n3C\u20aclUFtt3l  illegal, contrary to<br \/>\nthe evidentwnr she submitted that as admittedly,<br \/>\ndeath&#8221;of:&#8221;ManjatAi&#8217;a&#8217;  hardly within 6 months of<\/p>\n<p> rnarriageand as there was cogent evidence regarding<\/p>\n<p>  dowry&#8217;; acceptance of the same and harassment<\/p>\n<p>I  accused, the presumption available under<\/p>\n<p>Section  A and B ought to have been considered by the<\/p>\n<p> .. tr_ial.&#8221;Court. It is submitted that as the \ufb01ndings and<\/p>\n<p>it f&#8221;c~onclusion arrived at by the trial Judge are illegal and<\/p>\n<p>perverse, the impugned judgment and conviction is liable<\/p>\n<p>to be set aside and accused be convicted for the said<\/p>\n<p>offences. gr,&#8217;<\/p>\n<p>8. As the accused were indigent persons and had not<br \/>\nengaged any counsei, this Court requested Sri<br \/>\nS.S.Doddarnani, iearned advocate to assist the<br \/>\nAmicus Curiae. Defending the judgment<br \/>\nlearned Amicus Curiae contended\u00e9g  &#8221;\n<\/p>\n<p>prosecution case is full of contradictioin&#8217;s&#8217;~and&#8217;~omi\u00a7siens&#8212;<\/p>\n<p>as such, the trial Court was._justi\ufb01ed  .g_ivi:n&#8217;\u00a7;_ji:i&#8211;en.ei*it <\/p>\n<p>doubt. Taking us through thgeelvvideunce of &#8220;the pgrosecution<\/p>\n<p>witnesses,&#8221;heiespecifaiiy\ufb02&#8217;&gt;.sV}:hose&#8221;&#8221;&#8221;&#8216;e\u00a7&lt;amined to show the<br \/>\ndemand, -accepte_nce\u00ab.._:t&#039;i&#039;e.nd further harassments, he<\/p>\n<p>contended&quot;th_at,.Vthereiis total contradictions as to the<\/p>\n<p>  arno\u00b0un.tVidemandedwtry the accused. According to him, the<\/p>\n<p>&#039;arnoun_&#039;t..;isa&quot;&#039;id:&#039;*to have been demanded ranges from<\/p>\n<p> to Rs.25,000\/- and varies from witness to<\/p>\n<p> witnessA.&#039;i- Simiiariy, there is contradictory evidence as to<\/p>\n<p> thejpiace of marriage talks as to whether it took place at<\/p>\n<p>h   M __&#039;i*4iummagatti or Jeeragwada. Few witnesses have spoken<\/p>\n<p>to the piece as Jeeragwade and others at Mummagatti.<\/p>\n<p>Reiying upon the evidence of PW.9, the \ufb01rst informant, it is<\/p>\n<p>6%&quot;\n<\/p>\n<p>marriage, is estabiished and is unquestionabiegf&#8217;Ea;;h_:<br \/>\nof the witnesses have admitted that within3uAsi~..\u00a2$&#8221;A~irionthL:s &#8211;\u00ab<br \/>\nof the marriage, Manjawa met with u_n~ln&#8217;at&#8217;ural..&#8221;dea*thv.i:_&#8217;_Vbut<\/p>\n<p>the question further to be censidereldisg wheth&#8217;er  dgeath  s<\/p>\n<p>was accidental or suicidal ar_i_l:d.&#8217;,v:if,suici&#8217;da.i,_&#8217;Whether the<\/p>\n<p>accused were responsible&#8217; f_or._th;g-&#8216;.: .sa:.&#8217;ne.&#8221;~l _<\/p>\n<p>11. So,fa&#8217;r:.;ai_s  except<br \/>\nthe  accused suggated in the<br \/>\nC7055,&#8221;&#8216;\u00e9*3TilE?i.#fl5\u00a7!&#8217;;&#8217; :&#8221;&#8216;a&#8221;l&#8217;we:&#8217;-it\ufb01llntfabsoluteiy no supportive<br \/>\nmateriel.&#8221; tit  accused through some of<\/p>\n<p>theV_igvitn&#8217;esees .Vsvugdgest&#8211;iveiy that while Manjawa was<\/p>\n<p> f00d'&#8221;o&#8211;~n.~a kerosene stove, accidentally her<br \/>\n&#8220;caught fire and she succumbed to the<br \/>\nllinjuries, story of accidental fire, is belied by the<br \/>\n scieritic. ex&#8217;\/idence available on record. PW.18 Mallesh,<br \/>\nA n.i=:o&#8217;rensic expert examined by the prosecution speaks that<\/p>\n<p>h   &#8216;after the spot mahazar, the articles lying near the scene of<\/p>\n<p>offence viz., the burnt sari pieces, hair pieces, mud and<\/p>\n<p>beeds worn by the deceased were subjected to forensic<\/p>\n<p>5\u00bb<\/p>\n<p>test and in chromography test, out\u00bbAAof&#8221;-iritems <\/p>\n<p>burnt pieces of sari and other, pieces..of&#8211;._half  <\/p>\n<p>with ash, there was positive presence of**lger&#8217;osenAe.v,:residue<br \/>\non these articles. Thatmdicatles has &#8216;presence<br \/>\nof kerosene on the  .Aijdeceased which<br \/>\nultimately caught\ufb01re.  there was<br \/>\neven  dtlei.to kerosene stove as<br \/>\none peruses the spot<br \/>\nmahazar,  the scene of offence, (though<\/p>\n<p>not marked);inimediateljftaken by PW.8, we do not find<\/p>\n<p>of lceroisene stove. On the other hand, the<\/p>\n<p>&#8216;consists of a small kitchen with traditional<\/p>\n<p>stoxie  thy arranging 3 stones. Neither the<\/p>\n<p>vii&#8217;&#8230;,_&#8221;wphotogtra&#8217;phs nor the mahazar show that there was any<\/p>\n<p>A &#8220;:jprepa&#8217;ratlon made or in progress for cooking the food and<\/p>\n<p>it  such, the story that Manjavva caught \ufb01re while<\/p>\n<p> .  preparing food on a kerosene stove receives its \ufb01rst dent.<\/p>\n<p>More over, if It was an accidental fire, as the presence of<\/p>\n<p>all the 3 accused in the house at the time of incidence, is<\/p>\n<p>5\u00bb<\/p>\n<p><span class=\"hidden_text\">11<\/span><\/p>\n<p>not much in dispute, their silence and in fact denial of the<\/p>\n<p>entire prosecution case, goes against them.<\/p>\n<p>12. Keeping aside this silence <\/p>\n<p>explanation of the accused, if one:-p&#8217;eruseso&#8217;f_ it<\/p>\n<p>the prosecution witnesses, viz.,  <\/p>\n<p>totally independent persons,  sen_se,.,,Ath:e$i~&#8211;.vVh&#8217;ave no &#8221; it<\/p>\n<p>axe to grind against the accu.sed,&#8221;&#8216;-\u00bb..have\u00ab&#8221;cogentiy and<\/p>\n<p>consistently stated before&#8217;  during the<\/p>\n<p>marrlavge&#8221;VVt&#8217;aiits,v   of cash and gold<br \/>\nornaments and&#8211;v\u00a7li&#8217;ejia._&#8217;th.e&#8221;pa:Ients of the deceased pleaded<\/p>\n<p>their inability to  a demand, at the intervention<\/p>\n<p> *-of  el.ders,&#8221;Vit&#8221;was reduced to Rs.5,000\/&#8211; sash and 2-<\/p>\n<p> 1;f;&#8221;tha:a\u00a7 M3,, In this regard, though as rightiy pointed<\/p>\n<p>outiay t.heri,earned Amicus Curiae, certain variation as to<\/p>\n<p>the \ufb01gure of cash amount viz., whether it is Rs.10,000\/&#8211;<\/p>\n<p>&#8220;&#8216;i:V&#8217;,AARs,.iAf5,O00\/- or Rs.20,000\/-, in our considerate view, that<\/p>\n<p>. hardly makes any difference. The concept of higher<\/p>\n<p>demand as spoken to by these witnesses may be even<\/p>\n<p>exaggeration to some extent. It is well settlw that mere<\/p>\n<p>g\ufb01s<\/p>\n<p>I2<\/p>\n<p>exaggeration to some extent, would not be <\/p>\n<p>the witnesses to hold them as totally f_als:e,.::,es_peciei&#8217;l3r\u00ab,_,<\/p>\n<p>when there is admitted anxietfm 3th_e<\/p>\n<p>witnesses to highlight their cese. vCi&gt;&#8217;nehas  in e&#8217;<\/p>\n<p>the doctrine of falsus in uneleilfalsus &#8216;in lomni\ufb01us is not<\/p>\n<p>applicable to the crivrijjfiinal  the &#8216;\\l\\?&#8217;itnV9esses are<br \/>\npartly truthful and partlyunt&#8217;ruthful..,6Eeeiteggeration, it is<br \/>\nthe duty ef tl&#8217;:e&#8221;\u00a7\u00e9urt:=to ::seearate&#8217;&#8211;t3ra..ifle of truth from the<\/p>\n<p>chaffs of  \u00a7g;gge&amp;atl&#8217;\u00a2n;er &#8216; It is well settled that<\/p>\n<p>when lathe   acceptable and move, the<br \/>\nCourt h&#8217;a&#8217;s__&#8217;to_ ai:cei:it= and further if chaff or<\/p>\n<p>falsehedd is rnerfe than the grains of truth, bene\ufb01t of doubt<\/p>\n<p>. can iseigiyenlto the accused.\n<\/p>\n<p>H   these principles in mind, on analysing<\/p>\n<p> and reiessessing the entire evidence, we find that even<\/p>\n<p>  the-u,ghvV&#8221;there are minor discrepancies as to the place of<\/p>\n<p>xnnarriage talk or the exact amount demanded by the<\/p>\n<p> weccused, the fact remains that there was a demand and<\/p>\n<p>that was partially satis\ufb01ed by the parents of the deceased<\/p>\n<p>33-&#8216;<\/p>\n<p><span class=\"hidden_text\">13<\/span><\/p>\n<p>by paying a dowry of Rs.5,000\/- in cash and  <\/p>\n<p>1\/2 tholas. So far as later part isbAAconcern&#8217;ed&#8211;.i&#8217;fabsoiluteiyit &#8216;\u00bb <\/p>\n<p>there is unanimity in the prosecutien evidence; -\ufb01le suit-h__, <\/p>\n<p>can be safely held that therewas delrland of  <\/p>\n<p>accused and the parents  .sarne&#8221;tovtheiislnaller<br \/>\nextent. Thereafter,    __versioh of the<br \/>\nparents and close rfelatwese _l:yelli~eyeefelaerly villagers<br \/>\nwhom the  \u00abnet  the village to<br \/>\ncelebrateyyyhjea  ..:(V:l_V::a:9a::\u00a3&#8217;aVl3anchami), she had<br \/>\ncomplained   the cruelty or harassment<\/p>\n<p>meted vvalcelisedunot bringing the dowry as<\/p>\n<p> dernanded by  There is absolutely no inconsistency<\/p>\n<p> in: this reeardend as their evidence is unanimons, cogent<\/p>\n<p> to be accepted. At this stage, we<\/p>\n<p>  ey would llketoilposnt out that the trlal Court has rejected the<\/p>\n<p>&#8220;Vi\ufb02&#8211;.evidence&#8221;&#8216;of all these witnesses solely on the ground that<\/p>\n<p>they are interested as they are related to the deceased.<\/p>\n<p>T  &#8216;Mere relation with the deceased or the victim cannot be a<\/p>\n<p>V x sole ground to discard the evidence of these relatives.<\/p>\n<p>They would be the last persons to falsely implicate the<\/p>\n<p>$1\u00bb<\/p>\n<p>I4<\/p>\n<p>accused and unless the accused even by  <\/p>\n<p>show that these or each one of thae <\/p>\n<p>persona! enmity with them, there  <\/p>\n<p>accepting the evidence of therelative&#8212;-ylrltnesses&#8217;._a&#8217;s&#8221; ions&#8217;; as <\/p>\n<p>it is corroborated and free frornu.:VV:.c_loubt.  &#8220;_i&#8217;s:.Vrel;\u00e9-quaint to<br \/>\nnote that the trial Court:_&#8217;has &#8216;Vsight&#8221;&#8216;vvl&#8217;o.f.thislverellv settled<br \/>\nprinciple. Even otherwise,&#8217;-&#8216;aoart vll*.F.iV_*.\u00a3l,=,&#8217;_&#8217;..relatives, the<br \/>\nprosecution  elr_ldence &#8220;olf:Ilhdei)T.endent villagers,<\/p>\n<p>neighbours   parents regarding the<\/p>\n<p>demand&#8217;, a.cco.ete.nfce&#8217;  as well as the further<\/p>\n<p>harassment\ufb01srvv n&#8217;o_t&#8221; the demands in entirety.<\/p>\n<p> Strangeiy;~ the trialtiourt has ignored their evidence. We<\/p>\n<p>.,t:het.iAtl1e&#8211;:rea$oning of the trial Court and the conclusion<\/p>\n<p>arrilihed at:\\ri\u00bbz.,&#8217;V~li;(a) the witnesses are all related and hence<\/p>\n<p>V &#8211;VinterestedA.  discrepancy as to the dowry amount<\/p>\n<p>Hit&#8217;Vl&#8217;t\ufb02rlerraa\u00a2nded, appears to be not only illegal but perverse<\/p>\n<p> Similarly the conclusion of the trial Court at para<\/p>\n<p>T  &#8216;:&#8217;l&#8217;3l of the judgment that PWs.15 and 16 belong to lower<\/p>\n<p>V U strata in the society and as such are unable and pay<\/p>\n<p>dowry, is far from reality. The devil of dowry is prment<\/p>\n<p>5&#8243;&#8216;<\/p>\n<p><span class=\"hidden_text\">15<\/span><\/p>\n<p>irrespective of the people belonging to the different<br \/>\nof life, whether they are poor or rich and<br \/>\nassessment of the entire evidence, .._we :t;ha&#8217;t&#8217; .&#8217;_i_:he&#8217;s-._ RV&#8217;<\/p>\n<p>conciusion arrived at by the trial (?ourt*tiein&#8217;g<\/p>\n<p>perverse, are iiable to be interfered with: _ _<br \/>\n14.0n assessment of the ieuidence, wei\ufb01nd that the<\/p>\n<p>prosecution has succeeeed sh&#8211;o\u00bbti:i&#8217;ng\u00bb..tAthat when woman<br \/>\ndied by un-naturai death.
