BASANT, J.\n              --------------------------------------------\n                       B.A. NO. 5064 of 2007\n              --------------------------------------------\n            Dated this the 23rd day of August, 2007\n\n                              ORDER\n<\/pre>\n<p>      Application for regular bail.        The petitioner &#8211; a person<\/p>\n<p>aged about 19 years, now faces allegations for offences<\/p>\n<p>punishable, inter alia, under Secs.376 and 306 of the IPC.        A<\/p>\n<p>girl aged about 14 years &#8211; sister of a close friend of the<\/p>\n<p>petitioner, committed suicide on 23\/6\/07.              She committed<\/p>\n<p>suicide by hanging.        An F.I.R. was registered under the<\/p>\n<p>caption &#8220;unnatural death&#8221; and enquiry under Sec.174 of the<\/p>\n<p>Cr.P.C. commenced.        The post-mortem certificate allegedly<\/p>\n<p>revealed that the girl was used to sexual intercourse.          The<\/p>\n<p>eyes of suspicion fell on the petitioner. Certain materials have<\/p>\n<p>been collected to indicate that the petitioner was in love with<\/p>\n<p>the deceased girl.    There are indications to suggest that the<\/p>\n<p>petitioner had sexual intercourse with that girl. The girl being<\/p>\n<p>one aged below 14 years, if sexual intercourse is indicated,<\/p>\n<p>that must be held to amount to an offence of rape under law.<\/p>\n<p><span class=\"hidden_text\"> B.A. NO. 5064 of 2007          -: 2 :-<\/span><\/p>\n<p>The petitioner was arrested on 26\/7\/07. He continues in custody<\/p>\n<p>from that date.\n<\/p>\n<p>      2. The learned counsel for the petitioner submits that even<\/p>\n<p>accepting the entire allegations, the petitioner does not deserve<\/p>\n<p>to be detained in custody any longer.      He is also a very young<\/p>\n<p>person. He is a student of Plus 2 course in the same school in<\/p>\n<p>which the deceased was a 9th Standard student. Even accepting<\/p>\n<p>all the allegations, the learned counsel for the petitioner submits<\/p>\n<p>the petitioner does not deserve to continue in custody.<\/p>\n<p>Appropriate conditions may be imposed and the petitioner may<\/p>\n<p>be enlarged on bail, submits the learned counsel for the<\/p>\n<p>petitioner.\n<\/p>\n<p>      3. The learned Public Prosecutor opposes the application.<\/p>\n<p>The learned Public Prosecutor submits that the allegations<\/p>\n<p>reveal   great depravity of mind.      The petitioner was the friend<\/p>\n<p>of the 14 year old girl.    He had exploited the relationship and<\/p>\n<p>had indulged in sexual intercourse with that girl below the age of<\/p>\n<p>consent. This amounts to an offence of rape. Her suicide is also<\/p>\n<p>attributable to such relationship.     Therefore, the offence under<\/p>\n<p>Sec.306 of the IPC is also revealed. In these circumstances, the<\/p>\n<p>petitioner may not be enlarged on bail, urges the learned Public<\/p>\n<p><span class=\"hidden_text\"> B.A. NO. 5064 of 2007         -: 3 :-<\/span><\/p>\n<p>Prosecutor.\n<\/p>\n<p>     4.   I   have    considered      all  the relevant    inputs.<\/p>\n<p>Notwithstanding     the  opposition      by the  learned    Public<\/p>\n<p>Prosecutor, I am satisfied that the petitioner, in his late teens,<\/p>\n<p>can now be released on bail subject to appropriate terms and<\/p>\n<p>conditions.   In coming to this conclusion, I have taken note of<\/p>\n<p>all the relevant inputs including the nature and gravity of the<\/p>\n<p>allegation, the quality and quantum of the materials collected,<\/p>\n<p>the age of the petitioner as well as the deceased, the fact that<\/p>\n<p>they were both students of the same school and the stage of<\/p>\n<p>investigation.  Appropriate conditions can be imposed to allay<\/p>\n<p>any legitimate apprehensions of the Investigator\/the learned<\/p>\n<p>Public Prosecutor.\n<\/p>\n<p>     5.   In the result:\n<\/p>\n<p>     (a) The application is allowed.\n<\/p>\n<p>     (b) The petitioner shall be released on bail on the following<\/p>\n<p>terms and conditions:\n<\/p>\n<p>     (i) The petitioner shall execute a bond for Rs.25,000\/- with<\/p>\n<p>two solvent sureties each for the like sum to the satisfaction of<\/p>\n<p>the learned Magistrate.\n<\/p>\n<p>     (ii) The petitioner shall make himself available          for<\/p>\n<p><span class=\"hidden_text\"> B.A. NO. 5064 of 2007         -: 4 :-<\/span><\/p>\n<p>interrogation before the Investigating Officer on all Mondays and<\/p>\n<p>Fridays between 10 a.m. and 12 noon for a period of three<\/p>\n<p>months.\n<\/p>\n<p>     (iii) The petitioner shall not enter the jurisdiction of the<\/p>\n<p>Pooyappally Police Station until further orders without prior<\/p>\n<p>permission of the learned Magistrate, except for the purpose of<\/p>\n<p>complying with Condition No.(ii) above.<\/p>\n<p>                                                    Sd\/-\n<\/p>\n<p>\n                                           (R.
